Old Courthouse Phase 2 Renovations, Gateway Arch National Park (GANP 242900/253127) (Formerly Jefferson National Expansion Memorial (JEFF 199879)), St. Louis, Missouri

Solicitation 140P2022R0159 – Questions and Answers

Amendment 1, issued 7/29/22:

1. Contracting Officer’s Note 1: The language issued in “Section C – Specification / Drawings”, page 9 of 55 is incorrect. The correct language is as follows:

The Work includes installation of a new interior elevator, accessibility improvements, family restrooms, floor ramps, interior wayfinding signage, replacement of existing steam radiator system with new 4-pipe mechanical system, new fire-sprinkler system with detectors and alarms, upgrades to lighting, power, security and IT infrastructure, structural floor reinforcement, and replacement of window sashes and repair/refurbishment of window frames. Work also includes removal and disposal of asbestos containing materials, lead-based paint and household hazardous waste items as noted in a Work Plan included in the Appendices of the Construction Documents.

2. Contracting Officer’s Note 2: Please add the following requirement to Division 1 Specification Section 01 50 00 Temporary Facilities and Controls Part 4.3 Support Facilities Installation D. Project Identification and Temporary Signs:

Provide access to NPS for the installation of Artistic banners/signage on the temporary construction chain-link fencing for the duration of this project. Signage material will be suitable for use on temporary construction fencing. Exact locations and size of signage is to be determined; assume installations along all four perimeter streets. Installation and maintenance of these artworks will be the responsibility of NPS in consultation and/or under guidance of the artist.

Amendment 2, issued 8/9/22:

3. Contracting Officer’s Note:

Section 28 31 00 – Fire Alarm and Detection Systems, Part 2 – Products, 2.1 Acceptable Manufacturers is revised. The only acceptable manufacturer is option A, “Johnson Controls – Simplex 4100 ES”. This is necessary to be compatible with the existing Simplex 4100 ES system and with the new Security Command Center Fire alarm Network via the existing fiber backbone.

Amendment 3, issued 8/12/22:

4. Question: Does the steam pipe in the tunnels need to be abated for ACMs?

Answer: No. All steam pipe going to the tunnels will be abated and pipe removed. Once it goes into the tunnel, the steam pipe will be abandoned in place as well as the ACM covering. Exposed ends of the ACM covering at the tunnels should be sealed to prevent any ACM release into atmosphere.

5. Question: I am inquiring to request a copy of the 8/2/22 Pre-Bid Meeting & 8/4/22 Site Visit Sign In Sheets for the JEFF 199879 - Old Courthouse Phase 2 Renovations, Gateway Arch National Park, Jefferson National Expansion project.

Answer: See Amendment 2

6. Question: At the 1pm site visit last week, it was stated that an additional site visit can be scheduled in which all of the access points will be opened to the various catwalks. Will NPS schedule this additional site visit similar to the original site visit or do we need to schedule it per individual contractor?

Answer: The additional site visits will be held on August 16/Tuesday at 9am AND August 18/Thursday at 9am on the west entrance steps, N Broadway.

7. Question: Solicitation Page 15, Section H – Special Contract Requirements (Requirement 3) indicates a Quality Manager as part of the Key Personnel. Please confirm whether the Quality Manager can perform other duties on the project. In addition, is the safety manager required to be onsite full time?

Answer: Quality Control Manager CANNOT be the site superintendent. Quality Control Manager can perform other duties on site and is full time.

8. Question: Solicitation Page 15, Section H – Special Contract Requirements (Requirement 3) indicates a Safety Manager as part of the Key Personnel. Please confirm whether the Safety Manager can perform other duties on the project. In addition, is the safety manager required to be onsite full time?

Answer: Safety Manager can perform other duties on site and is full time.

9. Question: Solicitation Page 48-49, Factor 2, Subfactor 2A, Element 3 requires an organization chart. The associated written narrative (entirety of Factor 2) is limited to 3 pages. Please confirm that the organization chart is not part of the 3-page limit.

Answer: The Organization Chart is not part of the 3 page count.

10. Question: Solicitation Page 48-49, Factor 2, Subfactor 2A, Element 3 – can the org chart be an 11x17 sheet?

Answer: The org chart can be an 11x17 sheet.

11. Question: Solicitation Page 49, Factor 3, Subfactor 3A will utilize the Project Experience Questionnaire form provided as an Attachment to the RFP. The form provided with the RFP is a static PDF, though it appears this is supposed to be a fillable/editable form. Can a live/editable version be provided for use on this project? Or are we to recreate the form?

Answer: The pdf can be edited through Adobe Pro, however, a Word document version of the Project Experience Form is included in Amendment 03.

12. Question: Factor 3, Subfactor 3A - Project Experience Questionnaire form allows for expanding the response sections to adequately address each question (to multiple pages if needed). Once expanded for responses, is there a page limit for each form?

Answer: There is no page limit.

13. Question: Factor 3, Subfactor 3A requires us to “describe the experience and capability of key trades identified in Section H…”. No key trades were identified, only key personnel. Please clarify the requirement of this portion of Subfactor 3A.

Answer: There are no Key Trades identified for this project.

14. Question: Factor 4 - The Past Performance Questionnaire form provided as an attachment to the RFP is a static PDF, though it appears this is supposed to be a fillable/editable form. Can a live/editable version of the PPQ be provided for use on this project (since this will be transmitted directly from our references to the Contracting Officer)? Or are we to recreate the form?

Answer: The pdf can be edited through Adobe Pro, however, a Word document version of the Past Performance Questionnaire Form is included in Amendment 03.

15. Question: Please provide the “Hazardous Material Identification Listing” form that is referenced on page 50 of the Solicitation and is required to be submitted as part of the technical proposal. The form was not provided as part of the RFP. Note, this form is also listed on the cover page of Attachment 5.

Answer: The Hazardous Material Identification Listing Form is no longer required.

16. Question: Solicitation page 16, Special Requirement 4: Small Business Participation indicates a minimum of 20% of the total contract value is to be performed by Small Business. Page 51 of the solicitation lists a small business goal of 44% for Small Businesses. Likewise, the Small Business Subcontracting plan template provided as an attachment to the RFP lists a goal of 44%. Please clarify the small business requirements – is 20% a required minimum with 44% the goal?

Answer: 20% is the requirement, 44% is the goal.

17. Question: Report on Limitations on Subcontracting. The cover page included in Attachment 5 of the RFP indicates that this is a required submittal. Please confirm that this is not required as the project is not a sole source or set-aside solicitation.

Answer: Report on Limitations on Subcontracting is not required, as this solicitation is Full and Open.

18. Question: RFP attachment 5 – Cover page – is there a specific form to address “Proposed Equals”? If so, please provide. Note, this form is also referenced on page 50 of the solicitation.

Answer: The Proposed Equals form is no longer required during solicitation. This will be addressed by a submittal after award.

19. Question: Most Appendices, including “Appendix G – Signage and Wayfinding”, as mentioned in the Table of Contents of the Construction Documents on page 200116-6 appear to be unissued. Will these documents be forthcoming?

Answer: Signage and Wayfinding Plans are included as Appendix G.

20. Question: Specification section 01 91 13 – Commissioning Requirements – will the Government be providing the services of the Commissioning Agent (CxA) directly? Or are these costs to be included by the Offeror?

Answer: Cost of Commissioning Agent being provided by Partner and no costs are to be included by offeror.

21. Question: Regarding schedule – there are conflicting schedules within the solicitation - please verify which of the below schedule timelines is correct: a. Solicitation pages 10 and 48 indicate a Notice to Proceed by January 16, 2023, with completion required no later than 18 months after Notice to Proceed, or July 26, 2024. Page 48 indicates a Notice of Award on October 21, 2022. b. Solicitation page 3 indicates a period of performance from 10/21/2022 to 04/21/2024. This was also indicated at the pre-proposal conference and suggests a Notice to Proceed of 10/21/2024.

Answer: The Notice to Proceed and Notice of Award are separate events. The period of performance will be adjusted once the Notice to Proceed is issued and will extend to 18 months from the Notice to Proceed. Typically, the Notice to Proceed is issued 1 to 2 months after the Notice of Award. It is the Government's intention to award this contract by October 21, 2022. Given this date, it is the Government's estimate that the Notice to Proceed will be issued on January 16, 2023.

22. Question: Solicitation page 25-26, FAR 52.236-4 – the documents listed in this section were not issued as part of this RFP (though they were issued in the previously cancelled solicitation). Will these documents be reissued as part of this RFP? Specifically:

Answer: Refer to the Table of Contents in Volume 1 of the Project Manual as some of the mentioned documents are included in the Appendices. And reference all the amendments. Refer to this solicitation only for the documents needed for this project.

23. Question: I am reaching out to request additional access/walk-through of the Old Courthouse. We would like to set something up on Tuesday, August 16 at the earliest time available. We would specifically like to see the basement as well as the floors above the 2nd floor.

Answer: The additional site visits will be held on August 16/Tuesday at 9am AND August 18/Thursday at 9am on the west entrance steps, N Broadway.

24. Question: On A-505, elevation 8 shows that there are two accessories on the back of the door that are called out as a changing table(11). I believe these are meant to be coat hooks(12). Please verify.

Answer: Yes, elevation 8 on A-505, the note 11 should read 12 for coat hook (similar to elevation 4).

25. Question: What is the correct flooring in Breakroom 215C? Sheet A-905 shows LVT-1 and CPT-2. If both are to be installed, please provide extents.

26. Question: Please clarify required blocking in Rooms 215C, D & E? Do both sides of the wall need blocking? A-205 and A-502 have conflicting information.

Answer: Provide blocking full north-south length on east face of west wall in Room 215D. Blocking not required in 215B, 215C or 215E.

27. Question: Please confirm CPT-3 and WB-2 as the proposed flooring/trim finishes for the Elevator Machine Room 209A.

Answer: As referenced in the schedule sheet, A-906, the flooring is CPT-3 with WB-2 as the base.

28. Question: Please confirm if all windows on Sheet A-801 noted as “BASE” and “C.O. 1” are to have complete sash replacement per Bid Phase Notes. If this is incorrect, is there any way to decipher between the different processes for repair/restoration noted below from spec 080352 for each window.

a. Wood Window Patch-Type Repair

b. Wood Window Member-Replacement Repair

c. Wood Window Unit Replacement

Answer: Wood patching and/or replacement of existing window members is not related to Sheet A-801. Each individual BASE or C.O. 1 window shall be evaluated and repaired per specified methods. Specified wood window unit replacement method shall be followed at all sash replacements.

29. Question: A bidder has commented on the use of laminated glass and the putty glazing method. They noted that the oils in the putty conflict/breakdown the lamination of the glass. Please provide any clarification on this process or information regarding an approved alternative method.

Answer: We are unaware of stated issues using specified glazing compound (See 080352 2.6.B.1). Historic appearance requires use of glazing putty - Other products can be considered if submitted under 012223 2.3.E Approved Equals

30. Contracting Officer’s Note: Government solicitations are officially issued on sam.gov. There is not a “Plan Holder’s List” on this site. To find contractors who are interested in this project you can look at the Site Visit Sign-in sheets published in Amendment 2. However, there may be third party redistributers of the solicitation documents published from sam.gov that could have a Plan Holder’s List. Please inquire with them.

Amendment 4, issued 8/19/22:

31. Contracting Officer’s Note: There will be a limited access site visit for the dome attic held on Wednesday, August 24, 2022, at 9am on the west entrance steps, N Broadway. This is for fire protection sub-contractors, electrical sub-contractors, and mechanical sub-contractors only.

32. Question: Spec section 113013 notes a undercabinet microwave oven. In what room is this to be in? There currently aren’t any upper cabinets shown.

Answer: Revise spec section 13013 Residential Appliances, Part 2 Products 2.3 Microwave Oven, 1.2. Mounting to COUNTERTOP (from Undercabinet).

33. Question: We are to install new wall sensors (thermostats) for FCU’s and BCU’s. How are we to install the wiring for these sensors in the existing wall? Will the wall be opened up to allow access? Or are we to provide a surface raceway? Or Wireless sensors?

Answer: Wireless is preferred but both surface mtd and wireless are acceptable at the discretion of the installer

34. Question: Please provide a detail cut and elevation of the new door opening between utility room 048 and 045. Reference drawing AD201.

Answer: This is an existing opening that will be infilled with a new door.

35. Question: What is the depth of the existing slab on grade at the basement and on grade areas of the 1st floor? If unknown, what depth should we assume for bidding purposes?

Answer: Basement and 1st floor slab on grade depth is unknown. We have drawn and assumed 5" based on conversations with building maintenance and experience with similar buildings.

36. Question: The notes indicate to re-use existing MEFP floor and wall openings as much as possible. Our assumption is that all the holes will not be re-used. How many floor openings and wall openings should we assume will need to be patched for bidding purposes? Please provide a detail for patching of floor penetrations.

Answer: Unused floor openings should all be patched. For floor openings in structural vaults see 1/S-104. Refer to A-900-906 for floor finish occurring above patching. For limestone flooring use non-shrink grout tinted to match adjacent surface. A mock-up will be required to determine the patch is acceptable. (assume 22 patch surface & 148 patch beneath new floor finish) Wall openings in basement, above ceiling, or in utilitarian spaces can be left open.

37. Question: Reference note 2.05 on drawing AD-202, 203 will we be responsible for display removal, or will this be handled by a separate package. Our understanding was that all display work was going to be a separate bid package and that we were not supposed to include this item in our bid per the initial GC walk thru.

Answer: Display removal will be done by NPS.

38. Question: Reference keyed note 2.13 at southwest wall in room 122, please confirm that this wall is to be completely removed. The wall is shown with solid lines and does not have the dashed lines that all the other walls with this note have. Is this a utility chase that will have to have a portion of the wall removed for MEFP access?

Answer: Note 2.13 that points to the solid grey wall is incorrect, the masonry chimney located there will remain.

39. Question: Reference note 2.23 in room 109, 111 on drawing AD-203, please confirm that this bid package is not responsible for the salvaging or re-installing of historic wood divider.

Answer: Project scope includes removing and returning to NPS but not reinstallation.

40. Question: Note 2.31 on AD-302 directs for the higher ceiling of the first floor to remain in the rotunda area, which contradicts what the hatch depicts. Also, the hatch on A-302 shows new gyp board on existing frame. Please clarify scope extent.

Answer: This ceiling area should be removed, and new gyp board installed on existing framing.

41. Question: Reference notes 2.03 and 2.30 on drawing AD-302, both notes call for the plaster ceiling to be removed. Note 2.30 calls for the ceiling to be removed to the structure. Is there an additional ceiling above the plaster ceiling that needs to be removed? We are trying to figure out what additional work is required for note 2.30 verses note 2.03. Does the 2.30 note represent barrel vault plaster ceilings?

Answer: Some spaces have original ceiling structure, design intent is for plaster or gyp to be removed but the ceiling structure to remain for reuse with new gyp ceiling.

42. Question: Who is the Ameren point of contact for the new vault work?

43. Question: Please provide appendix H, which was issued with the original documents but did not appear in the updated solicitation documents. Are we responsible for abatement that is identified, but drawings do not indicate the product being removed. Example: the reports indicates that there is asbestos containing flooring in numerous rooms, but the demo drawings call for the flooring to be removed in those rooms. We will need a document that specifically tells us how much abatement work is required on the project and the quantities that we should assume for bidding purposes and where the abatement work is located in the building.

Answer: Appendix H is included in Volume 4/Project Manual.

44. Question: Are we responsible for new signage on the project?

Answer: Yes, there is a separate CLIN 3 for the wayfinding signage scope, as noted in the Contract Price Schedule. Refer to Appendix G for the Signage/Wayfinding drawings and the spec section. 101400.

45. Question: Reference equipment being removed from basement, will we be responsible for removing equipment pads that the equipment sits on? Examples: condensing units and generator being removed from basement.

Answer: When outdoor condensing units are removed, those setting on pads will need pads removed as well. The existing pad for the natural gas generator will need to be removed and a new one provided for the new diesel generator.

46. Question: Reference demo notes 2.03 and 2.31 in room 220 on drawing ad-304, note 2.03 says to remove ceiling to room extents, and note 2.31 says the existing ceiling is to remain. Please clarify what the ceiling demo scope is required in room 220.

Answer: Note 2.03 applies to extents of flat lower ceiling. 2.31 applies to extents of higher vaulted ceiling.

47. Question: Is there a specific reason a Hydraulic Elevator was selected? We are foreseeing some possible constructability issues with digging the elevator pit as well as boring a hole for the elevator jack. Is a machine room-less traction elevator an acceptable alternative?

Answer: There is limited room between the existing floor to floor height at level 2. The hydraulic elevator avoids the additional floor demolition that would be required for a traction elevator.

48. Question: STN-4 is shown on sheet A-904 in the storage rooms but is not included on the finish schedule/index. Please confirm there is no scope with STN-4. If there is, please provide specifications similar to what is included for STN-1, 2, & 3 for STN-4.

Answer: STN-4 should match STN-1.

49. Question: Will there be an Emergency Responder Radio Communication System included in this renovation.

Answer: Design includes a Simplex 4100u main control panel and a 4009 annunciation panel in the level one corridor. These are networked back to Arrowhead dispatch center located at Grounds Building, this is where the command center for all buildings in the Park use is a Simplex system. This requires that Johnson Controls/ Simplex are used so it is compatible with park wide system. There is no command center work within the Old Courthouse for the contractor.

50. Question: In the submission requirements listed in the solicitation under paragraph E.3, subfactor 1B, it says the schedule should be submitted in MS Project Gantt Chart Format. Is Primavera P6 Gantt Chart Format acceptable?

Answer: That is acceptable.

51. Question: In the submission requirements, is there a page limit for Subfactor 1B, schedule and schedule narrative?

Answer: There are no page limits for this section, however succinctness and specificity to this project will be appreciated.

52. Question: For Factor 3 - Experience, Subfactor 3A: Project Experience, please provide parameters for this section, such as timeframe, project value minimum, etc. Please also advise on how many projects should be provided.

Answer: Projects should be within the last 10 years, of equivalent scale, scope and costs and provide 3-5 projects.

53. Question: Please clarify if we can create our own form to for Factor 3 - Experience, Subfactor 3A: Project Experience, or if Attachment 5 - Project Experience Questionnaire is required to be filled out as is.

Answer: Please use the Project Experience Questionnaire provided. Submit responses to the questions in that questionnaire that address experience relative to the elements noted under the Project Experience evaluation subfactor in solicitation section L. Limit submittals to the quantity of projects and timeframes noted in the previous answer. Expand the response sections shown below as needed to adequately address each question (this questionnaire may be expanded to multiple pages if needed).

54. Question: For Factor 3 - Experience, Subfactor 3A: Project Experience, please clarify if we can provide supplemental information in addition to Attachment 5 - Project Experience Questionnaire.

Answer: Acceptable to provide supplemental information - limit of 1 additional page per project.

55. Question: For Factor 3 - Experience, Subfactor 3A: Project Experience, please confirm that Elements 1 through 3 can be answered in question 2 of the Project Experience Questionnaire form, or please provide instructions on where to include these answers.

Answer: It is acceptable to provide answers for elements 1 through 3 in Question 2 of the Project Experience Questionnaire.

The RFP implies that Elements 1 through 3 should be answered about the key trades.

Answer: In Subfactor 3A: Project Experience, replace the paragraph, "Describe experience and capability for Key Trades identified in Section H of this solicitation foe elements listed below. Indicate whether or not you have previously worked with these firms on previous projects. All firms proposed as Key Trades are subject to substitution requirements contained in this solicitation", with, "Describe experience and capability for the General Contractor and relevant Subcontractors for elements listed below. Indicate whether or not you have previously worked with these firms on previous projects".

57. Question: For Factor 4 - Past Performance, in lieu of the provided Past Performance Questionnaire, can CPARs be submitted?

Answer: The Government will review each offeror's CPARs through the CPARs system, so the offeror does not need to submit them. The Past Performance Questionnaire should be used with the instructions noted on the top of that form. The intent is to have your referenced sources complete the form and email them to timothy_burger@nps.gov and edwin_berry@contractor.nps.gov

58. Question: For Factor 4 - Past Performance, can NPS advise how many past projects we should submit as part of our proposal? Is there a minimum or maximum amount?

Answer: There is no minimum or maximum amount.

59. Question: For the "Past Performance Participation" requirement outlined in Section M, can NPS advise if there are any specific proposal components that should be submitted to demonstrate adherence to this requirement? E.g., should a narrative response be provided to address any of the specifications? Or should this requirement simply be addressed throughout the proposal?

Answer: There is no "Past Performance Participation" section. Section M describes how the Factors in Section L will be evaluated. Section L describes what we want from the offerors.

60. Question: For the "Past Performance Participation", is there a template that can be provided to address the required criteria?

Answer: There is no "Past Performance Participation" section.

61. Question: For Factor 3, Subfactor 3B: Key Personnel Experience, could NPS advise if there are any page limits for the section or the individual resumes?

Answer: There are no page limits for this section, however succinctness and specificity to this project will be appreciated.

62. Question: For Factor 2, Subfactor 2B: Safety, could NPS advise if there are any page limits for this section or the narrative portion of this section?

Answer: There are no page limits for this section, however succinctness and specificity to this project will be appreciated.

63. Question: Please confirm that wood window frame repairs per spec section 080352 are only to be performed on windows where sashes are to be replaced per Sheet A-801. At windows shown as NIC or “—” will there be any window work required beyond what is described by the Window Notes 1-9?

Answer: Wood window frame repairs only occur at windows defined as BASE and C.O.1. Windows labeled NIC will have no frame repair or sash replacement but will have work required by the Window Notes 1-9.

64. Question: Our interpretation of the answer of RFI #28 is that all windows noted as “BASE” or “C.O. 1” and have details associated with sheets A-803, A-804, A-805, A-806 on sheet A-801 are to have their sashes replaced with new manufactured/replicated sashes in their entirety. The old sashes are to be removed and disposed of. Please confirm.

Answer: Correct. All windows noted as Base or C.O.1 will have sashes removed, disposed of, and replaced with new replica sashes.

65. Question: Details on sheet A-802 call for sash, sill, and damaged wood restoration by others and (NIC). Please confirm the only scope at these openings is to remove the storm window and install bird wires.

Answer: Windows that state NIC will have no sash replacement work. Notes 1-9 still apply.

66. Question: Are the picture-hanging angles throughout the building to remain in place or should they be removed, and the plaster patched? If they are to be replaced, is there any information on quantities and locations?

Answer: Picture-hanging angles should remain in place or be removed and reinstalled.

67. Question: There is currently insulation above existing ceilings that are being removed. Do we need to reinstall insulation above new ceilings? If yes, please provide spec.

Answer: Any room with an attic space above does need insulation. Insulation should be cellulose type filled to R-30 depth.

68. Question: There is insulation shown in the new wall partitions, but there is not a spec for it. Please provide.

Answer: Acoustic insulation is specified in 092900 Gypsum Board.

69. Question: During a site walk it was mentioned that the gate on the North Entry Stairway is to be removed and new custom handrails were to be installed. This is not shown on the drawings. Please confirm this is outside of the scope.

Answer: Gate will be removed by NPS, do not include removal in bidding. Reference drawings on A-808 for details of new handrails.

70. Question: The window schedule has 15 windows shown to be painted, but not designated as Base or C.O. 1. Please confirm this is within the scope.

Answer: Restoration work will occur by NPS, contractor should be responsible for painting.

71. Question: There are a few items that have longer lead times and we may need to order before NTP. Will General Contractor be able to execute subcontracts and purchase orders after project award and before NTP, or will General Contractor be at risk until NTP?

Answer: Upon award of the contract, the GC can begin the submittal process, specifically the technical submittals related to the long lead items (in accordance to Division 1 submittal processes) and upon approval of these submittals, the GC can order the long lead items. The GC can move forward with submittals prior to the issuance of a NTP.

72. Question: The demo and proposed details/cuts on sheet A-803 and the specifications provide conflicting information regarding new chains, pulleys, and counterweights. Please confirm all sash replacements are to have new chains, pulleys, and counterweights.

Answer: All windows receiving new sashes should have new chains, pulleys, and counterweights.

73. Question: Regarding the answer for RFI #29. Spec Section 012223 2.3.E Approved Equals has not been issued. If we are to use this process, please provide spec.

Answer: The RFI-29 response should have stated Spec Section 013323, 2.3E is till the correct reference for the 013323 section.

74. Question: Can the Project Superintendent also serve at the Safety Officer?

Answer: Yes, Superintendent can also be the Safety Officer BUT CANNOT be the quality control manager.

Amendment 5, issued 8/25/20:

75. Question: The SBA issued a final rule that was effective on 1/23/17 that allows counting of lower-tier subcontractors (https://www.govinfo.gov/content/pkg/FR-2016-12-23/html/2016-30874.htm). The Code of Federal Regulations contains the new provisions in Title 13, Chapter I, Part 125 – 125.3(1)(i)(C): https://www.ecfr.gov/current/title-13/chapter-I/part-125/section-125.3. Per the revised CFR, will we: a. be allowed to establish two sets of small business subcontracting goals, one goal for the first tier and one goal for lower tier subcontracts awarded by other than small subcontractors with individual subcontracting plans? b. be allowed to establish two sets of small business subcontracting goals, one goal for the first tier and one goal for lower tier subcontracts awarded by other than small subcontractors with individual subcontracting plans?

Answer: The rule / reg allows Prime contractors to count awards to subtier subcontractors towards their goals in their subcontracting plan and thus a second set of goals is not required or needed.

76. Question: Specification section 01 40 00 – Quality Requirements – please clarify what, if any, quality control testing is to be provided directly by the Government.

Answer: The only testing oversight done by the Government will the Commissioning Agent (hired directly by Partners).

77. Question: Who is responsible for providing all control valves for the FCU’s? We prefer to provide these valves for consistency. a. In the specifications (section 230900 – 6) under ‘Products Furnished But Not Installed Under This Section’ it states that Control Valves will be furnished by controls contractor.

Answer: FCU on board controls should be factory installed and provided by the controls contractor. Preference is for controls to be sent to the manufacturer for factory install.

78. Question: Please provide a spec for the acoustic plaster ceilings shown in See You in Court 124 and Designed for Justice 122.

Answer: See specification section 092900 Gypsum Board section, 2.9B Acoustical Finish.

79. Question: Is fire protection/sprinkler going to be required inside of the Bally Building on Level 3?

Answer: The intent is to have the Bally Building removed before construction begins. If the Bally Building is still here, the park will get a variance from the AHJ to not protect the building. Either way, the contractor should not include any costs associated with this scope of work.

80. The following is a revision of previously answered Question 70 from Amendment 4: Question: The window schedule has 15 windows shown to be painted, but not designated as Base or C.O. 1. Please confirm this is within the scope.

Answer: Restoration work will occur by NPS, contractor should be responsible for exterior painting of these windows. DO NOT PAINT OVER THE EXISTING INTERIOR FAUX GRAINS OF THESE WINDOWS.

81. Question: Can the offices in the North Basement be utilized by the General Contractor for project management staff?

Answer: Do not park job trailer in the northeast courtyard (fountain) - job trailer can be placed on the sidewalk but Contractor to coordinate with city on the use of the sidewalk; construction fence should be extended to enclose job trailer. Alternatively, Contractor can utilize ROOM 017A in the basement only. The two basement bathrooms can be used by the GC management staff only; GC to provide break areas and portable areas for construction workers. GC is also responsible for cleaning/maintenance of the office spaces, provide own internet connections and furnishings; GC to take and submit photos of the office spaces before occupancy and will return space to original conditions.

82. Question: Some concerns have been raised about the air and water testing of the new sashes being installed into the existing frames. Spec Section 1.7.A.3 calls for specific tests that we have requested information on from a testing agency. Here is their response: ”After speaking to my laboratory, there is no way to lab test these windows without the frame. If they are asking for field testing, they should mention ASTM E783 in lieu of E330 and E1105 in lieu of E331. Perhaps they are just wanting the sash to have come from a window system that has been rated and tested to those standards? I would ask for more clarification. Either way, from my experience in the field and the lab’s opinion, those are some stringent requirements to meet. Those are lofty requirements for even modern windows with modern technology and typical aluminum. These windows are wood and don’t really stand a chance of passing these requirements. I would recommend field testing with a spray rack with minimal pressure (negative chamber) on the interior or do a spray nozzle test at a low pressure. Just know that these tests are only valid for new construction and that spray nozzle tests are not meant to be used on operable windows. It can be done, but it won’t be an “official” test. It will be more of a backcheck to make sure there aren’t any glaring issues. The bottom line is that there will always be chances of leaks when you leave the existing frame.” Please confirm the testing requirements for the new sashes.

Answer: Assume window will be field tested to ASTM E783 in lieu of E330 and E1105 in lieu of E331. Test procedure to be confirmed by historic treatment specialist hired by contractor (reference 080352, 3.1 Historic Treatment Specialist) and COR.

83. Question: General Project Information – Dynamic Controls will be providing a parts and smarts proposal only. Please make the electrical contractors aware that they will be responsible for all cabling and device installation for Section 28 13 00 - Electronic Access Control Specification and Section 28 16 00 – Intrusion Detection System Specification.

Answer: The General Contractor is responsible for division of work. IMEG provided a suggested responsibility matrix. The bidding Ecs will be notified but it is recommended that DCI state their scope and responsibilities to Ecs requesting proposals.

84. Question: Is there a specific temperature and humidity range (high/low) that the building needs to maintain to not adversely affect the historical fabric of the building?

Answer: Reference 01 51 00 Temporary Facilities and Controls. Winter - Maintain minimum 60 deg, minimum 30% humidity. Summer - Maintain maximum 80 deg, maximum 60% humidity

85. Question: It was stated at the walk thru that we would not be required to demo piping or other utilities thru existing basement tunnels because it is a confined space area. The drawings indicate that for the most part, but drawings MPD-200 and 201 call for us to demo the existing piping routed thru confined tunnel which extends from the west basement to the north basement. Drawings FPD-200 and FPD-201 also call for us to demo piping within a confined space tunnel. Please clarify if this piping needs to be removed within the confined tunnel spaces as indicated or not.

Answer: Refer to the answer for Q4, issued in Amendment 3. Q4: Does the steam pipe in the tunnels need to be abated for ACMs? Answer: No. All steam pipe going to the tunnels will be abated and pipe removed. Once it goes into the tunnel, the steam pipe will be abandoned in place as well as the ACM covering. Exposed ends of the ACM covering at the tunnels should be sealed to prevent any ACM release into atmosphere.

86. Question: Please confirm that the NPS will provide Builder’s Risk Insurance. Additionally, please provide the Builder’s Risk deductible.

Answer: No, the Government will not provide Builder's Risk insurance.

87. Question: As per IFC 510 and NFPA 72 fire codes, Emergency Responder Radio Communications Systems shall be tested on new developments or renovations. Will the Old Court House renovation include Public Safety Radio testing and system implementation as part of the project?

Answer: Testing is required by contractor, must be coordinated with NPS. Park has a Simplex 4100u main control panel and a 4009 annunciation panel in the level one corridor, all of which is networked back to Grounds. Park command center for all buildings is a Simplex system located at the Arrowhead dispatch center located at the Grounds Building. There is no command center work within the Old Courthouse for the contractor.

88. Question: For Volume I, Other Submittals, "Small Business Participation", can NPS advise if there are any specific proposal components that should be submitted to demonstrate adherence to this requirement? E.g., should a narrative response be provided as documentation, to address the criteria defined in the "Small Business Participation" factor contained in section M?

Answer: A narrative response is acceptable.

89. Question: For Volume I, Other Submittals, "Small Business Participation", is there a template that can be provided to address the required criteria?

Answer: There is no template.

90. Question: We respectfully request from NPS a minimum of a one week time extension of the bid due date.

Answer: The proposal due date to Wednesday, September 7, 2022, at 1000 local time. The question period is extended to August 31, 2022, at 1000 local time.

91. Question: Is this project Tax Exempt?

Answer: This project is NOT Tax Exempt. All applicable taxes shall be included in the proposal.

92. Contracting Officer’s Note: The answer to Question 72 on Amendment 4 is retracted.

Amendment 6, issued 8/26/20:

93. Contracting Officer’s Notes:

a) The proposal due date is further extended to Monday, September 12, 2022, at 1400 local time. The question period is extended to Tuesday, September 6, 2022 at 1000 local time.

b) There will be a final site visit specifically to view the attic space above the East and West Courthouse. This will take place at 0900, Wednesday, August 31, 2022. Meet on the west entrance steps, N Broadway.

Answer: The plans, including sheet T-500, state the current devices which are to replace the obsolete parts/modules.

102. Section 28 13 00 – Electronic Access Control Specification - Page 6 Section 2.7 A 1 a: indicates the reader manufacturer part number is an HID 920LHRNEK0001R which will read PIV credentials. We have been asked by the National Park Service to use the HID 920LTNNEK00017. Please clarify.

Answer: Utilize HID 920LTNNEK00017

103. Section 28 16 00 – Intrusion Detection System Specification - Page 3 Section 2.2 B 1: indicates a requirement for a battery operated emergency power supply with capacity for operating system in standby mode for 48 hours for the control panel. If the control panels are on emergency power, is the 48 hour period required. Please clarify.

Answer: If the control panels are on emergency power, the battery backup is not required.

104. We are to install new wall sensors (thermostats) for FCU’s and BCU’s. How are we to install the wiring for these sensors in the existing wall? Will the wall be opened up to allow access? Or are we to provide a surface raceway? Or Wireless sensors?

Answer: See answer to Question 87 in Amendment 5. Wireless is preferred but both surface mtd and wireless are acceptable at the discretion of the installer

105. E-200 – E401- The GCC (Portable Generator Connection Cabinet) is located in the Courtyard). Since the Generator is in the Basement, can we change the configuration to Dual Purpose so it would include Load Bank Connections within that device? Is this acceptable ?

Answer: Refer to specification section 263213-2.7. The GCC is already dual purpose-acceptable.

106. E501 – Transfer Switch Schedule. Overlapping Neutral is not an option in the Delayed Transition ATS. Will use the Standard Open transition Neutral. Is this acceptable?

Answer: Acceptable

107. Automatic Transfer Switch - 26 36 00. 2.7-E - Remote Start Circuit Monitoring: Feature is not available when a GCC is used. The Start Circuit from the Portable is not capable of interfacing with the fixed mounted unit. Is this acceptable?

2.7-N – This Remote Annunciator is indicative to one Manufacturer. We would like to utilize our standard which shows Switch Position, Source Availability, ATS Fail and a Lockable Test Switch as shown below. Is this acceptable?

Answer: Acceptable for both.

108. Packaged Engine Generator - 26 32 13. 2.3-L-3 – Again Remote Start Circuit Monitoring is not available when used in conjunction with a GCC panel. Is this acceptable?

3.2-B – Raised Base Rails and Drip Pan by MC. Is this acceptable?

Answer: The first question is acceptable, the second, raising of the Base Rails by the EC.

109. Does the fire protection contractor need to figure on placing hose valves at the roof hatches below ceilings?

Answer: Contractor shall provide an NFPA compliant system. The FP contractor will be the EOR and responsible for the complete design and installation. Depending on the building final classification and accessibility requirements additional hose valves may be required. Exact location and placement of additional locations shall be coordinated/reviewed if deemed required.

110. Part of the fire protection scope is to route pipe in the interstitial space above the court rooms. Should the fire protection contractor figure on protecting under cat walks and/or protecting the interstitial space?

Answer: Contractor shall provide an NFPA compliant system depending on final system requirements. Sprinkler system distribution and layout shall reflect final distribution on EOR drawings.

111. Fire protection demo drawing FPD-201 shows to "remove 6" fire protection service entrance back to main and cap." Is existing fire entering the building on a dedicated fire line or combination line? Will a tap destroy need to be performed by the FP contractor?

Answer: A tap destroy should probably be performed, confirm with St. Louis City Water department. Refer to civil drawings for additional information.

112. KN 2.51 on sheet AD-304 calls for the existing ACT ceiling to be salvaged and used for reinstallation in rooms 255, 226, 228 and 229. The hatch on sheet A-304 depicts a new acoustical panel ceiling. Please confirm which scope is correct.

Answer: ACT ceiling should be salvaged and used for reinstallation in rooms indicated.

113. CLIN #2 calls for the removal of a wheelchair lift and the addition of ramps on the East and West main entrances. There is nothing on the drawings noting these scopes. Please confirm that the removal of the wheelchair lift and the ramps are already complete and should not be included in the cost for this phase of the project.

Answer: Please strike the "Work will include removal of the mechanical wheelchair lift and replacing it with two ramp structures at both the East and West main entrances" from CLIN 2. That work does not apply to this project scope.

114. The drawings indicate that the existing horn strobes are to be replaced with new strobe only devices and that the contractor is to reuse the existing rough in for the new device. The existing fire panel is in the old security command center located in the north basement which is not at the same location of the new system, meaning the existing cable terminates at the wrong location. Please advise if we are to place remote power supplies at the existing north basement location to pick up those circuits or if the circuits are to be replaced.

Answer: Provide remote power supplies at the existing north basement location.

115. Please confirm the page limits noted for Subfactor 2A are constrained to Elements 1 and 2 and NOT Element 3.

Answer: See the answer to Question 9, Amendment 3.

116. MP402 – The Generator is shown with Seismic Vibration Isolators under the base rails raising the unit up for the drip pan. The isolators are actually mounted under the Engine/Generator to the base rail. MC when extending the pad will need to add something to raise the unit off of the pad so the MC can slide their drip pan under the unit. Is this acceptable? Does the split core radiator to have individual Low Coolant Level Switches for each side? The cooling system package will be mounted on the front of the skid area.
