About this file
This is a Sales and Use Tax Construction Contract Exemption Certificate issued by the State of Ohio for the City of Toledo's 2026 GCCS Construction project at Hoffman Road Landfill. The certificate establishes the framework for tax-exempt purchasing of tangible personal property and building materials to be incorporated into the construction project. The document requires signatures from the owner/contractee (City of Toledo), prime contractor, and all subcontractors, with copies maintained by each party and suppliers. The original certificate must be retained by the prime contractor, and all copies distributed to suppliers must be signed by the contractor or subcontractor making the purchase.
The certificate qualifies various categories of construction for sales and use tax exemption under Ohio Revised Code, including charitable nonprofit facilities, horticulture and livestock structures, sports facilities, hospital facilities, computer data centers, and megaprojects. Additionally, the exemption applies to real property owned or to be owned by the United States government, the State of Ohio, or Ohio political subdivisions, as well as construction contracts with such entities or with tax-exempt organizations. The certificate specifies that all bidders submitting proposals for the 2026 project must include a signed Tax Exemption Certificate with their bid submission through the City of Toledo's PlanetBids portal, along with other required documentation including bid guaranty, preliminary construction schedule, project references, and equipment and labor rates.
