Amendment issued to answer received questions and make the following adjustments to the PWS.
Replace “B-12.2 and B-12.5” in the last sentence of PWS 13.1 with “PWS 12.2, 12.4 and 12.5.”
Add “A copy of all DEMIL and Mutilation Certificates” to PWS 14.3.
Questions & Answers
Q26. Can the government provide the average container weight for each contract CLIN?
A26. No, this information is not available. Please note PWS 38f. “At no time will any single container exceed its intended or rated capacity.”
Q27. What is the difference between CLINS 12 and 13? Are we to assume that CLIN 12 is vehicles that are predominately steel whereas CLIN 13 are vehicles with a high aluminum content such as HUMVEES?
A27. The assumption is partially correct. CLIN 13_B is used for Tracked and/or wheeled Armored vehicles with a high Aluminum content.
Q28. In which CLIN would Tank Tracks be included?
A28. As listed in the Price Schedule - CLIN 0009_B.
Q29. For CLINS 16, 17, and 18, incineration is required. Since potentially contaminated or dangerous incineration residue is a potential liability for government and for the contractor, will the government require end disposal incineration certificates from the incinerating facility?
A29. If this is in reference to ashes disposed from incineration plants after the incineration process is complete, then no. The only incineration plants used under the contract are host nation approved incineration plants for the specific European waste codes.
Q30. For CLINS 16, 17, and 18, will the government require end disposal incineration certificates from the certified incineration facility be provided for each individual container including the end disposal facility weight verification to insure that all materials on these CLINS are properly incinerated rather than disposed of by other means such as landfills?
A30. Incineration certificates are not required for DEMIL A material. The manifest and receipt document with European Waste Code from the disposal facility, including the received weight, is required. Once the material enters the disposal facility’s waste stream, the host nation oversight procedures apply. For DEMIL B material, the certifier and verifier observe the incineration and the DEMIL certificate is completed which replaces the incineration certificate.
Q31. Since the contractor is responsible for loading scrap, will the government have a monitoring and surveillance system and random inspections to insure that all scrap is properly sorted and loaded prior to removal? Will the government require individual container certification from the contractor for each container to assure that the proper content?
A31. Yes, see PWS 44 Government Inspection, particularly (c). No, individual container certifications are not required for each container.
Q32. To assure accuracy of the government scale weights and weight receipts specified in 8.4, will the government require an end processor receipt verification and certification per container to verify container weights?
A32. The material is weighed out on the official government scale or certified scale when it is transported to the treatment facility. At the treatment facility the material is weighed in. Both weight tickets are part of the invoice documentation package in PWS 14.3.
Q33. For CLIN 20, since the contractor will be shredding material offsite, how will the government assure that the material is properly shredded? Is the contractor required to have a certifier onsite at the contractor or subcontractor shredding site for any materials removed under CLIN 20? Will materials removed under CLIN 20 be required to be stored in a secure area until shredded? Will a government verifier be onsite

during shredding?
A33. All CLIN 20 lines are DEMIL required (have a B as the 6th digit). Refer to PWS 12.2 for DEMIL offsite and PWS 12.4 for Transportation. Property removed must be secured during the time at the contractor’s facility. Contractor certifier is required onsite, U.S. Government verifier is also required onsite. Material remains in sealed container, verifier witnesses the seals being broken prior to re-weighing and offloading and stays with the process until mutilation is 100% completed and demil/mutilation certificates are completed.
Q34. For CLIN 21, will the demanufacturing process occur at the government site or at the contractors site?
If at the contractors site, will a contractor certifier and government verifier be required to be onsite during demanufacturing?
A34. The demanufacturing process is completed at the host nation licensed and government approved WEEE treatment plant. CLIN 0021xB is processed under the presence of the certifier and verifier.
Q35. For CLINS 12,13, 20,21 for Level 3 countries, will the contractor be required to have an authorized certifier onsite during removals and disposal in accordance with attachment 7? Will the government have a verifier onsite?
A35. Every time a mutilation/demilitarization material identified with the B as the sixth digit in the CLIN number is processed the contractor provides the certifier and the government provides the verifier for onsite surveillance. This is required for all locations, including Level 3 countries.
Q36. In the case the government utilizes the reverse auction process, will a cost realism analysis be performed to insure the low bidder provides a realistic bid to insure contract performance?
A36. In accordance with FAR 15.404-1, there are many methods of determining price reasonableness. Whether a cost realism analysis will or will not be performed is unknown at this time.
Q37. Is there a statement in the solicitation for being able to choose what we can or cannot entertain to pick up? If we decline to pick up certain type of scrap then who would be your contractor to go to, if not multiple award?
A37. Please see amendment 0001, Question / Answer number 8. It is required to quote all service and materials on the Price Schedule.
Q38. Has the solicitation closing been extended?
A38. This Amendment 0003 extends the solicitation closing to 22 April 2016 at 1500 Local time in Kaiserslautern, Germany. This is equivalent to 0900 Eastern.
Q39. I read that some of the CLINs aren’t allowed to have a negative total unit price. Is that true of all CLINs?
A39. No. Question / Answer 12 from Amendment 0002 is specific to Category 2 CLINs which do not have an EUWID index. It is possible for the total unit price of a Category 1 CLIN to be negative based on the proposed percent return to the Government and the EUWID index price. The unit price in Column E of the Price Schedule for transporting/processing/disposing of the material (PWS 2.3.b.2 and 2.3.b.3) should not have a negative value.

ADDENDUM TO 52.212-04 CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS
FAR 52.212-4(c) - Changes, addendum : In accordance with FAR 52.212-4(c) (1) Changes in the terms and conditions of this basic contract may be made only by written agreement of the parties. Formal written agreement of parties relative to the following terms and conditions is hereby made through contract acceptance or bilateral contract modification, as applicable. This addendum serves as the formal written agreement of parties authorizing revisions to CLIN weights/quantities for task orders issued against the contract. The weight/quantities for CLINs issued on task orders are estimated therefore task order weights/quantities will frequently require adjustment upward or downward to reflect the actual weight/quantities being removed. Services which are not identified by weight may also require modification to ensure actuals are reflected. The revisions will be adjusted for instances where the Government has underestimated or overestimated the quantities/amount of weight that is required to be removed. In instances of decreasing weight/quantity, these decreases are not subject to FAR 52.212-4, termination for convenience coverage.
FAR 52.212-4(g) – Invoice, addendum: The contractor shall submit an invoice within 30 days of each task order completion date. In the possible event that the contractor must submit a check to the Government, the contractor shall still be required to submit an invoice in WAWF for 1 euro and deliver the invoice package with the check within 30 days of the task order completion date.
