About this file

This is a CMS approval letter from the Department of Health & Human Services Centers for Medicare & Medicaid Services regarding a civil money penalties (CMP) fund allocation request submitted by the Utah Department of Health & Human Services, Division of Licensing and Background Checks. The project, titled "UT-0226-LTCC-1485, SNFClinic, Training to Improve Quality of Care," will be implemented by Long-Term Care Consultants, LLC across 11 nursing homes over a three-year period. The program provides comprehensive, technology-based training for nursing facility staff through a centralized system designed to address staffing challenges in facilities with high turnover rates. The system will offer staff management, training resources, and resident care capabilities. Expected outcomes include reduction in survey deficiencies, improved scope and severity tags, enhanced compliance, increased overall quality of care, reduction in pressure ulcers among long-stay residents, and improved functional outcomes for short-stay residents.

The total project cost is $198,000.00, funded through federally imposed CMP funds collected by CMS from nursing homes that fail to meet long-term care facility requirements. CMS has approved the proposal as meeting all requirements under 42 CFR 488.433, determining that the proposed use of CMP funds is appropriate and aligned with regulatory provisions of the Social Security Act and the Patient Protection and Affordable Care Act. The state is required to make project results publicly available and submit annual outcome reports in February using the CMPRP Project Tracking Sheet, which will be posted on the CMS CMPRP website.

SUBJECT: Approval of Request to Use CMP Funds

Dear Heather Flint and Jessica Fiedel:

Sections 1819(h)(2)(B)(ii)(IV)(ff) and 1919(h)(3)(C)(ii)(IV)(ff) of the Social Security Act incorporate specific provisions of the Patient Protection and Affordable Care Act pertaining to the collection and uses of civil money penalties (CMPs) imposed by the Centers for Medicare & Medicaid Services (CMS) when nursing homes do not meet requirements for long term care facilities. In accordance with 42 CFR § 488.433 and CMS Memorandum: QSO-25-26-NH states must obtain approval from CMS for the use of federally imposed CMP funds.

Our office has reviewed the proposal submitted by Long-Term Care Consultants, LLC for $198,000.00 to implement a program titled UT-0226-LTCC-1485, SNFClinic, Training to Improve Quality of Care – SNFClinic in 11 nursing homes for three years. This project aims to provide comprehensive training for nursing facility staff through a centralized technology-based system. The program will target facilities with high turnover rates and will provide these facilities with a centralized system for training, staff management, and resident care resources. Following completion of this program, the applicant anticipates a reduction in survey deficiencies, improvement in scope and severity tags, improvement in compliance, increase of overall quality of care, reduction in high-risk long-stay residents with pressure ulcers, and increase in short-stay residents who made improvements in function.

Based on our review, we find that the requirements at 42 CFR § 488.433 are met and that the proposal may be funded with federally imposed CMP funds.

Pursuant to 42 CFR § 488.433, states must make CMP-funded project results publicly available.

States shall submit project outcomes annually in February using the CMPRP Project Tracking Sheet, which will be posted on the CMS CMPRP website.

If you have any questions regarding this matter, please contact the CMPRP Team (CMP- Info@cms.hhs.gov).

Sincerely, Evan Shulman Director, Division of Nursing Homes Quality Safety & Oversight Group Center for Clinical Standard and Quality
