About this file
This is a Project Labor Agreements Fact Sheet issued by the City of Toledo, Ohio, detailing requirements and procedures for construction projects funded by the municipality. The document applies to all construction projects valued at $100,000 or greater funded by the City of Toledo or other funding sources that do not exclude Project Labor Agreements. All contractors and subcontractors performing construction work on-site or adjacent to worksites must comply with the agreement requirements. Following notification of bid award, a pre-job conference must be held within fifteen days between the successful bidder and the Northwest Ohio Building and Construction Trades Council (NWOBTC). An executed Project Labor Agreement, bearing signatures from the lead contractor and the Executive Secretary of NWOBTC, must be delivered to the Division of Purchases and Supplies within fifteen working days from the pre-job conference. No exemptions from the pre-job meeting exist, even for companies already signatory to collective bargaining agreements.
Project Labor Agreements do not impact the City's Minority Business Enterprise Program requirements or supersede any provisions of the Toledo Municipal Code, including the 15 percent MBE participation goal for construction projects and 21 percent for HUD-assisted projects. Under the agreement, wages and fringe benefits must be paid in accordance with applicable local collective bargaining agreements. The agreement prohibits strikes, lockouts, slowdowns, picketing, and other work stoppages by union members throughout the contract term. Grievance and dispute resolution procedures are detailed in Article VI of the Project Labor Agreement. Manufacturing and fabrication work are excluded from Project Labor Agreement requirements.
