052119 ARCHAEOLOGICAL PROTECTION
SECTION 01 35 13.22 – ARCHAEOLOGICAL PROTECTION
PART 1 - GENERAL
1.01 SUMMARY
A. The work of this section consists of protecting archaeological resources contained in soil deposits.
Active construction will occur adjacent to but not within the archaeologically sensitive areas, as defined in Part 1.2. See the Project Plans for boundary of the archaeological protection area.
B. Specific information related to the archaeological protection area can be found in the confidential report, Archaeological Testing Report, Scorpion Pier Replacement, Channel Islands National Park, California (Bundy 2017). This report is on file at the Channel Island National Park in Ventura, California.
C. Per the Programmatic Agreement for Section 106 of the National Historic Preservation Act, Native American monitoring and archaeological monitoring shall be conducted pursuant to the results of consultations undertaken in Stipulation I, and if applicable, Stipulation III.C.3. This section defines the monitoring requirements.
1.02 DEFINITIONS
A. Archaeological Resources: Archaeological resources are the physical evidences of past human activity, including evidences of the effects of that activity on the environment. Archaeological resources represent both prehistoric and historic time periods. They are found above and below ground and under water.
B. Archaeologically Sensitive Areas: Areas that have the potential to contain significant (National Register eligible) archaeological resources. If National Register eligible or listed archaeological resources could not be avoided, an appropriate mitigation strategy would be developed in consultation with the state historic preservation officer and, if necessary, associated American Indian tribes.
C. Non-sensitive Areas: Areas with little, if any, potential of containing significant (National Register eligible) archaeological resources.
D. Archaeological Monitor (GOV Provided): Archaeologist meeting the minimum requirements set forth in the Secretary of the Interior’s Standards for Professional Qualification Standards for Archaeology, who is designated to observe ground-disturbing activities during project operations to identify, protect, record, and collect archaeological deposits exposed during construction activity for compliance with federal historic preservation laws, regulations, and guidelines.
E. Tribal Monitor (GOV Provided): A Chumash representative meeting qualifications of the Park’s Tribal consulting partners, and able to identify, record, and protect traditional cultural resources and resources to which they attach cultural and religious significance eligible for listing in the National Register of Historic Places, and who can act on behalf of the Tribe concerning human

F. Archaeological Resources Protection Act (ARPA) of 1979 (P.L. 96-95; 93 Stat. 712): defines archaeological resources as any material remains of past human life or activities that are of archaeological interest and at least 100 years old; Section 4 of the statute describes the requirements that must be met before Federal authorities can issue a permit to excavate or remove any archaeological resource on Federal or Indian lands; the curatorial requirements of artifacts, and other materials excavated or removed.
G. Native American Graves Protection and Repatriation Act (NAGPRA) of 1990 (P.L. 101-601, 25 U.S.C. 3001 et seq., 104 Stat. 3048): Among other things, NAGPRA establishes procedures for the inadvertent discovery or planned excavation of Native American cultural items (human remains, burial objects, sacred object, and objects of cultural patrimony) on federal or tribal lands.
1.03 SUBMITTALS
A. Daily Work Schedule: Submit a Daily Work Schedule detailing construction work in archaeologically sensitive areas. Submit to Contracting Officer 30 days before start of ground disturbing site work. This submittal is in addition to, or can be a section within, the Contractor’s work plan. If the work schedule changes during the project, submit an updated Daily Work Schedule that provides a minimum 5-day notice of any ground-disturbing activities. Unless the previously scheduled ground-disturbing work is unchanged with the updated Daily Work Schedule, then no ground-disturbing work shall be permitted within 5 days of the submitted updated Daily Work Schedule.
1.04 QUALITY ASSURANCE
A. At least 1 week before on-site work begins, Contractor shall meet with Contracting Officer, Archaeological Monitor, and Tribal Monitor to discuss Daily Work Schedule, equipment and special methods to be used in archaeologically sensitive areas, and an orientation on the general cultural sensitivity of the project area, and the requirements of the Monitoring Plan and the NAGPRA Plan of Action. Contractor shall ensure that approved Daily Work Schedule is followed throughout construction.
PART 2 - PRODUCTS
2.01 DAILY WORK SCHEDULE
A. A Daily Work Schedule is required for all ground-disturbing activities, both on- and off-shore.
The schedule shall be based on the drawings and shall include the following:
1. Starting and ending dates of ground-disturbing construction.
2. Locations of temporary facilities, such as barriers, field offices, staging areas, sanitary facilities, borrow pits, and haul and access roads.
3. Types of construction, such as pile drilling and installation, clearing, landscaping, and post construction clean-up. Excavation is not permitted on the island.
CHIS – 174354 Addendum 1 01 35 13.22 - 3
4. Methods and equipment used for each type of construction.
5. Plan for relocating work in the event of temporary work stoppages due to archeological discovery.
2.02 BARRICADES
A. Contractor to provide barricades between the work area and the archaeologically sensitive areas, as specified in Section 01 50 00 – Temporary Facilities and Controls.
PART 3 - EXECUTION
3.01 BARRICADES
A. Comply with the barricade requirements specified in Section 01 50 00 – Temporary Facilities and Controls. Locate the barricades as directed by the Contracting Officer.
3.02 OBSERVATION
A. Archaeological Monitor (GOV Provided) will observe all ground-disturbing site work, including construction of temporary facilities, at all archaeologically sensitive areas, from a safe location mutually agreed on by Contractor and Monitor. No active excavation is permitted on the island;
however, is it understood that some of the construction activities may disturb the ground.
B. Tribal Monitor (GOV Provided) will observe all ground-disturbing work both on- and off-shore, from a safe location mutually agreed on by the Contractor and the Tribal Monitor. Contractor shall allow safe and effective access for the Tribal Monitor to observe all ground-disturbing work.
3.03 DISCOVERY OF RESOURCES
A. The Contractor shall follow the direction of the Archaeological Monitor, or Tribal Monitor in absence of the Archeological Monitor, regarding artifacts or human remains encountered during construction, and shall follow the provisions of the Archaeological Monitoring Plan and NAGPRA Plan of Action.
B. If the Archaeological or Tribal Monitor discovers resources, immediate relocation of the work to a non-sensitive area may be required to allow Monitor to identify and document resources and, if necessary, develop an appropriate mitigation plan. While the Archaeological and/or Tribal Monitor is documenting resources in sensitive areas, Contractor shall relocate work to non-sensitive areas where monitoring is not normally required.
C. If resources are discovered while the Archaeological and/or Tribal Monitor is absent, stop work immediately and report the discovery to the Contracting Officer.
CHIS – 174354 Addendum 1 01 35 13.22 - 4
3.04 WORK STOPPAGE
A. The Contractor shall plan, schedule, and execute the work to prevent stoppages at one area from stopping all work at the construction site
