Jordan Macy DEP WQC AUTHORIZATION # New England District Army Corps of Engineers 24-WW07-0002-APP Department of the Army 401 WQC Application Completion on 696 Virginia Road 5/30/2024 Concord, MA 01742-2751
RE: Application for: BRP WW 07 - 401 WATER QUALITY CERTIFICATION FOR
DREDGING - MAJOR PROJECT
AT: Cape Cod Canal Section 111 Shore Damage Mitigation Project Cape Cod Drainage Basin and South Coastal Drainage Area
Dear Mr. Macy:
The Department of Environmental Protection (“MassDEP”) has reviewed your application for a 401 Water Quality Certification for Major Dredging, as referenced above and is basing its certification upon an evaluation of the information contained in the application which is relevant to water quality considerations. In accordance with the provisions of Section 401 of the Federal Clean Water Act (33 U.S.C. § 1251 et seq.), M.G.L. c. 21, §§ 26-53, and 314 CMR 9.00, MassDEP has determined there is reasonable assurance the project or activity, as conditioned herein, will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other appropriate requirements of state law.
The waters off of the Scusset Beach borrow area which is part of the South Coastal Drainage Area, and waters off of the Town neck Beach placement areas which is part of the Cape Cod Drainage Basin are designated in the Massachusetts Surface Water Quality Standards as SB. These waters are designated as a “habitat for fish, other aquatic life and wildlife, and for primary and secondary contact recreation”. Anti-degradation provisions of these Standards require that “existing uses and the level of water quality necessary to protect the existing uses shall be maintained and protected.”
The above-referenced project involves the dredging of approximately 327,000 to 387,000 cubic yards (cy) of sediment from a nearshore burrow area off of Scusset Beach and the

beneficial reuse as nearshore and beach nourishment material at the town-owned beach in Sandwich, Massachusetts (Town Neck Beach). Beneficial use of the dredged material for placement and construction of an engineered dune and beach berm at Town Neck Beach will allow the sand to stay in the littoral system and will build a beach profile protect public and private property, infrastructure, and an expansive saltmarsh system located behind the beach.
As identified in the April 12, 2023 letter from the Massachusetts Division of Marine Fisheries (DMF) to the United States Army Corp of Engineers and the Environmental Assessment prepared by Army Corps of Engineers dated February 20231,2, the project is located near three separate areas which have been mapped as containing eelgrass (Zostera marina). Eelgrass beds provide one of the most productive habitats for numerous marine species and are designated “special aquatic sites” under the Federal Clean Water Act 404(b) (1) guidelines. Eelgrass has been mapped adjacent to the nearshore and beach nourishment placement area at the Town Neck Beach. Conditions 14 through 17 below discuss eelgrass survey, documentation, and mitigation requirements related to protection for the existing bed located adjacent to the nearshore and beach nourishment (disposal of dredged material) area at the Town Neck Beach.
Sediment Chemistry Results: The United States Army Corp of Engineers (USACE) developed a project-specific sampling and analysis plan which was conducted as part of the Suitability Evaluation and the project Environmental Assessment. The USACE collected sediment grab samples at ten locations within the burrow site dredge area for grain size analysis.
The sediment of the dredge area is characterized as predominately poorly graded, fine to coarse sand material. Materials sampled from the proposed placement locations was likewise found to be sand or sand and gravels materials. A suitability evaluation was provided by USACE, which concluded that the dredge sediment was compatible/suitable composition for placement and beneficial reuse as nearshore and beach nourishment at the Town Neck Beach in Sandwich, MA,3.
Additional Protective Measures: The USACE claims sovereign immunity with respect to dredging activities.4 However, MassDEP strongly recommends that conditions provided below for the disposal of dredged material also be followed (when applicable) for the

4 The scope of sovereign immunity regarding state regulation of the proposed activity has not been definitively resolved. The Department does not address this issue at this time and reserves all rights to assert jurisdiction on future projects.
proposed dredging activity to be conducted to prevent degradation to wetlands and waters of the Commonwealth and to maintain the chemical, physical, and biological integrity of the water resources of the Commonwealth.
MassDEP requests that a bathymetric survey of the burrow site depicting post-dredge conditions be conducted following the completion of the dredging. At a minimum, the survey should include an overlay of the dredge footprint (i.e., top of slope) with sufficient coordinates in the Massachusetts State Plane (e.g., longitude and latitude) to clearly delineate the dredge footprint.
Every effort should be made to limit dredge vessel and/or barge overflow at dredge site and within waters of the Commonwealth.
Public Notice: The application public notice was published in the Sandwich Enterprise on February 9, 2024. No comments were received by MassDEP during the 21-day public comment period pursuant to 314 CMR 9.05(3)(e), which ended on March 1, 2024.
Section 61 Findings: As the Applicant, the USACE did not prepare an Environmental Notice (ENF) or Environmental Impact Report (EIR) in accordance with M.G.L. .c 30, §§ 61 to 62H including (MEPA). Rather, the USACE prepared a Draft Finding of No Significant Impact and Environmental Assessment (March 2021) as required under the National Environmental Policy Act.
