About this file
This is a Vendor Affidavit regarding the Use of Coercion for Labor and Services required by Hillsborough County Public Schools (HCPS) in Florida pursuant to Section 787.06(13) of the Florida Statutes. The affidavit must be completed and signed by an authorized officer or representative of any nongovernmental contractor executing, renewing, or extending a contract with HCPS. The affidavit applies to the Auction Services Surplus Vehicles procurement (ITB 26056), with sealed bids due Wednesday, April 15, 2026, at 5:00 PM ET through www.myvendorlink.com. The selected contractor must possess a valid State of Florida Independent Motor Vehicle Dealer License and provide comprehensive auction services for surplus and obsolete district property including vehicles, heavy equipment, and other tangible assets. The contract term begins upon School Board approval and automatically renews for up to four additional one-year periods, contingent on appropriations, contractor performance, continued need, and mutual agreement.
By executing this affidavit under penalty of perjury, the contractor certifies that it does not engage in human trafficking or coercion for labor and services, including use of physical force, unlawful restraint or confinement, exploitative debt practices, document confiscation, financial coercion, fraud, or provision of controlled substances for exploitation purposes. This compliance requirement is mandatory for all proposers and represents a certification of lawful business practices. No specific incumbent contractor is identified, and compensation is structured as percentage-based commission fees determined by vendor pricing submissions on tiered brackets based on sale prices. The contractor shall charge no markup on transportation costs or pass-through expenses, with actual costs deducted from sales proceeds. The procurement incorporates compliance requirements under 2 CFR Part 200 federal funding regulations and requires submission of multiple certifications and affidavits prior to contract execution.
