DIVISION 1 - GENERAL REQUIREMENTS

SECTION 011100 - SUMMARY OF WORK

PART 1 - GENERAL

1.01 SUMMARY:

A. This Section summarizes the Work covered in detail in the complete Contract Documents.

B. Owner: New York Air National Guard is contracting for Work described in the Contract

Documents.

1. Contract Identification: Base Defense Group Beddown – WHAY 089079

2. Work Site Location: Stewart Air National Guard Base, Newburgh, NY

C. Engineer: The Contract Documents were prepared by Burns & McDonnell Engineering

Company, Inc., 100 Eagle Rock Avenue, Suite 303, East Hanover, NJ 07936

1.02 PROJECT DESCRIPTION:

A. Description of Project: This Project provides for the renovation of existing Building 106

(14,730 SF) and construction of a new 34,000 SF two-story addition. The new facility will house the base’s new Security Forces Base Defense Group mission and the base’s Security Forces Squadron operation. The project also includes all utilities and supporting facilities. The project shall be phased such that Building 105 is substantially complete prior to the start of alteration work within Building 106.

B. Project Duration: 18 months (Phases 1 and 2).

1.03 WORK BY OTHERS:

A. Work Under Other Contracts: Not applicable.

1.04 CONTRACTOR'S USE OF PREMISES:

A. Limited Use:

1. Confine operations to areas within Contract limits indicated. Portions of Site outside the Contract limits shall not be disturbed.

2. Coordinate with the Government to avoid interference of operations.

3. Conduct operations so as to ensure the least inconvenience to the Government.

4. Contactors operations are to comply with all applicable Federal Aviation Administration

(FAA) requirements. Reference 14 CFR Part 77 – Objects Affecting Navigable Airspace.

1.05 OWNER'S USE OF PREMISES:

A. Partial Owner Occupancy: The Government reserves the right to occupy and to place and install equipment in completed areas of the building, prior to Substantial Completion provided that such occupancy does not interfere with completion of the Work. Such placing of equipment and partial occupancy shall not constitute acceptance of the total Work.

1.06 WORK SEQUENCE:

A. General: Construction sequence shall be determined by Contractor subject to the

Government's need for continuous operation of existing facilities.

B. Continuous Service of Existing Facilities: Exercise caution and schedule operations to ensure that functioning of present facilities will not be disrupted. Shutdown of the Government's operating facilities to perform the Work shall be held to a minimum length of time and shall be

coordinated with the Government who shall have control over the timing and schedules of such shutdowns.

C. Required Phases: Construct Work in following phases to provide the least possible interference to the activities of the Government.

1. Phase 1:Renovation of Building 105

2. Phase 2:Addition and Alteration of Building 106.

D. Substantially Completed Areas: Owner intends to place in service, in accordance with the provisions for use of completed Work set forth in the GENERAL CONDITIONS, the following areas or facilities as soon as they are Substantially Complete and ready for their intended use.

1. Building 105.

1.07 OWNER-FURNISHED EQUIPMENT AND MATERIALS:

A. Equipment: Equipment and Materials indicated on the Contract Documents as Government

Furnished – Government Installed (GFGI) will be furnished, paid for and installed by the Government.

1.08 MEASUREMENT AND PAYMENT:

A. Lump Sum Contracts: All Work indicated and specified in the Contract Documents shall be included in the Lump Sum Contract Price.

1.09 COPIES OF DOCUMENTS:

A. Furnished Copies: After execution of Agreement, Contractor will be furnished at no cost, a maximum of three sets of Contract Documents consisting of full-size Contract Drawings including revised Drawings, and the Project Manual, in addition to those used in execution of the Agreement.

1.10 LIST OF DRAWINGS (AND SCHEDULES):

A. Contract Drawings:

1. Each sheet of the Contract Drawings bears the following general title: Base Defense Group Beddown – Building 106, 105th Airlift Wing, Stewart Air National Guard Base, Stewart International Airport, Newburgh, NY.

2. Individual sheet numbers and titles are as stated on index sheet under "Contract Drawings".

B. Reference Drawings:

1. Reference Drawings included with the set of Contract Drawings are as stated on index sheet under "Reference Drawings."

PART 1 - GENERAL

1.01 SECTION INCLUDES:

1.02 QUALITY ASSURANCE:

A. For products or workmanship specified by association, trade, or Federal Standards, comply with requirements of the standard, except when more rigid requirements are specified or are required by applicable codes.

B. Conform to reference standard by date of issue current on date of Contract Documents, except when a specific publication date is specified.

C. Obtain copies of referenced standards, direct from publication source, when needed for proper performance of Work, or when required by Contract Documents.

D. Maintain copy at jobsite during submittals, planning, and progress of the specific work, until Substantial Completion.

E. Should specified reference standards conflict with Contract Documents, request clarification from Contracting Officer before proceeding.

F. The Contractual relationship of the parties to the Contract shall not be altered from the Contract Documents by mention or inference otherwise in any reference document.

SECTION 012300 – BID OPTIONS

PART 1 - GENERAL

1.01 SUMMARY:

A. This Section specifies administrative and procedural requirements for Bid Options.

B. Definition: A Bid Option is an amount proposed by Bidders and stated on the Bid Form for certain construction activities defined in the Bidding Requirements that may be added to or deducted from Base Bid amount if the Contracting Officer decides to accept a corresponding change in either the amount of construction to be completed, or in the Equipment and Materials, or installation methods described in Contract Documents.

C. Coordination: Coordinate related Work and modify or adjust adjacent Work as necessary to ensure that Work affected by each accepted Bid Option is complete and fully integrated into the Project. Costs listed for each Bid Option shall include costs of related coordination, modification, or adjustment.

D. Notification: Immediately following the award of the Contract, prepare and distribute to each party involved, notification of the status of each Bid Option. Indicate whether Bid Options have been accepted, rejected, or deferred for consideration at a later date. Include a complete description of negotiated modifications to Bid Options.

E. Schedule: A "Schedule of Bid Options" is included at the end of this Section. Specification Sections and/or Drawings referenced in the Schedule, if any, contain requirements for Equipment and Materials and methods necessary to achieve the Work described under each Bid Option.

1. Each Bid Option is defined by abbreviated language, recognizing that Drawings and

Specifications document the requirements.

2. Include as part of each Bid Option, miscellaneous devices, accessory objects, and similar items incidental to or required for a complete installation whether or not mentioned as part of the Bid Option.

PART 2 - PRODUCTS – NOT APPLICABLE.

PART 3 - EXECUTION

3.01 SCHEDULE OF BID OPTIONS:

A. Bid Option No. 1: Provide and install outdoor stand-by generator and automatic transfer switch in lieu of generator connection and manual transfer switch as indicated by details on the Drawings labeled “Option No.1.” Complete product and execution requirements are included in Division 26, SECTION 263213- DIESEL GENERATOR SET and SECTION 263600 - TRANSFER SWITCH. Contractor is responsible for all conduit, handholes, manholes, wiring, accessories, and labor required to provide a fully functional system.

B. Bid Option No. 2: Provide and install mechanically assisted, carriage mounted high-density storage system for Squad Room 103 in Building 106 as indicated by details on the Drawings labeled “Option No. 2.” Complete product and execution requirements are included in DIVISION 10, SECTION 105626 – MOBILE STORAGE SHELVING. Contractor is responsible for all rails, carriages, operators, accessories, and labor required to provide a fully functional system. Interior configuration requirements to be determined by Base Civil Engineer.

C. Bid Option No. 3: Provide and install mechanically assisted, carriage mounted high-density storage system for Armory 106 in Building 106 as indicated by details on the Drawings labeled “Option No. 3.” Complete product and execution requirements are included in DIVISION 10, SECTION 012300 - BID OPTIONS: continued

SECTION 105626 – MOBILE STORAGE SHELVING. Contractor is responsible for all rails, carriages, operators, accessories, and labor required to provide a fully functional system.

D. Bid Option No. 4: Provide and install Medium Voltage Pad-Mounted Sectionalizer Switch Cabinet. Contractor is responsble for connection in existing electrical manhole EMH#17, conductors, conduits, concrete pad, etc as indicated by details on the Drawings labeled “Option No. 4”. Complete product and execution requirements are included in SECTION 262213 –

TRANSFORMERS AND MEDIUM VOLTAGE PAD-MOUNTED SECTIONALIZER

SWITCH.

E. Bid Option No. 5: Remove existing exterior metal wall panels and trim from Building 106.

Provide and install new exterior metal wall panels and trim on Building 106 as indicated by details on the Drawings labeled “Option No.5”. Panel color and profile to match new insulated metal walls panels. This bid option shall include removal and reinstallation of all exterior light fixtures, signage and other appurtenances as required to allow for the installation of the new metal wall panel system. Complete product and execution requirements are included in SECTION 074213 – METAL WALL PANELS. Contractor is responsible for all material, trim, flashing, copings, fasteners, accessories and labor required to provide a functional and weathertight wall panel system.

SECTION 012500 - SUBSTITUTIONS

PART 1 - GENERAL

1.01 SUMMARY:

A. This Section includes administrative and procedural requirements for handling requests for substitutions made after award of the Contract.

B. Related Work Specified Elsewhere:

1. Requirements for submitting Contractor's construction progress schedule and the Submittal schedule: SECTIONS 013200 and 013300.

2. Requirements governing Contractor's selection of products: SECTION 016000.

1.02 DEFINITIONS:

A. Definitions in this Article do not change or modify the meaning of other terms used in the

Contract Documents.

B. Substitutions: Changes in products, Materials, Equipment, and methods of construction required by the Contract Documents proposed by the Contractor after award of the Contract are considered to be requests for substitutions. The following are not considered to be requests for substitutions:

1. Revisions to the Contract Documents requested by Contracting Officer.

2. Specified options of products and construction methods included in the Contract

Documents.

3. Substitutions requested during the bidding period, and accepted by Addendum prior to award of the Contract, are included in the Contract Documents and are not subject to requirements specified in this Section for substitutions.

1.03 SUBMITTALS:

A. Substitution Request Submittal: Contracting Officer will consider written requests for substitution if received within 60 days after commencement of the Work. Requests received more than 60 days after commencement of the Work may be considered or rejected at the discretion of Contracting Officer.

1. Submit 3 copies of each request for substitution for consideration. Submit requests in the form and according to procedures required for Change Order proposals. Requests for substitution shall not be submitted in the form of a Request for Information (RFI).

2. Identify the Equipment or Material, the fabrication, or installation method to be replaced in each request. Include related Specification Section/Article and Drawing numbers.

3. Provide complete documentation showing compliance with the requirements for substitutions, and the following information, as appropriate:

a. Statement indicating why specified product or method of construction cannot be provided.

b. Coordination information, including a list of changes or modifications needed to other parts of the Work and to construction performed by the Government and separate contractors, that will be necessary to accommodate the proposed substitution.

c. A detailed comparison of significant qualities of the proposed substitution with those of the Work specified. Significant qualities may include elements such as performance, weight, size, durability, visual effect, and specific features and requirements indicated.

d. Product data, including drawings and descriptions of products and fabrication and installation procedures.

e. Samples, where applicable or requested.

f. Identification of available sales, maintenance, repair, and replacement services.

g. A statement indicating the effect of the substitution on Contractor's construction progress schedule compared to the schedule without approval of the substitution.

Indicate the effect of the proposed substitution on the overall Contract Times. If specified product cannot be provided within the Contract Times, provide letter from manufacturer, on manufacturer's letterhead, stating lack of availability or delay in delivery.

h. An itemized estimate of costs that will result directly or indirectly from approval of the substitution, including:

(1) A proposal of the net change, if any, in the Contract Price.

(2) Costs of redesign required by the proposed change.

(3) Costs of resulting claims as determined in coordination with other contractors having work on the Project affected by the substitution.

i. Statement indicating whether or not incorporation or use of the substitute is subject to payment of any license fee or royalty.

j. Contractor's certification that the proposed substitution conforms to requirements in the Contract Documents, will perform adequately the functions and achieve the results called for by the general design, is similar in substance to that specified, and is suitable for same use as that indicated and specified.

k. Contractor's waiver of rights to additional payment or time that may subsequently become necessary because of the failure of the substitution to perform adequately.

4. Contracting Officer’s Action: If necessary, Contracting Officer will request additional information or documentation for evaluation within one week of receipt of a request for substitution. Contracting Officer will notify Contractor of acceptance or rejection of the substitution within 2 weeks of receipt of the request, or one week of receipt of additional information or documentation, whichever is later. Acceptance will be in the form of a Change Order.

PART 2 - PRODUCTS

2.01 SUBSTITUTIONS:

A. Conditions: Contracting Officer will receive and consider Contractor's request for substitution when one or more of the following conditions are satisfied, as determined by Contracting Officer. If the following conditions are not satisfied, Contracting Officer will return the requests without action except to record noncompliance with these requirements.

1. Extensive revisions to the Contract Documents are not required.

2. Proposed substitution is in keeping with the general intent of the Contract Documents and will produce indicated results.

3. Substitution request is timely, fully documented, and properly submitted.

4. The specified product or method of construction cannot be provided within the Contract

Times. Contracting Officer will not consider the request if the product or method cannot be provided as a result of failure to pursue the Work promptly or coordinate activities properly.

5. The requested substitution offers the Government a substantial advantage, in cost, time, energy conservation, or other considerations, after deducting additional responsibilities Government must assume. Governemnt's additional responsibilities may include compensation to Engineer for redesign and evaluation services, increased cost of other construction by Government, and similar considerations.

6. The specified product or method of construction cannot receive necessary approval by a governing authority, and the requested substitution can be approved.

7. The specified product or method of construction cannot be provided in a manner that is compatible with other materials and where Contractor certifies that the substitution will overcome the incompatibility.

8. The specified product or method of construction cannot be coordinated with other materials and where Contractor certifies that the proposed substitution can be coordinated.

9. The specified product or method of construction cannot provide a warranty required by the Contract Documents and where Contractor certifies that the proposed substitution provides the required warranty.

10. Where a proposed substitution involves more than one prime contractor, each contractor shall cooperate with the other contractors involved to coordinate the Work, provide uniformity and consistency, and assure compatibility of products.

B. Contracting Officer’s review and acceptance of Submittals shall not relieve Contractor from responsibility for any variation from the requirements of the Contract Documents. Contracting Officer’s acceptance of Submittals not complying with the Contract Documents does not constitute an acceptable or valid request for substitution, nor does it constitute approval of a substitute. Acceptance by Contracting Officer shall not relieve Contractor from responsibility for errors or omissions in the Submittals.

SECTION 012600 - CHANGE ORDERS/MODIFICATIONS TO CONTRACT

PART 1 - GENERAL

1.01 SUMMARY:

A. Promptly implement Change Order/modifications.

1. Provide full written data required to evaluate changes.

2. Provide full documentation to Contracting Officer on request.

B. Designate in writing the member of the Contractor's organization:

1. Who is authorized to negotiate/accept changes in the Work.

C. Contracting Officers are the only agents of the Government that can bind the Government or make changes in the Contract.

1.02 DEFINITIONS:

A. Change Order/modifications: A Change Order/modification is a written change to the

Contract. A Contract Change Order or modification is prepared on a Standard Form 30.

1.03 PRELIMINARY PROCEDURES:

A. Contracting Officer(s) may initiate changes by submitting a Proposal Request to the

Contractor. Request may include any or all of the following:

1. Detailed description of the change, products, and location of the change in the Project.

2. Supplementary or revised drawings and specifications.

3. The projected time span for making the change, and a specific statement as to weather overtime work is, or is not authorized.

4. A specific period of time during which the requested price will be considered valid.

5. Such request is for information only, and is not an instruction to execute the changes, nor to stop work in progress.

B. Contractor may initiate changes by submitting a written notice to Contracting Officer, containing:

1. Description of the proposed changes.

2. Statement of the reason for making the changes.

3. Statement of the effect on the Contract Sum and the Contract Time.

4. Statement of the effect on the work of separate contractors.

5. Documentation supporting any changes in Contract Sum or Contract Time as appropriate.

1.04 CONSTRUCTION CHANGE DIRECTIVE:

A. In lieu of proposal request, Contracting Officer may issue a modification for Contractor to proceed with a change for subsequent inclusion in a modification.

B. Authorization will describe changes in the Work, both additions and deletions, with attachments of revised Contract Documents to define details of the change, and will designate the method of determining any change in the Contract Sum or any change in Contract Time.

C. Contracting Officer(s) will sign and date the construction change directive as authorization for the Contractor to proceed with the changes.

D. Contractor shall sign and date the construction change directive to indicate agreement with the terms therein.

1.05 DOCUMENTATION OF PROPOSALS:

A. Support each quotation for a cost proposal, and for each unit price which has not previously been established, with sufficient substantiating data to allow Contracting Officer to evaluate the quotation.

2. Change Order will describe changes in the Work, both additions and deletions, with attachments of revised Contract Documents to define details of the change.

3. Change Order will provide an accounting of the adjustment in Contract Sum and Contract Time.

1.07 FIXED PRICE CHANGE ORDER/MODIFICATION:

A. Content of Change Orders will be based on either:

1. Contracting Officer's proposal request and Contractor's responsive proposal as mutually agreed between Contracting Officer and Contractor.

2. Contractor's proposal for a change, as recommended by Contracting Officer.

B. Contracting Officer(s) will sign and date the Change Order as authorization for the Contractor to proceed with the changes.

C. Contractor shall sign and date the Change Order to indicate agreement with the terms therein.

1.08 UNIT PRICE CHANGE ORDER:

A. Content of Change Order will be based on either:

1. Contracting Officer definition of the scope of the required changes.

2. Contractor's proposal for a change, as recommended by Contracting Officer.

3. Survey of completed work.

B. The amount of the unit prices to be:

1. Those stated in the Agreement.

2. Those mutually agreed upon between Contracting Officer and Contractor.

C. When quantities of each of the items affected by the Change Order can be determined prior to start of the Work:

1. Contracting Officer(s) will sign and date the Change Order as authorization for

Contractor to proceed with the changes.

2. Contractor shall sign and date the Change Order to indicate agreement with the terms therein.

D. When quantities of the items cannot be determined prior to start of the Work:

1. Contracting Officer(s) will issue a Construction Change Directive directing Contractor to proceed with the change on the basis of unit prices, and will cite the applicable unit prices.

2. At completion of the change, Contracting Officer will determine the cost of such Work based on the unit prices and quantities used.

3. Contractor shall submit documentation to establish the number of units of each item and any claim for a change in Contract time.

1.09 FIELD CHANGE DOCUMENTS:

A. A construction field change is a "no cost" change which can be handled expeditiously in the field. The Standard Form 30 is not required. The signature of the Contractor-authorized representative, Government project engineer, and Contracting Officer sign the form. All parties receive a copy of the Construction Field Change Form with the original filed in the Contract file.

1.10 CORRELATION WITH CONTRACTOR'S SUBMITTALS:

A. Periodically revise the construction schedule to reflect each change in Contract time.

1. Revise subschedules to show changes for other items of Work affected by the changes.

B. Upon completion of Work under a Change Order, enter pertinent changes in Record

Documents.

1.02 DEFINITIONS:

A. RFI: Request for information prepared by Contractor and submitted to Contracting Officer seeking interpretation or clarification of the Contract Documents.

1.03 COORDINATION:

A. Coordination: Coordinate construction operations included in different Sections of the

Specifications to ensure efficient and orderly installation of each part of the Work. Coordinate construction operations, included in different Sections, that depend on each other for proper installation, connection, and operation.

1. Schedule construction operations in sequence required to obtain the best results where installation of one part of the Work depends on installation of other components, before or after its own installation.

2. Coordinate installation of different components with other contractors to allow optimum accessibility for required maintenance, service, and repair.

3. Make adequate provisions to accommodate items scheduled for later installation.

4. Where availability of space is limited, coordinate installation of different components to allow optimum performance and accessibility for required maintenance, service, and repair of all components, including mechanical and electrical.

B. Prepare memoranda for distribution to each party involved, outlining special procedures required for coordination. Include such items as required notices, reports, and list of attendees at meetings.

1. Prepare similar memoranda for the Government and separate contractors if coordination of their Work is required.

C. Administrative Procedures: Coordinate scheduling and timing of required administrative procedures with other construction activities and activities of others to avoid conflicts and to ensure orderly progress of the Work. Such administrative activities include, but are not limited to, the following:

1. Preparation of construction progress schedule.

2. Preparation of the schedule of values.

3. Installation and removal of temporary facilities and controls.

4. Delivery and processing of Submittals.

5. Progress meetings.

1.04 SUBMITTALS:

A. Coordination Drawings: Prepare Coordination Drawings if limited space availability necessitates maximum utilization of space for efficient installation of different components or if coordination is required for installation of products and materials fabricated by separate entities.

1. Content: Project-specific information, drawn accurately to scale. Do not base

Coordination Drawings on reproductions of the Contract Documents or standard printed data. Include the following information, as applicable:

a. Indicate functional and spatial relationships of components of architectural, structural, civil, mechanical, process, and electrical systems.

b. Indicate required installation sequences.

c. Indicate dimensions shown on the Contract Drawings and make specific note of dimensions that appear to be in conflict with submitted Equipment and minimum clearance requirements. Provide alternate sketches to Contracting Officer for resolution of such conflicts. Minor dimension changes and difficult installations will not be considered changes to the Contract.

d. Crane or other construction equipment placement and motion space required.

2. Sheet Size: At least 24 by 36 inches but no larger than 30 by 40 inches.

3. Number of Copies: Submit one electronic copy and two opaque hard copies of each

Submittal to Contracting Officer. Contracting Officer will return comments on one copy.

4. Refer to individual Sections for coordination drawing requirements for Work in those

Sections.

1.05 PROJECT MEETINGS:

A. Preconstruction Conference:

1. Contracting Officer will conduct a meeting within 20 days after the Effective Date of the Agreement, to review items stated in the following agenda and to establish a working understanding between the parties as to their relationships during performance of the Work.

2. Preconstruction conference shall be attended by:

a. Representative(s) of Contractor including Contractor’s superintendent.

b. Engineer.

c. Contracting Officer.

d. Representative(s) of Government.

e. At Contracting Officer's option, representatives of principal Subcontractors and

Suppliers.

3. Meeting Agenda:

a. Construction schedules.

b. Phasing.

c. Critical Work sequencing and long-lead items.

d. Designation of key personnel and their duties; lines of communication.

e. Project coordination.

f. Procedures and Processing of:

(1) RFIs.

1. Contracting Officer will conduct a meeting at least ten days before submission of the first Application for Payment to finalize the initial coordination schedules requested under SECTION 013200 - CONSTRUCTION PROGRESS SCHEDULES AND

REPORTS.

2. The meeting shall be attended by:

a. Representative(s) of Contractor including Contractor’s superintendent (and scheduler).

b. At Contracting Officer's option, representatives of principal Subcontractors and

Suppliers.

c. Engineer.

d. Representative(s) of Government.

C. Construction Progress Meetings:

1. Contracting Officer will schedule and conduct a meeting at least bi-weekly and at other times requested by Contracting Officer. Representatives of the Government, Engineer, and Contractor shall be present at each meeting. With Contracting Officer's concurrence, Contractor may request attendance by representatives of Subcontractors, Suppliers, or other entities concerned with current program or involved with planning, coordination, or performance of future activities. All participants in the meeting shall be familiar with the Project and authorized to conclude matters relating to the Work.

2. Contractor and each Subcontractor represented shall be prepared to discuss the current construction progress report and any anticipated future changes to the schedule. Each Subcontractor shall comment on the schedules of Contractor and other Subcontractors and advise if their current progress or anticipated activities are compatible with that Subcontractor's Work.

3. If one Subcontractor is delaying another, Contractor shall issue such directions as are necessary to resolve the situation and promote construction progress.
