About this file

This is a Business Confidentiality Claim form issued by the Office of the Government Records Ombudsman at the Utah State Archives in coordination with the State of Utah Division of Purchasing for the BD27-106 Design Professional Services Pre-Qualified Vendor List solicitation. The form provides the mechanism for vendors submitting qualifications to claim protected status for trade secrets and commercial financial information in their proposals under Utah Code 63G-2-305 and 63G-2-309. Vendors seeking confidentiality protection must submit both redacted and non-redacted versions of their complete proposals, as the Division of Purchasing will not perform redactions on behalf of claimants. The confidentiality claim must include a concise statement of reasons supporting the protection request and must be submitted with the information designated for protection.

The form requires claimants to provide detailed company information, including company name, address, representative contact details, and specific identification of which pages, paragraphs, and sections of their proposal require confidential treatment along with the corresponding reasons for each claim. It is important to note that submission of a confidentiality claim does not guarantee that the requested information will receive protected classification if the government receives a records request under the Government Records Access and Management Act (GRAMA). The claimant bears responsibility for clearly designating confidential material and providing substantive justification for each protection request.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
