About this file
This is an Addendum #4 to Bid Invitation 3075-26 issued by the New Hampshire Department of Administrative Services, Division of Procurement and Support Services, for an office supplies contract. The addendum addresses six questions submitted by potential bidders regarding contract terms and conditions prior to the revised bid closing date of October 30, 2025, at 1:00 PM. The original bid solicitation outlined a five-year contract term extending through November 30, 2030, with potential two-year extensions, requiring vendors to bid on at least 90% of line items across multiple product categories including computer accessories, desk supplies, envelopes, files, binders, labels, notebooks, paper, and writing supplies.
The addendum clarifies several key contract provisions without material modifications to the original terms. The State declined to modify pricing lock provisions for paper and printer ink, confirm changes to audit language that would incorporate confidentiality protections and third-party auditor approval requirements, or clarify p-card payment restrictions. However, the State confirmed that Paragraph 32 (Performance Guarantees) has been removed from the bid, and provided clarification that Appendix A will become Exhibit A in the resulting contract while Exhibits B and C will comprise the remaining contract language. The State indicated willingness to consider revisions to RFB terms and Agreement General Provisions to align with vendor capabilities, though no specific modifications were detailed in this addendum. All changes noted in the addendum supersede previously submitted documents and must be submitted with the bid response.

ADDENDUM # 04 TO BID INVITATION 3075-26
DATE AND TIME OF BID CLOSING: 10/30/2025 1:00 PM
FOR: Office Supplies
This bid is hereby changed as follows.
Question 1: On page 6, paragraph 16 and 17 regarding bid prices and adjustments. Would the State consider modification to the price locks for paper and ink/toner?
State Response: The State will not accept modifications of pricing on paper and printer ink.
Question 2: On page 7, paragraph 18 regarding audits and accounting. In the audit provision, would the State consider revising the language so that, subject to confidentiality obligations between the contractor and third parties, the customer may audit non-confidential books and records at its expense to confirm correct pricing? Additionally, would the State allow the contractor to require that any third-party auditor be subject to contractor approval and execute a non-disclosure agreement?
State Response: All state contracts are considered public information with certain exceptions to information regarding HIPAA, national security, etc. The State does not use third parties to perform audits in this scenario.
Paragraph 18 of the bid document remains unchanged.
Question 3: On page 8, paragraph 24 regarding payment. Would the State consider clarifying that purchasing cards (p-cards) may not be used for invoice payments, and that if p-cards are used, payment must be made at the time of order?
State Response: The resulting contract does not mandate that only P-cards may be used but is one method of payment. Paragraph 24 of the bid document remains unchanged.
Question 4: Will the State consider incorporating revisions to the RFB terms including the Agreement General Provisions to align with our capabilities?
State Response: The State may consider revisions to the terms.
Question 5: Question 4 requested the removal of Paragraph 32 (Performance Guarantees), however, the State’s response indicated Paragraph 45 was removed. Will the State please modify this response to indicate Paragraph 32 is removed from the bid?
State Response: Correction to question 4 on Addendum #1. Paragraph 32 is hereby removed from the bid.
Paragraph 45 remains included in the bid.
Question 6: The purchase order terms and conditions reference Exhibits A, B, and C, but have not been provided.
Will the State please clarify what exhibits will be included in the resultant contract and provide any Exhibits which were not included in the original RFB release?
State Response: Appendix A in the bid (beginning page 14) will become Exhibit A. Exhibits B and C will become the remaining contract language from the bid. The resulting contract will be sent to the awarded Vendor at the time the award is made and will be effective once all parties have signed.
