EVALUATION FACTORS

SECTION 00 21 16

EVALUATION FACTORS FOR AWARD

1.0 BASIS OF AWARD

Award of this Contract will be made to the technically acceptable responsible Offeror submitting the lowest priced offer (based on the total of all line items on the Price Schedule) – Lowest Priced

Technically Acceptable Offer (LPTA). This acquisition will result in the award of a firm-fixed price, construction contract.

The technical evaluation of each proposal will be solely on the basis of Technical Evaluation

Factors found in this section. The Government will evaluate each proposal on a technically acceptable/unacceptable basis only with respect to the technical evaluation factors (criteria) described herein. Award will be made on the basis of the lowest evaluated price of the proposal meeting or exceeding the acceptability standards for non-cost factors.

It is the intent of the Government to award off initial offers without discussions.

2.0 PROPOSAL EVALUATION

2.1 Technical Evaluation:

Acceptability will be based on all factors receiving an acceptable rating. The proposal will be evaluated according to the criteria for Non-Price Evaluation Factors of this section.

Proposals will receive either an ACCEPTABLE or an UNACCEPTABLE rating for each of the evaluation factors. Find the description of these ratings in Table 1.

TABLE 1: TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS

Rating: Description:

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

2.2 Pricing Evaluation:

The Government will evaluate price proposals in accordance with FAR 52.217-5, Evaluation of

Options for award purposes of all line items identified on the Contract Line Item Schedule

(Price-Schedule), Section 00 10 00 of this Solicitation.

3.0 EVALUATION PROCESS:

The evaluation process consists of three parts:

1) Proposal Compliance Review. This is an initial review to ensure that all required forms and certifications are complete and that a complete proposal is received. An initial review of each of the proposals will be conducted to check for apparent errors, omissions and areas that require clarification. The purpose of this preliminary review session is to eliminate minor irregularities or apparent clerical mistakes. This preliminary evaluation will ensure that each proposal contains the Technical Proposal Volume I and Price

Proposal Volume II and the correct number of copies.

2) Relevant Experience and Past Performance. Relevant Experience and Past

Performance will be evaluated according to the criteria for Non-Price Evaluation Factors found in this section.

3) Price Evaluation. The Government will evaluate price for fairness and reasonableness through the use of price analysis in accordance with FAR 15.404-1(b). Price will also be verified for unbalancing of line items in accordance with FAR 15.404-1(g).

3.1 Definitions:

a) Clarification is a limited exchange with an Offeror for the sole purpose of eliminating minor irregularities, informalities, or apparent clerical mistakes in the proposal or to address adverse past performance not previously addressed with the

Offeror. Clarifications do not give an Offeror the opportunity to revise or modify its proposal and are used, as necessary, when not opening discussions.

b) Communications are a limited exchange with an Offeror used to assist in determinations of the competitive range. Communications are limited to enhancing

Government understanding of proposals and addressing adverse past performance information not previously addressed if said information is the determining factor preventing an Offeror from being included in the competitive range. Such communications shall not be used to cure proposal deficiencies or material omissions, or otherwise revise the proposal.

c) Discussions offer the opportunity to resolve deficiencies or weaknesses in the proposals, based on the requirement and the evaluations factors set forth in the solicitation. If the Contracting Officer determines it is necessary to open discussions, they must discuss with all Offerors in the competitive range. Offerors have the opportunity to revise their proposals at the conclusion of discussions.

d) Relevant: “Relevant” is defined as having a logical connection with the requirements in this request for technical proposals; that is, featuring work that is similar in nature, magnitude, and complexity to the current requirement. To be acceptable, there must be an explanation of how the provided project information is relevant to the proposed work.

e) Year: A “year” is 365 consecutive days.

3.2 Bid Guarantee:

The Offeror is required to submit a bid guarantee along with its proposal in accordance with

FAR Subpart 28.101. The bid guarantee shall be included in Volume II of the proposal. Any proposal received without a bid guarantee will be rejected and is ineligible for review by the

Government. The amount of the Bid Guarantee shall be twenty (20) percent of the Offeror’s proposed price or $3,000,000.00, whichever is less.

3.3 Submission Format: (Please refer to Section 00 21 00 for number of required copies)

All proposal materials shall be submitted in binders with a table of contents and tabbed section dividers. The sections should parallel the submission requirements identified below. In Volume

I, Technical Proposal, there shall be a tabbed section for each Non-Price Evaluation factor.

Volume II, Price Proposal, shall be submitted in a clearly marked envelope.

3.3.1 Volume I - Offeror’s Technical Proposal shall include the following sections, in the general format specified below:

4.0 EVALUATION CRITERIA

4.1 CRITERIA for Non-Price Evaluation Factors:

Proposals shall concisely, accurately, and completely provide the information required for each of the following non-price evaluation factors. NOTE: Absence of complete information will be deemed as if no support information was provided for that factor. Proposals that do not meet the minimum requirements of all of the non-price evaluation factors shall be determined to be

UNACCEPTABLE and are not eligible for award consideration. No assumptions may be made by the Government. Your proposal must clearly demonstrate the requisite technical experience and qualifications to receive an ACCEPTABLE rating for each of the following criteria:

EXPERIENCE OF OFFEROR/PRIME.

FACTOR B VOLUME 1, TAB B PAST PERFORMANCE OF PRIME

FACTOR C VOLUME 1, TAB C PROPOSED TECHNICAL APPROACH

5.0 FACTOR A– Relevant Construction Experience of Offeror/Prime:

5.1 Definitions for Factor A (Definitions for the purposes of this factor):

Relevant construction project means a construction project located on an active United States military installation that is capable of receiving, storing, transferring, and offloading aviation fuel, constructed for the purpose of fueling aircraft.

Substantially completed means at a minimum turned over for beneficial occupancy in its entirety (not partially turned over).

Affiliate means any entity that will have meaningful involvement in contract performance.

Key Subcontractor means a subcontractor who at a minimum directly performed all of the major or critical aspects of a relevant construction project, which are the facilities or systems for receiving, storing, transferring, and offloading aviation fuel.

5.2 Submission Requirements for Factor A:

The Offeror shall submit a minimum of two (2) and no more than four (4) examples of substantially completed relevant construction projects on which the Offeror (or Affiliate) performed either as the prime contractor or as a Key Subcontractor. However, at least one of the total number of submitted projects must have been performed by the Offeror. If any project submitted is that of an Affiliate, it must be accompanied by a signed Letter of Commitment from that Affiliate committing them as a member of the team for this project (see Attachment 2). The

Offeror shall use Attachment 2 to explain how the Affiliate will have meaningful involvement in contract performance. The submitted projects shall be 100% construction progress complete or substantially complete within six (6) years from the date of issuance of this solicitation.

5.2.1 At least one project example shall include all elements of the following four phases of airfield fueling: (1) offload, (2) transfer (systems of pumps, filters and pipes), (3) aviation fuel storage, and (4) fuel delivery to equipment that complies with the direct aircraft fueling systems criteria for Type III, IV, or V hydrant fueling systems as specified in the Unified Facilities

Criteria (UFC) 3-460-01. The construction contract for this project example shall be a minimum of $15 million in magnitude.

5.2.2 Other project examples shall include at a minimum two elements of the following four phases of airfield fueling, but may include multiple or all phases: (1) offload, (2) transfer

(systems of pumps, filters and pipes), (3) aviation fuel storage, or (4) fuel delivery to equipment that complies with the direct aircraft fueling systems criteria for Type III, IV, or V hydrant fueling systems as specified in the Unified Facilities Criteria (UFC) 3-460-01. One of the elements included must be phase (4). The construction contract for these project examples shall be a minimum of $8 million in magnitude.

5.2.3 At least one project example shall include vertical construction of at least 1,000 square feet

(SF) and include HVAC, mechanical, electrical, and plumbing features. This project submission may either be submitted independently of 5.2.1 or 5.2.2 or as part of a project submission under

5.2.1 or 5.2.2.

Using a Relevant Experience Matrix similar to that shown below in Table 3, clearly identify to which phase of airfield fueling each project example submitted under 5.2.1, 5.2.2. and 5.2.3 pertains.

*Please note, Table 3 above is an example. In total, the projects submitted must fulfill all applicable column requirements as explained in Paragraphs 5.2.1 – 5.2.3.

The Offeror shall also submit an explanation briefly justifying each designation in the Relevant

Experience Matrix for each submitted example project. This explanation shall not exceed two (2)

8.5” x 11” double-sided pages or four (4) 8.5” x 11” single-sided pages, regardless of the total number of projects submitted.

If the Offeror submits more than four (4) project examples, the Government shall only evaluate the first four (4) submitted projects. If the Offeror submits more than two (2) project examples but the Government determines that two (2) project examples collectively meet the requirements of 5.2.1, 5.2.2, and 5.2.3, the Government may decline to evaluate the remaining project examples.

Note: For project(s) submitted where work was performed by the Offeror (or Affiliate) as a Key

Subcontractor, the Offeror shall submit a separate statement that includes the total contract amount, the dollar amount of the work performed as the Key Subcontractor, a description of the elements of work specifically completed by the Offeror (or Affiliate) while working as a Key

Subcontractor, and the percentage of work performed as the Key Subcontractor. The statement shall also justify how the Offeror (or Affiliate) meets the definition of “Key Subcontractor” in the context of the example project(s) submitted. The statement shall not exceed one (1) 8.5” x

11” double-sided page or two (2) 8.5” x 11” single-sided pages, regardless of the total number of projects submitted where work was performed as a Key Subcontractor. If it is determined by the

Government that based on the information provided by the Offeror (or Affiliate) does not in fact meet the definition of a Key Subcontractor, the project will not be considered for evaluation.

5.3 Evaluation Method for Factor A:

Factor A will be evaluated to determine whether the Offeror’s submission meets the requirements of this factor. If any of the required information is not provided in the Offeror’s proposal or fails to meet the requirements, the Offeror will be evaluated as “Unacceptable.”

TABLE 4: FACTOR A - RELEVANT CONSTRUCTION EXPERIENCE OF

OFFEROR/PRIME

Rating: Description:

Acceptable The proposal clearly demonstrates how at least two of the project examples submitted meets the requirements of section 5.0.

Unacceptable The proposal does not clearly demonstrate how at least two of the project examples submitted meets the requirements of section 5.0.

6.0 FACTOR B – Past Performance of Offeror/Prime

6.1 Submission Requirements for Factor B:

The project examples submitted for Paragraphs 5.2 Submission Requirements for Factor A will be used for evaluation of Past Performance of the Offeror (or Affiliate), as well as other past performance information.

The Past Performance Questionnaire (PPQ) (Attachment 3) included in the back of this Section

00 21 16 is provided for the Offeror to submit to the client of each project the Offeror includes in its proposal for Factor A in paragraph 5.2. Ensure correct phone numbers and email addresses are provided for the client’s point of contact (POC). Completed Past Performance Questionnaires should be submitted with your proposal. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Lorraine.Q.Laurente@usace.army.mil, via email prior to proposal closing date and time.

We will accept previously submitted PPQs on Form PPQ-0. Please ensure all information is up to date and meets the requirements of the evaluation factor.

Note: You may submit CCASS ratings in lieu of the PPQ forms included in Attachment 3 if you completely fill in blocks 1 - 5 of the Contract Information portion of the NAVFAC/USACE Past

Performance Questionnaire (Form PPQ-0) and submit with the Final CCASS report. Be sure to include the POC’s information of the Client and the Contract Number of the project.

6.2 Evaluation Method for Factor B: The method of rating for Factor B shall be as follows:

The Government will evaluate an Offeror’s (or Affiliate’s) past performance based on a demonstrated record of performance in accordance with FAR 15.305(a)(2). Past performance information is an indicator of an Offeror’s ability to perform the contract successfully.

The Government will evaluate the successful completion of all project examples for the past six

(6) years. The Government reserves the right to check any or all cited references to verify supplied information and to assess owner satisfaction.

The Government may review any other sources of information for evaluating past performance.

Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor

Performance Assessment Reporting System (CPARS). This information may involve the

Offeror’s Affiliate if an Affiliate’s project is submitted for Factor A.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

NOTE: In the case of an Offeror without a record of past performance or for whom information on past performance is not available; the Offeror’s past performance may not be evaluated as

TABLE 5: FACTOR B – PAST PERFORMANCE OF OFFEROR EVALUATION RATING
