About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's RFP MH26-11 for Tow and Wrecker Services. The form provides a template for vendors submitting proposals to claim protection of trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the confidentiality claim form detailing which specific pages, paragraphs, and sections require protection and the corresponding reasons for the claim. The procurement is for multiple contracts to provide tow and wrecker services for vehicles owned by eligible users over a five-year contract term, with vendors required to guarantee pricing for 24 months and an administrative fee of 0.25 percent.
The confidentiality claim form requires vendors to provide complete company information, including the company name, address, representative contact details, and the specific governmental entity receiving the submission. Vendors must include a concise statement of reasons supporting their confidentiality claim and understand that submitting a claim does not guarantee protected classification if the government receives a public records request under the Government Records Access and Management Act. The Division of Purchasing will not redact proposals on behalf of vendors who fail to submit a redacted copy alongside their non-redacted proposal, ensuring vendors bear responsibility for identifying and protecting their proprietary information at the time of submission.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
