SECTION 01 10 50.01

HAZARDOUS MATERIALS PROCEDURES

PART 1 - GENERAL

1.1 SUMMARY OF WORK

A. A key element to the Pollution Prevention program at the 125th Fighter Wing is the control of Hazardous Material (HM). To control HM use, a Hazardous Materials Pharmacy (HAZMART) program has been fully implemented within the installation. The HAZMART focuses on source reduction as the preferred method of pollution prevention. Control of HM includes reducing the number of types and amounts of HM used, and controlling its proper distribution, storage, use, and disposal. The Contractor shall comply with all Federal, state and local Environmental Management System (EMS) environmental standards.

B. Contractor shall follow the hazardous materials management processes in the 125th Fighter Wing’s “Environmental Protection Plan for Contractor’s”.

C. Contractor shall establish a Hazardous Material (HM) storage and distribution system when HM is to be used.

1. All HM required to support the contract shall be reported to the Hazardous Material Pharmacy (HMP) using the “Transient Organization HM Inventory” forms (for short or long term contracts as required) in attachments 1 and 2 of this specification section.

2. The “Transient Organization HM Inventory” forms will be provided to the Contractor during contract award.

3. All hazardous materials must be approved by the Installation Hazardous Materials Management Team prior to being brought onto the base.

4. Any additional HM needed by the Contractor shall be identified to the Contracting

Officer’s Representative (COR) and approved by the Hazardous Materials Management Team prior to being brought onto the base.

D. Contractor shall submit a list of hazardous materials to be used to the installation HMP prior to the start of work, using Construction Hazardous Materials Submittal Form, in order to support the installation’s compliance with Executive Order 12856, Federal Compliance with Right-to- Know Laws and Pollution Prevention Requirements.

1. The contractor shall submit two HM approval packages consisting of an AF Form 3000

(Material Approval Submittal) with the following documents in a binder: (1) Transient Organization Hazardous Material Inventory Form, (2) hardcopies of project Safety Data Sheets (SDS’s) and (3) a CD containing electronic copies of the “Transient Organization Hazardous Materials Inventory Form” and copies of all SDS’s. Once approved, both the

Contractor and COR keeps one binder each. These documents become part of the official project documentation.

E. Contractor shall maintain a “Transient Organization HM Inventory” for all HM on the job site for inspection/verification.

F. COR will verify that the HM identified to the HMP is the only HM in use on the job site.

G. Contractor shall provide the following to the HMP:

1. A list of each material and quantity of material for all proposed HM. Hazardous Material (HM) shall be construed to mean any item that is:

a. A health hazard or physical hazard as defined in 29 CFR, 1910.1200(c).

b. Regulated in its disposal by federal Environmental Protection Agency (EPA) under

40 CFR.

c. Hazardous as defined by federal Department of Transportation (DOT) regulations under 49 CFR.

d. Hazardous as defined by the Dangerous Goods Regulations of the International Air Transport Association.

2. A safety data sheet (SDS) for each item on the HM list. SD shall also be provided electronically by individual MSDS for processing prior to work beginning. These SDS shall also be maintained in a Binder within the project trailer or wherever the construction project is headquartered.

3. Examples of hazardous materials used on the job site include, but are not limited to:

a. Petroleum based liquids/gases (gasoline, kerosene, diesel, propane, butane, acetylene, etc.).

b. Adhesives and glues.

c. Shot charges for anchor systems.

d. Volatile solvents (such as PVC cleaner and glues, paint thinners).

e. Non-water-based paints.

f. Liquid sealants.

g. Epoxies and coating systems.

h. Acidic or alkali cleaners.

H. Contractor shall establish a construction-specific HM storage and issue location that fully complies with federal, state and local environmental regulations.

1. Materials issued shall be tracked for quantities used.

2. Unused materials shall be inventoried and removed from Base property prior to close-out of the contract or expiration date of the HM.

3. Reports of materials delivered, used and removed from the installation shall be submitted to the COR monthly and prior to contract close-out.

I. Contractor shall accompany the COR and the installation Environmental Manager (EM) on project close-out inspection to ensure all used and unused HM has been removed from the installation. This requirement shall not be a punch list item and must be accomplished prior to the government accepting beneficial occupancy of the facility or construction item. (See Attachment 2.)

1.2 SUPPLEMENTS

A. The supplements listed below, following “End of Section,” are part of this specification.

1. Transient Organization HM Inventory (Short Term Contract).

2. Transient Organization HM Inventory (Long Term Contract).

3. Contractor Hazardous Material Identification Form Close-Out Procedures.

Contractor Hazardous Material Close-Out Procedures Certification

By signing this form, the contractor and government representatives certify that:

1. The contractor has reported all HM usage during the contract to the COR (short term contracts).

2. The contractor has updated all authorized HM to the COR (long term contracts).

3. The COR ensured that all HM’s have been entered in EESOH-MIS.

4. The COR ensured that a print out of all used/authorized HM have been obtained from

EESOH-MIS and placed in the project closeout documents.

5. The COR notified the Contracting Officer that all used HM have been entered and closed out in EESOH-MIS.

6. Contractor, the Contracting Officer’s Representative and the Environmental Manager have performed a close-out inspection to ensure that all used and unused HM have been removed from the installation.
