SCOPE OF WORK

FY16 Poe Lock Embedded Gate Anchorage Replacement Scope of Work

The scope of the project includes, but is not limited to, the installation of new embedded gate anchorages behind the existing gate anchors and the connection to the lock gate leaf at the Poe Lock which is part of the Soo Locks Complex in Sault Ste. Marie, Michigan. The Poe Lock is a 110 feet wide by 1200 feet long navigation lock which allows vessels to safely transit the 21 foot in drop in water elevation between Lake Superior and the lower Great Lakes. The scope includes installation of new primary and secondary embedded anchorages at Gates 1, 2 and 3. The embedded gate anchorages distribute the top reaction of the leaf into the concrete lock wall. Each gate leaf is supported by two embedded anchorages, a primary and secondary embedded anchorage. The embedded anchorages are positioned adjacent to the top of the gate leaf, below the surface of the concrete lock wall.

Installation will require removal of concrete to install steel anchorage frames, drilling of concrete cores to accommodate concrete anchors, installation of steel anchorage frames and tensioned concrete anchors, and placement of new concrete. The contract will also include fabrication of steel embedded anchorage frames and anchor rods. Fabricated elements will consist of fracture critical members and applicable steel specifications. The top of the existing embedded anchorage will be removed to accommodate the connection of the new embedded anchorage to the existing gate leaf, the bottom portion of the existing embedded anchorage shall be abandoned in place. Contract award is expected in summer 2016. Steel fabrication shall begin in summer 2016. Concrete removal shall begin in summer/fall 2016, and placement of components of the new embedded anchorages including anchor demonstration test, will be allowed during the navigation season (25 March – 15 January). Time is of the essence for the project. The schedule for working within the lock area for this project is rigid and is limited to the timeframe when winter lock closure takes place for lock maintenance (17 January 2017 thru 19 March 2017). This will include final installation of the anchorage and connection to the lock gate. Project delays that cause the project to extend past the required completion date would adversely impact the commercial navigation industry and time extensions will not be granted.

It is critical that all the gates in the contract are turned over to the government in functioning condition no later than 19 March 2017. For the gates to be considered functional, they must operate as originally designed. Weather conditions during the winter shut down at the Soo Locks are very harsh with low temperatures, heavy snow, and high winds.

The schedule for the project (as described in specification section 01 32 01.00 10) will be proposed by the contractor and, when accepted by the government, becomes part of the contract. The contractor's failure to meet the contract schedule milestones could result in unilateral direction from the government that alters the schedule to ensure that the gate is in functioning condition no later than 19 March 2017.

Security requirements:

a. All personnel employed by the contractor in the performance of the services specified in this contract or any representative of the Contractor entering the work area shall conform and comply with all applicable U.S. Army Corps of Engineers, facility access, security policies and procedures. (Provided by government representative). All personnel and vehicles are subject to search upon entry, exit and within the confines of the facility.

b. Pre-screening of contractor candidates via E-verify Program: The Contractor must pre‐screen candidates using the E‐verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that all contractors working on the site have two valid forms of Government issued identification prior to entering the information in E-Verify. The vendor must ensure the correct information is entered into the E‐verify system. A verification sheet for each verified/eligible contractor candidate must be provided to the COR no later than 3 business days after the initial contract award. (The purpose of using E-Verify is to ensure all contractors are U.S. citizens or documented foreign citizens with authority to work in the United States of America). The COR will forward the verification sheets to the USACE, Detroit District Security Office for validation.

c. Clearance of Personnel: All Contractor and Sub-Contractor employees are required to have a National Agency Check (Fingerprint Check) with favorable adjudication prior to their being able to enter the work site. The Contractor will be responsible for working with the COR to submit all required paperwork for each employee to the Security Office prior to initiation of the background investigation.

The contractor may complete Government furnished fingerprint cards at a local police station for each employee that will be working at the project location. The cost for the fingerprinting is the responsibility of the contractor. The completed fingerprint cards shall be provided to the Security Office.

The preferred method recommended by the Government, at no cost to the contractor, is to complete an electronic fingerprint submission with the Soo Locks Facility Security Officer (FSO). FSO Point of contact is Mr. Michael Panik at 906-635-3470

The contractor should anticipate the fingerprint cards to take approximately 24 days and the electronic finger prints to take approximately 8 business days for adjudication. These are estimates only, actual times may vary.

d. Exceptions to Background Investigation: All exceptions will be reviewed and authorized after a thorough review by the Detroit District Security office on a case by case basis.

e. Security Checks ‐ All contract employees must carry valid Government issued picture identification at all times.

They must show I.D. upon request by both Security and Government personnel. The Contractor's employees must enter the site through the main security checkpoint unless otherwise approved by the Contracting Officer. The Contractor's employees will be subject to such additional checks as may be deemed necessary to ensure that no violation of security rules has occurred.

f. Security Access List - The contractor shall be required to maintain a list of personnel needing access to the site.

The list shall be updated at least weekly or each time a change is made. The template for the list will be provided to the contractor at the Pre-construction conference. The list shall be submitted prior to 1400 at least 24 hours prior to an individual requiring site access.

g. Facility Access: 24 hour per day 7 day a week access to the facility is through the unmanned automatic parking lot gate (Gate 4 Foot of Ashmun St.). Gates 15, 13, 10, and 7 are open generally 0600-1800 7 days a week between May and September. Gate 9 is generally open 0600-1800 7 days a week year round. The front door of the warehouse is generally open 0600-1800 Monday – Friday excluding Federal Holidays. There are numerous other automatic gates that the contractor may be required to pass through in order to reach the work area. Gate Access through any of the gates listed above are subject to change.

Access through any non-automated gates or Gate 15, 13, 10, 7 and 9 outside of established hours must be coordinated in advance with the COR so the Government can coordinate with the Security Contractor. The government will not provide guard escort services for the contractor.

All automatic entrances require personnel to be in possession of a FIPS 201 compliant identification card.

CAC, PIV, TWIC, etc. Contractor employees may be required to know the PIN number for their FIPS 201 compliant identification card to access certain areas of the facility. The Government can only reset PINs on CAC cards. The Government will not issue CAC cards to contractor personnel.

h. Exclusion or Expulsion from the Site ‐ A negative background investigation (NAC) may result in the exclusion or expulsion of Contractor employees from the site as determined by the Detroit District, Chief, Security & Law Enforcement. Additionally any failure to observe the security rules will also result in the potential exclusion or expulsion of Contractor employees from the site. Exclusion or expulsion of an employee resulting from a negative background investigation (NAC) or the failure of an employee to observe the security rules shall not be subject to the Disputes clause and shall not result in an increase in the contract amount.

3 SELECTION PROCEDURES

3.1 Technical Evaluation: There will be an evaluation of technical proposals for conformance with the minimum RFP criteria to determine if the proposal is technically acceptable. While there is intent to keep the Offeror’s pre-award proposal effort to a minimum, proposals must provide adequate detail for evaluators to determine if the proposal is technically acceptable.

3.2 There will be an evaluation of all technical proposals by a Source Selection Evaluation Board (SSEB).

The SSEB’s duty is the assignment of a fair, unbiased technical rating for each proposal based solely on the merits of the proposal. Proposals that do not conform to the terms and conditions contained in the RFP or those that include stipulations or qualifying conditions unacceptable to the Government are not eligible for award.

There will be no consideration of pricing data during the technical evaluation.

3.3 Selection without Discussions: It is the intent of the Government to make selections based upon initial offers, without further discussions or additional information. Therefore, submit your proposal on the most favorable terms from a price and technical standpoint. Do not assume you will have an opportunity to clarify, discuss or revise your proposal. If selections are not possible from initial offers, discussions will be conducted as follows:

3.4 Competitive Range: The Contracting Officer may establish a competitive range comprised of all of the highest rated technical proposals. The range may be further reduced for purposes of efficiency, i.e., the Contracting Officer determines that the number of most highly rated proposals that might otherwise be included in the competitive range exceeds the number at which an efficient competition can be conducted.

3.5 Discussions: The Government intends to make a selection without discussions. However, there may be written or oral (i.e., telephonic) discussions with all Offerors in the competitive range. As a result, Offerors may be asked to revise their initial offers. If an Offeror's proposal is eliminated or otherwise removed from the competitive range during discussions, further revisions to that Offeror's proposal will neither be accepted nor considered.

Discussions will culminate in a request for Final Proposal Revisions, the date and time of which will be common to all Offerors.

3.6 After discussions and the subsequent receipt of final proposal revisions, the SSEB will evaluate supplemental information provided by offers, adjust previously assigned technical ratings, and provide a recommendation to the Contracting Officer. The Contracting Officer will consider the SSEB’s findings and perform a best- value analysis.

4 DEBRIEFINGS

Post-award: In accordance with FAR 15.506, Unsuccessful Offerors may request a post-award debriefing within three (3) days after the date on which the Offeror received notification of contract award. There will be no point-by-point comparisons with other Offerors’ proposals and debriefings will not reveal any information that is not releasable under the Freedom of Information Act (FOIA).

5 EVALUATION CRITERIA

5.1 Factor 1 will be evaluated using a Combined Technical/Risk Rating. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining technical ratings. Combined technical/risk evaluations shall utilize the combined technical/risk ratings shown below:

Combined Technical/Risk Ratings Method

Color Rating Description

Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.

5.2 Factor 2, will be evaluated using the Past Performance Relevancy Ratings and the Performance Confidence Assessments shown below:

Past Performance Relevancy Ratings Adjectival Rating Description Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Performance Confidence Assessments Rating Method

Adjectival Rating Description

Substantial Confidence Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Small Business Rating Method Small Business Acceptable/Unacceptable Ratings

Adjectival Rating Description

Acceptable Proposal indicates an adequate approach and understanding of small business objectives.

Unacceptable Proposal does not meet small business objectives.

5.3 The Offeror’s conformance with the specified format and submission requirements will be considered during the technical evaluation. Material omission(s) may cause the technical proposal to be rejected as unacceptable.

5.4 The Offeror’s adherence to prescribed page and formatting limitations prescribed will be strictly adhered to and enforced. Information submitted which exceeds the specified limit will NOT be evaluated. For example, the Government will not evaluate excess information. If four pages are submitted in response to an item with a three page limitation, the information of the fourth page will not be evaluated.

5.5 Proposals will be reviewed for compliance with the technical specifications. Non-compliance with the technical specifications will be considered a deficiency and an Unacceptable rating will be assigned.

5.6 Order of Importance

This is a Best Value solicitation. During evaluation, Factor 1 Technical Capability and Factor 2- Past Performance, Factor 4- Small Business Participation and Factor 5 Small Business Utilization when combined are significantly more important than price. Factor 1-Technical Capability will be considered of higher importance than Factor 2- Past Performance. Factor 2 will be considered of higher importance than Factor 4- Small Business Participation and Factor 5- Small Business Utilization, which are equal. The Past performance, Small Business Participation and Small Business Utilization Factors, when combined, are more important than the cost/ price factor. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factor (to include all subfactors).

5.6.1 Factors and Subfactors to be evaluated.

FACTOR 1: Technical Capability (Experience and Organization) SUBFACTOR 1: Relevant Experience in Key Construction Areas SUBFACTOR 2: Technical Approach Summary SUBFACTOR 3: Proposed Contract Duration and Preliminary Schedule

SUBFACTOR 4: Qualification of Key Team Members

All subfactors are equal.

FACTOR 2: Past Performance: Each Offeror’s past performance will be reviewed to determine relevancy and confidence assessment.

FACTOR 3: Price and Pro Forma Information: The resulting award will be a Firm Fixed Price type contract. A Bid Bond required.

Factor 4: Small Business Participation: The extent of Small Business Participation will be evaluated for unrestricted acquisitions. This solicitation is solicited as unrestricted.

Factor 5: Small Business Utilization: Past Performance of Utilization of small Business Concerns.

Subcontracting Plan is required for large businesses only.

6 LIST OF EVALUATION FACTORS, SUB-FACTORS AND SPECIFIC TECHNICAL

EVALUATION CRITERIA

6.1 FACTOR 1: TECHNICAL CAPABILITY (EXPERIENCE AND ORGANIZATION)

The Experience and Organization evaluation will consider such things as an Offeror’s previous relevant experience with similar projects, the qualifications and organization of key team members, and other considerations as described in the sub-factors and elements. If the Offeror does not assume all roles in this contract, then the Offeror must clearly demonstrate that its major subcontractors have the relevant technical experience for the role they are assuming of the scope and complexity required in the Specifications. The sub-factors are described below:

6.1.1 FACTOR 1, SUBFACTOR 1: RELEVANT EXPERIENCE IN KEY

CONSTRUCTION AREAS

-.1 Submittal for Evaluation:

If the prime contractor proposes self-performing the onsite construction, ensure the proposal is clear which work the Offeror will be performing. If the prime contractor proposes to subcontract some or all of the onsite construction the Offerer must submit a Letter of Commitment from the subcontractor with the proposal. If the prime contractor proposes to use a subcontractor for the steel fabrication, the Offerer must submit relevant past experience working with the subcontractor that demonstrates successful completion of a similar project in size and complexity.

The Offeror shall demonstrate relevant experience by providing project examples of relevant work performed in the key construction areas. Submit projects that are at least 50% construction progress completed or completed and turned over no longer than ten (10) years preceding the date of this Solicitation. Submitted projects must have been performed by the Offeror as either the prime contractor or major subcontractor to be considered relevant. Any project that was less than $1,500,000 will not be considered relevant. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer or by the team member. Limit each project description to 1 page.

An Offeror shall provide evidence of experience on at least three but no more than five construction projects performed in the United States. The submitted projects must demonstrate relevant work experience in the following key areas:

1. The Offeror’s ability to develop and adhere to a detailed construction sequencing schedule.

2. The Offeror’s and Steel Fabrication subcontractor’s previous work experience with fracture critical welding in conformance with American Welding Society (AWS) D1.5.

3. The Offeror’s previous work experience with AISC certified steel fabricators.

4. The Offeror’s previous work experience with working in sub-zero temperatures.

5. The Offeror’s previous work in a fully operational facility with adjacent traffic (auto or ship).

6. The Offeror’s previous work in existing lock facilities, specifically jacking/lifting lock gates.

7. The Offeror’s previous work involving working with a dive team.

In addition to the project examples, the Offeror may provide a supplemental narrative (not project lists), not to exceed two pages, explaining how any corporate experience that is not directly related to the specific projects above is applicable to this project and how the Government will benefit.

The above information is limited to projects that are well underway or that have been completed and turned over no longer than the past ten years preceding the date of this solicitation.

The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing the Government Contractor Performance Assessment Reporting System (CPARS), or other Government appraisal systems or to interview owners or references. The Government may check any or all cited references to verify supplied information.

The contractor shall also provide a copy of the steel fabricator subcontractor’s current certification that they meet AISC Certification, Certified Bridge Fabricator - Advanced (ABR).

-.2 Evaluation Criteria The Government will evaluate whether the proposal demonstrates relevant experience performed in all of the key construction areas, as evidenced in at least three projects but no more than five completed by the prime contractor, within the last ten years or currently underway and at least 50 percent complete. Projects submitted by the Offeror must clearly identify which of the key construction areas are represented in the work; a minimum of five (5) out of the seven (7) construction areas described above must be demonstrated in each of the submitted projects. Additionally, areas 1 through 4 must be demonstrated in the combined submitted projects. The projects must be of similar scope to this project and be valued at least $1,500,000.

Proposals where a contractor has two or more projects where each project demonstrates experience in ALL seven (7) key construction areas will also be considered a strength in the proposal.

Proposals where the steel fabricator subcontractor’s certification does not meet AISC Certification, Certified Bridge Fabricator - Advanced (ABR) or if the certification has expired will be removed from consideration.

6.1.2 FACTOR 1, SUBFACTOR 2: TECHNICAL APPROACH SUMMARY

-.1 Submittal for Evaluation The Offeror shall submit a narrative (not to exceed two pages) describing the overall technical approach to the contract work. The narrative shall include the following:

1) Gate jacking/shoring/diving procedure. Procedure shall include sequence of work and all shoring work necessary to support the lock gates during construction.

2) Work processes description and how work will prevent impacts to all lock operations.

3) Describe how divers plan to enter the water, depth of the deepest dive and a list of dive equipment.

-.2 Evaluation Criteria

1) A narrative that is realistic and demonstrates an understanding of the work requirements, reduces risk to lock gate damage, reduces the risk of diving operations by eliminating decompression dives and having medical treatment equipment on site and reduces interruptions of lock operations will be considered a strength.

6.1.3 FACTOR 1, SUBFACTOR 3: PROPOSED CONTRACT DURATION AND

PROPOSED SCHEDULE

-.1 Submittal for Evaluation Submit a proposed summary level schedule for construction. Schedules shall consist of a GANTT Chart on a single American National Standard Institute (ANSI) D sheet. Font size shall be a minimum of 8 and legible. The proposed schedule will, after contract award, be replaced with a final schedule as required by Section 01 32 01.00 10 Project Schedule. However, the activities listed as binding below are required to stay as proposed. The schedules shall be task oriented, indicating the number of calendar days, after Notice to Proceed, by which milestones are to be achieved. Offeror may use a critical path or other method of his choice; however, schedules shall be graphically represented. The proposed project schedule shall reflect the proposed contract duration. The proposed schedule shall include at a minimum the following construction activities:

Contract Award Date Notice To Proceed Work plan complete and approved Mobilization (Describe equipment) Shop Drawings Submitted and Approved Steel Anchorage Frames Fabrication Complete Initial Concrete Demolition Complete New Anchor Frames Installed Work on the Final Installation of Lock Anchorages Permitted (17 January 2017– this is a binding date) Final Existing Anchorage Demolition Complete Pin Plate Installation Complete and Control Dimensions Submitted Concrete Placement Complete Lever Arm and Link Bars Installed Anchorages completed, Miter Gate Tested, and Accepted by the Government (19 March

2017 – this is a binding date) Demobilization Contract Completion Date

It is the Offeror’s responsibility to identify the sequencing of the above listed construction activities. The construction schedule shall be of sufficient detail to identify by trade the work that is to be completed along with the duration of the above listed activities.

Constraints: Offeror must demonstrate the capability and flexibility to plan and schedule the complete project to meet the proposed contract completion period. Clearly identify any constraints on the schedules presented (e.g., labor or material availability, weather, etc.).

Clearly indicate the anticipated overall critical path activities on the schedule.

Offerer shall also provide a 1 page narrative outlining any scheduling assumptions, risks, logistical challenges, or any other information that the Offeror deems to be critical to understanding the proposed schedule.
