RFP #60-00000-26-00092 Temporary Employment Services – Response to Offerors Questions
This document is a Question and Answer response document issued by the State of New Mexico on behalf of NASPO ValuePoint for a Request for Proposals to establish Master Agreements for Temporary Employment Services. The procurement seeks to award contracts for managed service provider (MSP) operations across six staffing categories: Administrative, Commercial and Industrial, Educational, Healthcare (Clinical and Non-Clinical), Information Technology (Professional and Non-Professional), and Professional Services (excluding IT). The RFP is open to qualified bidders nationwide, with services to be delivered across all 50 states, the District of Columbia, and U.S. territories. Offerors may bid on one or more categories without a minimum requirement. Technical proposals are consolidated into a single submission regardless of the number of categories proposed, with a 55-page limit across seven sections. The proposal deadline is August 11, 2026, at 3:00 PM MST, with organizational references due by the same deadline. The Offeror Response Worksheet requires specific formatting but does not mandate font size, margins, or line spacing. Oral presentations, demonstrations, or system walkthroughs may be requested during evaluation. No New Mexico Resident Business or Contractor Preference Certificates are considered in this RFP, and out-of-state vendors are eligible, with Secretary of State registration required only after award.
Pricing is structured around MSP Markup percentages applied to base pay rates, with separate Standard and Payroll Only MSP Markup proposals required per category. The MSP Markup is fixed for the life of the contract but may be adjusted during renewal periods per the Sample Master Agreement. All staffing costs—including statutory burdens, benefits, insurance, overhead, profit, and MSP services—must be included within the proposed markup, with certain reimbursable expenses (background checks, travel, licensing) potentially negotiated separately at the Participating Entity level. The contractor-sourced contingent workers are capped at 20% per category per Purchasing Entity, calculated in aggregate with affiliates and subsidiaries, with no exceptions contemplated. Pay rates are ceilinged at the BLS OES 75th Percentile Hourly Wage by Metropolitan Statistical Area, or per Section 21.C.2 for non-MSA locations. Pricing evaluation uses a scoring formula incorporating the Sum of MSP Markup (Standard plus Payroll Only combined). The estimated 2025 portfolio sales are $107.4 million across participating states, with detailed spend information available in Attachment E. This is a re-solicitation of an existing NASPO ValuePoint portfolio, with current master agreements available on the NASPO ValuePoint website. Formal MSP experience of at least five years is required from the prime contractor, and sub-vendor networks may be built post-award provided all contract requirements are met at execution.

RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
QUESTION
NUMBER
QUESTION RESPONSE TO QUESTION
Can the Lead State share historical or estimated annual spend/volume by category under the prior Temporary Employment Services Master
Agreement(s), even directionally, to help size staffing and account management infrastructure?
See Attachment E, Revised Participation
Information for estimated annual spend.
This information will not be provided per category.
Section III of the RFP Overview states $107.4 million in 2025 sales through the current Temporary Employment Services portfolio. Can the Lead State break this figure down by category, or by Participating State, to help Offerors right-size their proposed operating model?
This information will not be provided per category.
Is there a minimum number of categories an Offeror must bid on, or may an
Offeror submit for a single category (e.g., Category 5 only) without disadvantage in scoring?
There is no minimum number of categories an Offeror must bid on. See
Attachment C, Revised Evaluation Plan.
For positions that could reasonably span more than one category (e.g., a
Workday HRIS consultant under Category 5 versus Category 6), will the Lead
State or each Purchasing Entity make the final categorization call at the time of each Order?
See Attachment B, Revised Scope of
Work, section 3.
Section 7. C limits the Contractor's staffing resources to no more than 20%
Contingent Workers per category per Purchasing Entity, calculated in the aggregate with affiliates and subsidiaries. Is this 20% calculated per Order, per
Purchasing Entity over the life of the Order, or cumulatively across the life of the Master Agreement?
See section 7.C. of Attachment B, Revised Scope of Work.
Is there a minimum number of Sub-vendors an Offeror must demonstrate in its proposed network at the time of submission, or is network-building during the implementation period acceptable?
There is no minimum. However, if awarded, the Contractor must be able to meet all of the requirements in the
Master Agreement.
RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
Will the Lead State or NASPO ValuePoint require disclosure of sub-vendor agreements, indemnification terms, or insurance certificates at proposal submission, or only post-award during onboarding?
At time of post-award.
Section 4.D of Attachment H asks Offerors to include screenshots of the
Management System. Are Offerors permitted to use mockups or a representative demo environment if the platform is undergoing active development, or must screenshots reflect the production system currently in use with existing clients?
See the guidance provided in
Attachment H, Revised Offeror Response
Worksheet, that states “Offeror should provide all information necessary to demonstrate Offeror’s ability to meet the requirements of this RFP and the
RFP’s Scope of Work.”
Attachment B, Section 17. H sets a maximum six-hour system support response time for all Purchasing Entities. Does this apply uniformly across time zones, including Hawaii and Alaska, or is it measured within each Purchasing Entity's own business hours?
See Section 17. H. of Attachment B, Revised Scope of Work.
Is there a specific minimum uptime or SLA requirement for the Management
System beyond the four-hour issue resolution and two-hour escalation notice already specified in Section 17? H?
See Section 17. I. of Attachment B, Revised Scope of Work.
Attachment B, Section 21. C ties the Pay Rate ceiling to the BLS OES Hourly
75th Percentile Wage by Metropolitan Statistical Area. Still, the cited BLS link
(oessrcma.htm) reflects Mean Hourly Wage, not the 75th percentile. Can the
Lead State confirm which specific BLS dataset and percentile field Offerors should reference, and how Pay Rate ceilings will be determined for non-MSA or rural locations not covered by an MSA wage table?
See Section 21.C. of Attachment B, Revised Scope of Work.
Additionally, see Section 21.C.2. of
Attachment B, Revised Scope of Work.
Is there a single, fixed MSP Markup percentage that applies uniformly across all six categories within an Offeror's proposal, or may Offerors propose a different MSP Markup for each category they bid on?
See Attachment I, Cost Proposal.
RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
Will Attachment I, Cost Proposal allow Offerors to propose a different Payroll
Only MSP Markup percentage by category, or is a single Payroll Only rate expected across the entire proposal?
See Attachment I, Cost Proposal, and See
Attachment B, Revised Scope of Work, Section 21.A .
Attachment H specifies a 55-page total limit across seven sections. Does this page count include the Category checkbox page, section headers, or table of contents, and do Attachment H's per-section sub-limits (5+15+5+10+5+10+5) need to sum to exactly 55, or is the 55-page figure an independent ceiling?
See Attachment H, Revised Offeror
Response Worksheet.
Can the Lead State confirm the required font size, margins, and line spacing for the Attachment H technical response, as none are explicitly stated in the worksheet?
There is no required font size, margins, or line spacing.
Attachment H Section 5 contains two items labeled "A," one under Quality
Assurance and a second under "Artificial Intelligence" use. Can the Lead State confirm that this is a numbering error in the published document and clarify whether the AI question is part of Section 5 (Quality Assurance) or stands as its own scored subsection within the page count?
See Revised Attachment H, Revised
Offeror Response Worksheet in
Amendment No. 5.
Scope of Work Section 4.E states that the Contractor shall “manage payroll, benefits, insurance, and all taxes related to the work of the Contingent
Worker.” Please confirm that, when a Contingent Worker is employed by a
Sub-vendor, the Sub-vendor remains the employer of record (EOR) and is responsible for directly administering payroll, benefits, insurance, taxes, withholdings, workers’ compensation, and related employment obligations for that worker, while the Contractor’s MSP responsibility is to oversee Sub-vendor compliance with all applicable laws, including EOR responsibilities.
See Section 4.E. of Attachment B, Revised Scope of Work.
Please clarify if the references need to be in the last two or three years as
Attachment N states, “within the last two (3) years” which creates a discrepancy.
See Attachment N, Revised
Organizational Reference Questionnaire.
RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
Please clarify if the references need to be submitted by August 4th or August
11th as there is a discrepancy between the dates listed in the RFP Overview document and in Attachment N.
See Attachment N, Revised
Organizational Reference Questionnaire.
The MSP markup for recruiting for the Contractor will include all the costs, statutory, benefits, overhead, etc. plus the cost of MSP services.
See Section 21.A. of Attachment B, Revised Scope of Work.
Are there any other states besides New Mexico that are part of the Sourcing
Team for this RFP?
Yes. See Attachment A, RFP Terms and
Conditions section V. A.
Is exceeding the 80% Sub-vendor threshold in Section 16.B considered a compliance exception requiring remediation, or a reporting/notification trigger?
See Section 16.B. of Attachment B, Revised Scope of Work.
The current NASPO ValuePoint Temporary Employment Services Master
Agreement uses the concept of a Fully Loaded Labor Rate (FLLR), with the
Contractor’s markup applied over that loaded rate. That structure has provided useful flexibility across multiple public entities, labor categories, geographic markets, statutory burden structures, benefit requirements, and Sub-vendor pricing models. Will the Lead State consider permitting Offerors to propose pricing under a similar structure, where the MSP Markup is applied to a loaded labor/sub-vendor rate rather than only to the base Pay Rate? If not, please confirm that the MSP Markup is intended to include all applicable staffing costs above the Pay Rate, including statutory burdens, benefits, insurance, overhead, profit, Sub-vendor markup where applicable, and the Contractor’s
MSP fee.
The pricing structure is defined in the
RFP. Additionally, see Section 21.A. of
Attachment B, Revised Scope of Work.
Section 21.C references the '75th percentile wage of the BLS OES Mean Hourly
Wage.' BLS OES publishes Mean Hourly Wage and 75th Percentile Hourly Wage as separate statistics. Please confirm which BLS OES data column (the
'A_PCT75' percentile wage field, or another) should be used to establish the
Pay Rate ceiling."
See Section 21.C. of Attachment B, RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
For Purchasing Entities located in areas not covered by a BLS OES Metropolitan
Statistical Area (e.g., rural counties, US territories), what wage source should be used to establish the Pay Rate ceiling?
See Section 21.C.2. of Attachment B, Revised Scope of Work.
What considerations is NASPO giving to developing a separate or supplemental competitive solicitation for direct staffing services to accommodate facilities that prefer alternatives to the MSP model?
This RFP is led by the state of New
Mexico for Managed Service Providers as identified in Attachment B, Revised
Scope of Work. Section 4.
How does NASPO balance the goal of promoting sub-vendor participation with ensuring the most qualified candidate is selected regardless of source?
See Attachment B, Revised Scope of
Work, Section 4. B.
Under what circumstances, if any, would NASPO consider allowing exceptions to the 20% cap?
No exception is contemplated within this
Request for Proposal.
How can Purchasing Entities address situations where contractor-sourced candidates demonstrably outperform sub-vendor candidates but are restricted by the cap?
See Section 16.B. of Attachment B, Revised Scope of Work.
Is there room for a waiver or escalation process when market conditions limit sub-vendor availability?
See Section 16.B. of Attachment B, Revised Scope of Work.
How has NASPO evaluated the impact of the 20% cap on speed to fill, quality of candidates, and overall program performance?
The Lead State of New Mexico and the
Sourcing Team have determined that
Attachment B, Revised Scope of Work will meet the needs of Purchasing
Entities.
What feedback has NASPO received from Purchasing Entities regarding this limitation, particularly in hard-to-fill or rural markets?
The Lead State of New Mexico has solicited feedback from Purchasing
Entities and determined that Attachment
B, Revised Scope of Work will meet the needs of the Purchasing Entities.

Purchasing Entity begins using multiple sub-vendors.
The terms of the Master Agreement apply upon the effective date of the contract.
Please confirm whether any attachments or exhibits, other than Attachment I
Cost Proposal, may include pricing-related assumptions or examples, or if all pricing references must be strictly limited to Attachment I. The RFP says cost information should not be included in the technical proposal.
See Section B. 2. of Attachment O, Electronic Submission Requirements.
Please confirm whether Attachment N references must cover each category proposed, or whether two strong references for similar MSP/temporary staffing services are sufficient for all proposed categories.
See Attachment N, Revised Organizational Reference Questionnaire.
Please confirm whether Attachment P is optional only and not required for proposal responsiveness, since the RFP states it is optional but also discusses amendment distribution.
See Section IV.A. of RFP Overview.
Please confirm whether completed forms must be uploaded as separate files by attachment, or whether any forms may be combined into one administrative volume. Required submissions are listed separately, and
Attachment I must be separate.
See Section B. 2. Of Attachment O, Electronic Submission Requirements.
Please confirm whether vendors may include additional supporting documents, such as certifications, sample reports, system security documents, and process flowcharts, or whether the proposal should be limited only to the required attachments.
See the instructions in Attachment H, Revised Offeror Response Worksheet.
RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
Will the State provide additional guidance regarding the pricing evaluation methodology, including the relative weighting of pricing versus technical evaluation factors?
See Stage 3 of Attachment C, Evaluation
Plan.
Please confirm whether Scope of Work Section 21's 'fixed for the life of the
Contract' language on MSP Markup overrides the rate-adjustment process described in Master Agreement Section 6.1.2, i.e., whether markup percentages can ever be adjusted during renewal periods.
See Section 21.A. of Attachment B, Revised Scope of Work.
Should offerors include all applicable costs, including recruiting, onboarding, payroll administration, background screening, and technology fees, within the proposed markup structure?
See Section 21.A. of Attachment B, Revised Scope of Work.
Will pricing remain fixed for the initial contract term, or will there be opportunities for annual pricing adjustments?
See Section 6.1 of Attachment D, Sample
Master Agreement.
Should the proposed Account Manager and key staff be specifically assigned resources, or may Offerors describe representative personnel and roles?
See Section 14 of Attachment B, Revised
Scope of Work.
Should Offerors propose only their supplier markup (inclusive of all overhead, administrative costs, profit, and the NASPO administrative fee), with the Pay
Rate entered separately? Or should the proposed cost represent a fully burdened bill rate, with the Pay Rate excluded only for evaluation purposes?
See Section 21.A. of Attachment B, Revised Scope of Work.
If the answer to the above question is yes, should the Offeror describe the subcontractor's MSP/VMS platform and capabilities within its technical proposal while clearly identifying the Prime Contractor's governance and management responsibilities?
No. See Section 17 of Attachment B, Revised Scope of Work and Attachment
H, Revised Offeror Response Worksheet.
RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
The RFP requires Offerors to demonstrate a minimum of five (5) years of relevant experience. May this experience requirement be satisfied through the combined qualifications and experience of the Prime Contractor and its subcontractor(s)/teaming partner(s), provided the Prime Contractor retains overall contractual responsibility under the resulting Master Agreement?
No. See Section 4 of Attachment B, Revised Scope of Work.
Will a Prime Contractor be permitted to expand or modify its sub-vendor network after Master Agreement award, subject to the approval process described in the Scope of Work?
See Section 4. C. of Attachment B, Revised Scope of Work.
Is the place of performance expected to be determined at the individual
Purchasing Entity level, rather than at the Master Agreement level?
See Section 5 of Attachment B, Revised
Scope of Work.
Are offerors expected to maintain a physical presence in New Mexico, or is remote account management/recruiting acceptable where the individual
Purchasing Entity order does not require on-site support?
Contractors are expected to meet the requirements identified in Section 14 of
Attachment B, Revised Scope of Work.
For proposal purposes, should offerors describe their ability to support both remote service delivery and on-site/local contingent worker placement as required by each Purchasing Entity?
See the instructions in Attachment H, Revised Offeror Response Worksheet.
See Section 11.H. of Attachment B, Revised Scope of Work.
If a Purchasing Entity requires on-site personnel, will those location-specific requirements be provided at the order/request level?
See Sections 5 and 11.E. of Attachment
B, Revised Scope of Work.
The Cost Proposal fields default to '0' but instructions require a value over
0.00%. Please confirm acceptable format and whether a single markup applies to all worker levels within a category.
See Attachment I, Cost Proposal.
Category Tabs default to: “0.00%” It is the responsibility of the Offeror to insert and submit their proposed % figures in each Category Tab.
RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
Must both Standard MSP Markup and Payroll Only MSP Markup be completed for each proposed category? Are both values summed for the 'Sum of MSP
Markup' used in cost scoring?
See instructions in Attachment I, Cost
Proposal. Additionally, see Attachment
C, Revised Evaluation Plan.
Can you clarify which cells (Standard + Payroll Only per category?) are summed to compute the value used in the scoring formula? Attachment C references
'Sum of MSP Markup' for cost scoring.
The Offeror’s Standard MSP Markup and
Offeror’s Payroll Only MSP Markup will be used to calculate the Sum of MSP
Markup.
Attachment J indicates offeror-specific modifications are 'strongly discouraged.' Will proposing any redlines negatively affect evaluation scoring or responsiveness determination?
See Section IV. E of Attachment A, RFP
Terms and Conditions.
Attachment K indicates Staff/Personnel Resumes/Bios cannot be marked confidential. How should offerors handle PII (e.g., personal phone numbers, addresses) in key staff resumes?
See Section 1 of Attachment K, Claim of
Business Confidentiality Definitions.
Attachment O imposes a 50MB file limit and prohibits .zip files. Please confirm handling of large files with screenshots and naming conventions for redacted file versions.
See Sections 1.D. and 1.E. of Attachment
O, Electronic Submission Instructions.
Attachment N requires references to submit questionnaires directly. May an offeror submit more than two references, and can additional references earn points beyond 25 per reference (up to 50 total)?
See Stage Two of Attachment C, Revised
RFP Evaluation Plan.
Should the Standard MSP Markup and Payroll Only MSP Markup include all costs other than the Pay Rate, or are there any costs that may be billed separately?
See Section 21.A. of Attachment B, RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
If certain costs may be billed separately, can you confirm whether that includes background checks, drug screens, health screens, credentialing, licensing, certifications, PPE, training, travel, parking, mileage, or Purchasing Entity-specific requirements?
See Section 21.A. of Attachment B, Revised Scope of Work.
Should the MSP Markup apply to all billable pay components, including regular time, overtime, holiday pay, shift differentials, on-call, call-back, incentives, bonuses, or other premium pay?
See Section 11.K. of Attachment B, Revised Scope of Work.
150 Please confirm how overtime bill rates should be calculated under this contract. See Section 11.K. of Attachment B, Revised Scope of Work.
For cost evaluation purposes, are the Standard MSP Markup and Payroll Only MSP
Markup weighted equally, or will expected usage of each model be considered?
See Attachment C, Revised Evaluation
Plan, Section: Stage 3: Cost Evaluation
How should “direct referral” be defined for Payroll Only pricing? For example, would this include incumbent workers, former employees, retirees, rehires, client-identified candidates, or candidates previously submitted by a Contractor or Sub-vendor?
See Section 5.F. of Attachment B, Revised Scope of Work.
Is Attachment I pricing intended to be the maximum pricing for all future
Participating Addenda, or may pricing be adjusted by Participating Entity, geography, labor category, risk profile, credentialing requirements, or state-specific requirements?
See Section 6.1. of Attachment D, Sample Master Agreement.
If a Participating Addendum requires an additional administrative fee, may the
Contractor adjust pricing to account for that fee?
See Section 5.2.5. of Attachment D, Sample Master Agreement.
Please clarify whether “Pay Rate” means the wage paid to the Contingent Worker, the maximum billable wage component charged to the Purchasing Entity, or another amount.
See Section 2.M. of Attachment B, RFP # 60-00000-26-00092 – Temporary Employment Services State of New Mexico Response to Offerors Questions
How should the applicable BLS occupation and MSA be selected when a position could reasonably fall under more than one occupation or geographic area?
See Sections 3 & 21.C.2. of Attachment
B, Revised Scope of Work.
If BLS data does not reflect current market conditions, hard-to-fill roles, rural locations, urgent needs, or licensed healthcare requirements, what is the process for requesting approval of a higher Pay Rate?
See Section 21.A. of Attachment B, Revised Scope of Work.
If a federal, state, local, union, prevailing wage, SCA, DBA, grant-funded, or Purchasing
Entity-specific wage requirement exceeds the BLS-based Pay Rate, which requirement controls?
See Section 10.A. of Attachment B, Revised Scope of Work.
When the Scope of Work refers to providing compliance for background and reference checks, is the Contractor expected to provide an attestation of completion, or copies of the underlying reports?
See Section B.8.C. of Attachment B, Revised Scope of Work.
When does the SLA clock begin for request acknowledgment, availability notification, and candidate submission? If a request is incomplete or missing required information, does the SLA pause until the missing information is received?
See Section 5.E. of Attachment B, Revised Scope of Work.
Will awarded Contractors be required to transition active Contingent Workers from the current program? If so, will transition timing, worker data, communications, and onboarding requirements be handled at the Participating Addendum level?
This will be determined by each
Purchasing Entity. Additionally, see
Section 19. B. of Attachment B, Revised
Scope of Work.
