About this opportunity

The Utah Department of Health and Human Services is announcing a notice of intent to award a contract for long-term care consulting services without engaging in a standard competitive procurement process, with the public notice period closing September 15, 2026. The award is to Long Term Care Consultants, LLC under Utah Code Section 63G-6a-802(1)(c) based on impracticality — the Centers for Medicare & Medicaid Services has specifically selected this vendor and awarded CMS civil money penalty funds to deliver the services.

The scope covers delivery of an electronic training platform and related consulting services across 11 participating nursing and skilled nursing facilities over a three-year term (36 months). The contractor must perform facility-specific account setup and onboarding during Month 1, including automated secure employee roster uploads via CSV, live orientation training for administrative and clinical staff, and tailored monthly training calendars with facility-specific modules. From Months 2–36, the contractor provides continuous platform access, technical customer support, system maintenance and updates, and develops board-approved continuing education units. Contract outcomes focus on reducing survey deficiencies, improving CMS compliance scope and severity tags, reducing pressure ulcers in long-stay residents, and improving functional outcomes in short-stay residents, with quarterly tracking of antipsychotic usage, pressure injuries, and hospitalization rates.

The estimated contract value is $198,000 over three years, funded through federally imposed CMS civil money penalty funds. Compensation is $500 per month per facility ($5,500 monthly total). Monthly invoices with standard billing documentation and quarterly reports (due within 30 days after each calendar quarter end) are required.

Interested vendors may challenge this sole-source determination by submitting documentation demonstrating other competing sources exist during the public notice period. The contract is subject to mandatory anti-boycott certification under Utah Code 63G-27 et seq.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
