About this file
This attachment outlines the Minority and Women's Business Enterprise (MWBE) subcontractor commitment requirements for a State of Indiana Request for Proposal, governed by Indiana Code 4-13-16.5 and 25 IAC 5. Respondents may propose MWBE subcontractor commitments as part of their bid, with all subcontractors required to be listed on the State of Indiana Certified M/W/IVOSB directory at the time of proposal submission. The commitment applies throughout the entire contract term, including any period following the initial term. Respondents must submit completed MWBE Subcontractor Commitment Forms along with signed letters of commitment from each proposed subcontractor, with the subcontract amounts matching corresponding entries in the bid cost template.
Prime contractors must ensure proposed subcontractors meet specific criteria, including current state certification, proof of certification status via IDOA letter, classification as only MBE, WBE, or IVOSB, and provision of valuable scope contributions within their certified industry area. Certified prime contractors cannot count their own workforce to meet subcontracting goals and must use other certified firms instead. Each subcontractor letter must be on company letterhead, signed, and include the subcontract amount, percentage of total bid amount, description of products or services with applicable UNSPSC code, and approximate performance dates. The State may deny evaluation points if required documentation is missing, unsigned, or if amounts do not match. Failure to meet MWBE participation goals does not affect proposal evaluation. Questions regarding MWBE requirements should be directed to the Division of Supplier Diversity at (317) 232-3061 or https://www.in.gov/idoa/mwbe.
