About this file

This document is a comprehensive contract forms package for site preparation work issued by the City of Easton, Pennsylvania. The file contains standardized agreement templates and bonding documents establishing the contractual framework between the City and contractors for public works projects. The Agreement for Site Preparation (Article 1) requires contractors to furnish all supervision, technical personnel, labor, materials, machinery, tools, equipment, and services necessary to complete improvements in accordance with contract documents prepared by the City of Easton Bureau of Engineering. Contract payment is structured as either lump sum or unit price compensation based on quantities of work completed, subject to changes authorized under the General Conditions Section 14. The contract documents include performance bonds (100% of contract price), payment bonds for labor and material protection, maintenance bonds (10% of contract amount), and one-year defect correction and repair warranties following completion and acceptance. Contractors must provide proof of workers' compensation insurance or exemption certificates prior to contract execution and must submit lists of subcontractors and suppliers for City approval.

The pricing structure follows Pennsylvania Public Works Contractors' Bond Law of 1967 (Act No. 385) requirements, with contractors responsible for all bonding costs and insurance premiums. Set-asides or incumbent designations are not specified in this template document. Contractors must comply with the Prohibition of Illegal Alien Labor Act, Public Works Employment Verification Act (utilizing E-Verify within five business days of hire), nondiscrimination and sexual harassment provisions, and environmental regulations. Additional requirements include suspension and debarment certifications, tax liability verification, and submission of cancelled checks within 45 days of final payment documenting eligible project costs and matching fund expenditures. The Commonwealth reserves audit rights for financial and performance verification, with unallowable costs required to be returned by the contractor to the grantor.
