Identifies portions of the work the Contractor will self-perform; Identifies how subcontractors will be selected and managed; Evaluates the Contractor’s proposed project schedule and how well it meets the project objectives.

Shorter schedules which maintain quality and safety are preferred. Contractors shall identify their proposed completion date as the project’s Substantial Completion date, which the Contractor commits to on their Cost Proposal Form.

Consideration will also be given to the portions of the project that the contractor will self-perform and the strength brought to the team by critical subcontractors including how they we reselected and the success the contractor has had in working with them.

C. Design Proposal | 25 Points The Design Proposal Required Drawings must be submitted electronically via U3P no later than the time and date specified on the Solicitation Schedule. Presentation boards are not requested for this project.

The following is a list of all items to be included in the Design Proposal. Each drawing sheet shall be sized to sufficiently demonstrate the detail of the drawings:

1. Required Drawings:

a) Site drawing, including but not limited to:

Plan showing all site development: building footprints and floor elevations, roads, parking, drainage - Scale 1”=50'-0" (minimum).

b) Floor Plans for each floor of the building(s), Scale 1/8"=1'-0" (minimum).

DFCM VBS Design-Build: Request for Proposals, 3.30.2026 9

f) One perspective view drawing.

2. Complete outline specifications.

3. Narrative description of each system (electrical, mechanical, plumbing, structural, security, etc.).

4. A complete list of exceptions, exclusions and inclusions, or other deviations:

a) Any exclusion to the programmatic requirements shall include an additive cost to include the excluded item back into the project.

b) Any exclusion from the programmatic requirement shall also provide detailed information regarding any alternate or substitution that may be required to meet the published design build budget.

D. Cost Proposal | 40 Points Before submitting a proposal, each Contractor shall carefully examine the solicitation, visit the site of the Work, fully inform themselves as to all existing conditions and limitations, and shall include in the Cost Proposal the cost of all items required by the program and the contract documents.

The DFCM Cost Proposal Form must be submitted to DFCM via the U3P website no later than the date and time specified in the Solicitation Schedule. Late cost proposals will not be accepted.

Cost Proposals are required to be within the stated design-build budget. If the Cost Proposal is not within the stated budget, Contractors must submit a Value Engineering Proposal. If the Cost Proposal is not within budget and no Value Engineering Proposal is submitted to bring the project within budget, the Contractor may be deemed non-responsive.

Value Engineering Proposal Value Engineering proposals are separate and distinct from the exceptions, exclusions and inclusions, or other deviations listed under the Design Proposal section above.

Each Value Engineering proposal item shall be listed separately with the associated cost and description for the Selection Committee to understand the implications of said value engineering proposal. A sufficient description of the adjustment, as well as the impact on the Cost Proposal must be provided to allow for evaluation by the Selection Committee of the impact on scope, functionality, durability, long term cost efficiency and initial cost.

The amount shown on the DFCM Cost Proposal Form should not include the impact of the Value Engineering Proposal items. Value Engineering Proposals will be evaluated by DFCM and the user to determine which items, if any, are potentially acceptable.

Prior to the interviews, each contractor will be notified as to which of their Value Engineering Proposal items have been determined to be potentially acceptable and which ones will not be considered. Only those Value Engineering Proposal items that are determined to be potentially acceptable may be presented in the interview.

Contractors may not submit additional Value Engineering Proposal items after the deadline. Any new Value Engineering item proposed in the interview that was not submitted by the deadline will not be considered.

The accepted Value Engineering Proposal items will be included in the cost of the original Contract.

DFCM may reject any Value Engineering Proposal that is not desirable for the project. DFCM reserves the right to use any value engineering information proposed by any Contractor for the project and use the concepts for the benefit of the project.

By submitting a cost proposal or bid, in any format, the Contractor / Bidder / Vendor certifies that: 1) no product to be supplied by the Contractor / Bidder / Vendor in connection with this Solicitation is a “forced labor product” as that term is defined in Utah Code 63G-6a-121; and 2) to the extent, if any, that this solicitation involves technology, or technology services, networks or systems, the Contractor / Bidder / Vendor is not a “restricted foreign entity” as that term is defined in Utah Code 63G-6a-121.

E. Past Performance Rating | 25 Points For Design-Build solicitations, DFCM will use the past performance rating of the Contractor with whom DFCM will be contracting with in the event their team is awarded the project.

DFCM VBS Design-Build: Request for Proposals, 3.30.2026 10

DFCM Performance Ratings DFCM rates the performance of each Contractor on a scale of 1 (low) to 5 (high). Ratings for completed DFCM projects over the past five years will be averaged and used in the selection scoring matrix.

It is the Contractor’s responsibility to confirm and review for accuracy their DFCM performance ratings prior to the proposal deadline. Changes made to DFCM ratings resulting from discrepancies found after the proposal deadline will be reflected in future selections.

DFCM performance ratings are available for review upon request by contacting the DFCM VBS Coordinator via email at dfcm_vbs@utah.gov.

Non-DFCM Performance References If a Contractor does not have a minimum of three active DFCM performance ratings, they are required to submit references for non-DFCM projects of comparable type, scope, size, and completed within the past five years that will supplement any of the Contractor’s DFCM performance ratings. All references must be for projects in which the Contractor was the prime Contractor.

Complete and accurate information for non-DFCM references must be provided on the DFCM Performance References Form. The form requires a minimum of five references. Incomplete reference information or the inability for DFCM to acquire a rating from a provided reference may result in the Contractor being disqualification from the selection process.

How does DFCM rate non-DFCM projects?

To obtain a minimum of three collective performance ratings for each Contractor, references provided for non- DFCM projects will be contacted at random and asked a series of predetermined questions. The reference will be asked to rate the Contractor on a scale of 1 (low) to 5 (high) for each question. The ratings will be averaged and result in a performance rating for the corresponding project. DFCM will only contact references until a collective total of three performance ratings for non-DFCM and DFCM projects are obtained. The three performance ratings will be averaged and used in the selection scoring matrix. Contractors that fail to meet this requirement or a minimum of three collective ratings may be disqualified from the selection process.

Additional Requirements The following items are not part of the Selection Criteria but are requirements that may disqualify the Contractor from the selection process if not submitted.

F. DFCM Termination or Debarment Form The Contractor must sign and submit the provided DFCM Termination or Debarment Form certifying that neither it nor its principals are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from soliciting work by any government agency. This form also certifies that neither they nor their principals have been terminated during the performance of a contract or withdrew from a contract to avoid termination. If the Contractor cannot certify these two statements, the form provides a section for a written explanation of the circumstances to be provided for review by DFCM. Although this form is not part of the Selection Criteria, it is a required proposal document. Proposals submitted without this form may lead to Contractor disqualification.
