Certification of Demilitarization

Description:

A certification statement as shown shall be signed and dated by a DoD contracted person or a Government employee who actually performed or witnessed the DEMIL.

The certificate shall be verified by a technically qualified DoD contracted person or a Government employee who witnessed the DEMIL of the material or inspected the residue. The individual who verifies the DEMIL should generally be at least in the next higher management or technical level to the initial certifying individual and must be a U.S. citizen.

MUTILATION CERTIFICATE

PROCESSING DEMIL / MUTILATION REQUIRED PROPERTY AT CDD KAISERSLAUTERN

For the purpose of this Standard Operating Procedure all coordination with the Contractor are done through the DEMIL Coordinator and COR.

1) Introduction:

a) This Standard Operating Procedure (SOP) is to establish the policy and guidelines for the oversight and management of contractor’s performance on the processes of demilitarization and mutilation. It will also set the guidelines to maintain proper accountability for DEMIL and mutilation required property under the R-2010 contract.

2) References:

3) Definitions:

a) Centralized DEMIL Division (CDD): The branch of a Disposition Services operation with the responsibility and accountability of DEMIL required property.

b) Contracting Officer Representative (COR): Individual designated in accordance with subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the contracting officer to perform specific technical or administrative functions. The CORs will be the contractor's primary points of contact for the duration of this contract. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

c) Distribution Standard System (DSS): The current software application for property accounting in the Disposition Services disposal program.

d) Demilitarization (DEMIL): The act of eliminating the functional capabilities and/or inherent military design features from DoD Personal Property. Methods and degree range from removal and destruction of critical features to total destruction by cutting, crushing, shredding, melting, burning, etc.

e) DEMIL Coordinator: An individual appointed for the oversight of the DEMIL operations.

f) Disposal Turn In Document: The DOD Form 1348-1a used for the standard turn-in of excess/surplus/scrap property.

g) Distribution Branch: The branch of a Disposition Services operation with the responsibility of reutilizing / marketing excess/surplus/scrap property.

h) Mutilation: The act of making material unfit for its originally intended purposes by cutting, tearing, scratching, crushing, breaking, punching, shearing, burning, neutralizing, etc.

i) Property Management Branch (PMB): The branch of a Disposition Services operation with the responsibility of receiving and processing excess/surplus/scrap property other than DEMIL required.

j) Certifier: A qualified DoD contracted person or Government employee (U.S. or non-US), and actually performed or witnessed the required DEMIL. (Permanent waiver to allow contract labor to certify, and actually perform/supervise the required DEMIL/Mutilation/Demanufacturing).

k) Verifier: A technically qualified DoD contracted person or Government employee (US Citizen) should be the next higher management or technical level, actually witnessed the DEMIL of the material or inspected the residue and must count the items to be demilitarized before DEMIL begins (DLA Disposition services only).

4) Administration:

a) The CDD Demil Coordinator will review, export and print the Ultimate Disposal Work Bench (UDWB) list of property available for demilitarization and/or mutilation on a weekly basis to include:

i) Items available for demilitarization, DSS Status – UDPRA listed on the Ultimate Disposal Work Bench (UDWB).

ii) Items available for mutilation, DSS Status – UDPRA listed on the Ultimate Disposal Work Bench (UDWB).

b) The report will be exported into an Excel spreadsheet for processing.

c) Copies of this report will be distributed as follows:

i) One copy of the demilitarization and/or mutilation required items will be provided to the Contractor’s representative for review and workload evaluation.

d) The UDWB in DSS will be checked daily for property available for DEMIL or downgrade.

5) Mutilation Process:

a) CDD Demil Coordinator will review property available for mutilation listing with contractor’s representative and discuss method and degree of mutilation required for each item.

b) A plan of action will be developed by the contractor’s representative to accomplish the required mutilation. (Onsite mutilation of property or offsite to an approved R2010 facility) The plan will be provided to the CDD DEMIL Coordinator for review and approval.

· Mutilation Onsite - Contractor’s employees will proceed with the mutilation of each item in accordance with instructions provided.

· Mutilation Offsite – Contractor’s representative will coordinate the offsite mutilation of property through the COR. Scheduling of loading, sealing and delivery will be coordinated with CDD DEMIL Coordinator. Contractor employee (R2010 facility) will perform mutilation in accordance with the instructions provided.

c) Contractor’s employees will proceed with the mutilation of each item in accordance with instructions provided. After mutilation of each item (multiple units) is accomplished, the residue will be inspected by the verifier.

d) Once the process has been verified, the mutilation certificate will be executed by both, contractor’s employee as certifier and the mutilation verifier.

e) Contractor’s employees will sort the residual material by CLIN into hoppers provided by the Contractor.

f) The CDD DEMIL Coordinator will complete the transaction by processing the mutilation certificate into the DSS account within 24 hours.

6) Demilitarization Process:

a) CDD Demil Coordinator will review property available for demilitarization listing with contractor’s representative and discuss method and degree of demilitarization required for each item.

b) A plan of action will be developed by the contractor’s representative to accomplish the required demilitarization. (Onsite DEMIL of property or offsite to an approved R2010 facility) The plan will be provided to the CDD DEMIL Coordinator for review and approval.

· DEMIL Onsite - Contractor’s employees will proceed with the demilitarization of each item in accordance with instructions provided.

· DEMIL Offsite – Contractor’s representative will coordinate the offsite demilitarization of property through the COR. Scheduling of loading, sealing and delivery will be coordinated with CDD DEMIL Coordinator. Contractor employee (R2010 facility) will perform demilitarization in accordance with the instructions provided.

c) Once the demilitarization process has been verified, the demilitarization certificate will be executed by both, contractor’s employee as certifier and the demilitarization verifier.

d) Government employee acting as verifier will ensure that the item is demilitarized in accordance with applicable regulations and instructions given.

e) Contractor employee will sort the residual material by CLIN into hoppers provided by the contractor, weight and transport the scrap material into the R-2010 area and provide CLIN, SCL code and weight to the DEMIL verifier. Residual material not identifiable to a CLIN will be moved to the R-2010 process area for expedited removal and disposal by the contractor.

f) DEMIL verifier will complete the transaction by processing the DEMIL Certificate into the DSS account within 24 hours.

7) Security:

a) Due to the sensitivity of DEMIL and mutilation required property, items will be secured by the CDD if the mutilation or demilitarization process cannot be completed within that days’ workload.

b) Accountability of all items will be maintained at all times until the verification process has been completed and the residue has been transferred to the Contractors yard and placed in the appropriate CLIN container.

DEMIL SURVEILLANCE PLAN

FIRED CARTRIDGE CASINGS (Aluminum, Brass and Steel)

1. References:

a. DoD 4160.21-M-1, Appendix IV, Category III, Para C

b. CLIN #0005 (Aluminum), CLIN #0008 (Brass) and CLIN #0010 (Ferrous Metals) Recycling 2010 DSD- Europe, SP4520-xx-x-xxxx

2. Property Location: Various Military Installations throughout DSD-Europe Area of Responsibility.

3. Method and Degree of DEMILITARIZATION:

a. DEMIL off Government premises only.

b. DEMIL will be accomplished by:

(1) Melting by processing through a brass mill, or smelting plant or popping plant.

(2). Crushing, deforming, cutting or otherwise mutilation the property so as to completely destroy its lethal purpose.

(3). Direct shipment of property will be in sealed containers to provide intransit security from the government installation to the brass mill, plant or equipment- crushing site.

c. Contractor must provide written notification to the Contracting Officer stating which method listed in paragraph 5a or 5b will be used to DEMIL property prior to removal.

d. On direct mill shipments, the contractor further agree to begin DEMIL within 48 hours of the receipt of each shipment of fired cartridge casings.

4. Equipment required:

a. Mill Smelter

b. Shear

c. Metal Baling Press

d. Popping Plant

5. DEMIL time frame: 15 Calendar days from time of removal.

6. DEMIL Surveillance will be conducted by an approved DEMIL certifier and verifier appointed in writing by the Recycling 2010 Program Manager. The individuals must possess the qualifications required to monitor DEMIL actions IAW DoD 4160.21-M-1. Contractor is responsible for DEMIL certifications.

Attachment 7b

(Fired Cartridge Casings, Aluminum Brass and Steel)

Surveillance Plan:

1. Certifier/Verifier - Discuss method, and degree of DEMIL and work plan with contractor.

2. Contractor - Move property to DEMIL work site.

DRMO Personnel/Property Disposal Agent - must ensure proper loading and weighing methods are used. Ensure the vehicles used to transport are closed conveyance and sealed with the proper U.S. seals.

3. Certifier/Verifier Contractor - When property arrives at DEMIL work site ensure all seals are checked and intact, that the vehicle is weighed properly, unloaded and weighed empty. Get a copy of the contractor weight ticket and compare with the weight ticket from the point of origin. Ensure security of fired cartridge casings is kept at all times.

4. Contractor - Begin DEMIL of Fired Cartridge Casings by the approved DEMIL method outlined in this plan.

5. Certifier/Verifier - Survey property being demilitarized, and ensure compliance with procedures outlined in this plan.

6. Certifier/Verifier - Contractor - Repeat steps 3 through 6 until DEMIL is completed.

7. Verifier/Certifier - Examine DEMIL residue for proper DEMIL of material, then sign DEMIL certificates.

Attachment 1 DoD4160.21-M-1 Chapter II, Paragraph A7 CERTIFICATION OF DEMILITARIZATION.

1. A certificate as quoted below will be signed and dated by a technically qualified Contractor Representative, as designated by the Recycling 2010 Program Manager, who actually witnessed the demilitarization of the material. In cases where the witnessing of demilitarization would unnecessarily subject the witness to hazardous conditions or when the demilitarized material can be laid out to clearly display the residue from each item demilitarized. Demilitarization may be certified through inspection of the residue. The certificate will be executed for all items demilitarized and will read as follows:

"I certify that (identify items) were demilitarized in accordance with (cite specific instructions (Appendix and Category) that were complied with in the DoD 4160.21-M-1 and other applicable regulations)."

2. The certificate must be countersigned by a technically qualified U.S. Government representative (United States citizen), designated by the Recycling 2010 Program Manager, who actually witnessed the demilitarization of the material or inspected the residue as provided above.

3. The certification will include the printed or typed name of the signatories.

4. The DRMO Chief, Property Administrator, or Accountable Property Officer, as appropriate, will place the demilitarization certificate in the applicable source document file for a period of three years. The Recycling 2010 Program Manager/Contracting Officer will ensure that a copy of the certificate is placed in the appropriate contract administration file and retained throughout the life of the contract.

(Aluminum or Steel Road Wheels with Rubber Tread and Sprockets)

1. References:

a. DoD 4160.21-M-1, Appendix 4, Category VII

b. DoD 4160.21-M-1, Chapter II

c. DRMS-I 4160.14 Section 2 Chapter 4 d CLIN #0005 (Aluminum) CLIN #0010 (Heavy Ferrous Metal) Recycling 2010 DSD- Europe, SP4520-xx-x-xxxx

6. 2. Property Location: Various Military Installations throughout DSD-Europe Area of Responsibility.

3. Requirements:

1. DEMIL off Government premises. DEMIL on Government premises will only be authorized when there is no requirement for the U.S. Government to obtain permits, and with prior approval of the Contracting Officer.

2. DEMIL accomplished by:

a. Preferred method: Incineration, or shredding

b. Alternate method: Torch Cutting

3. Minimum Equipment Required:

a. Shear

b. Torch cutter

c. Personal Protective Safety Equipment

4. Demil Time Frame: Within a reasonable amount of time, not to exceed 15 calendar days from date of removal from Military Installations. If DEMIL is performed on Government premises the contractor shall complete DEMIL within 15 calendar days from the notice to proceed from the Contracting Officer.

5. Special requirements to transport subject material.

a. Contractor is responsible for obtaining, and providing all required permits necessary for transportation and processing.

b. Contractor is responsible for ensuring accountability, and security of subject material, until such time as DEMIL is complete.

6. DEMIL surveillance will be conducted by an approved DEMIL verifier and certifier appointed in writing. The individuals must possess the qualifications required to monitor DEMIL IAW DoD 4160.21-M-1 Chapter II, Paragraph A-7. The contractor will be responsible for DEMIL certification.

A. Surveillance Plan:

1. Certifier/Verifier - Discuss method, and degree of DEMIL and work plan with contractor.

2. Contractor - Move property to DEMIL work site.

3. Certifier/Verifier Contractor - When property arrives at DEMIL work site ensure security of road wheels is kept at all times.

4. Contractor - Begin DEMIL of Road Wheels/Sprockets by the approved DEMIL method outlined in this plan.

5. Certifier/Verifier - Survey property being demilitarized, and ensure compliance with procedures outlined in this plan.

6. Certifier/Verifier - Contractor - Repeat steps 3 through 6 until DEMIL is completed.

7. Verifier/Certifier - Examine DEMIL residue for proper DEMIL of material, then sign DEMIL certificates.

B. Method and degree of demilitarization;

Refer to Attachment 3:

NOTE: The item mentioned below is illustrated in Attachment 1.

1. Road Wheels: Complete Destruction by smelter, shredding, or torch cutting.

Note per DRMS-I 4160.14 Section 2 Chapter 4 ParagraphC4.10 Figure 3:

· The use of precision torch fixtures, precision cutting saws, or precision tools of any kind to minimize mutilation is forbidden.

· All torch cutting will displace at a minimum, ½ inch of metal.

Attachment 1 (Acceptable Torch Cut)

Attachment 2 DoD 4160.21-M-1 Chapter II, Paragraph A7 CERTIFICATION OF DEMILITARIZATION.

1. A certificate as quoted below will be signed and dated by a technically qualified Contractor Representative, as designated by the Recycling 2010 Program Manager, who actually witnessed the demilitarization of the material. Attachment 3 DoD 4160.21-M-1 Appendix 4

CATEGORY VII. TANKS AND MILITARY VEHICLES

(CATEGORY VII - U.S. MUNITIONS LIST).

A. The following items are designated as MLI and the DoD Demilitarization Program Office has determined them to be of a critical and/or sensitive nature that requires total or key point destruction. These items and their key points are normally assigned a Demilitarization Code "E":

Tank track and track components including, but not limited to road wheels, idler arms, sprockets, final drives, etc. (Rubber track pads are not included.) These items require total destruction overseas or prior to export from the U.S. only.

Technical data relating to the design, engineering, development, processing, use, operation, overhaul, repair, testing, maintenance, modification or reconstruction of any item in paragraphs A through C, this Category (total destruction by shredding, pulping or burning).

B. The following items are designated as MLI and do not require demilitarization. They are normally assigned a Demilitarization Code "B".

Rubber track pads.

Specifically designed or modified components, parts, accessories, attachments and associated equipment not otherwise enumerated above including but not limited to military bridging equipment and deep water fording kits.

All other technical data and defense services directly related to any defense article enumerated this Category.

(Steel Tank Track with Rubber Pads)

1. References:

a. DoD 4160.21-M-1, Appendix 4, Category VII

12. DEMIL surveillance will be conducted by an approved DEMIL verifier and certifier appointed in writing. These individuals will possess the qualifications required to monitor DEMIL according to DoD 4160.21-M-1 Chapter II, Paragraph A-7. A minimum of two contractors per site performing the DEMIL will be trained for certifying and appointed by the Recycling 2010 Program Manager. The contractor is responsible for DEMIL certification. (See attachment 2)

12. Certifier/Verifier - Survey property being demilitarized, and ensure compliance with procedures outlined in this plan.

13. Certifier/Verifier - Repeat steps 3 through 6 until DEMIL is completed.

14. Certifier/Verifier - Examine DEMIL residue for proper DEMIL of material, then sign DEMIL certificates.

D. Method and degree of demilitarization;

2. Tank Tracks: Complete Destruction by smelter, shredder, or torch cutting.

"I certify that (identify items) were demilitarized in accordance with (cite specific instructions (Appendix and Category) that were complied with in the DoD 4160.21-M-1, Appendix 4, Category VII and waiver conditions as stated in OASD memorandum, 19 Oct 1988, subject: Modified Demil Surveillance ."

2. The certificate must be countersigned by a technically qualified U.S. Government representative (United States citizen), designated by the Recycling 2010 Program Manager, who actually witnessed the demilitarization of at least 10% of the material or inspected a minimum of 10% of the residue as provided above.

3. The US Government reserves the right to verify the demilitarization process or the demilitarization residue at any time during the process and / or increase the % of surveillance if required.

4. The certification will include the printed or typed name of the signatories.

5. The DRMO Chief, Property Administrator, or Accountable Property Officer, as appropriate, will place the demilitarization certificate in the applicable source document file for a period of three years. The Recycling 2010 Program Manager/Contracting Officer will ensure that a copy of the certificate is placed in the appropriate contract administration file and retained throughout the life of the contract.

CATEGORY VII. TANKS AND MILITARY VEHICLES

(CATEGORY VII - U.S. MUNITIONS LIST).

C. The following items are designated as MLI and the DoD Demilitarization Program Office has determined them to be of a critical and/or sensitive nature that requires total or key point destruction. These items and their key points are normally assigned a Demilitarization Code "E":

Tank track and track components including, but not limited to road wheels, idler arms, sprockets, final drives, etc. (Rubber track pads are not included.) These items require total destruction overseas or prior to export from the U.S. only.

Technical data relating to the design, engineering, development, processing, use, operation, overhaul, repair, testing, maintenance, modification or reconstruction of any item in paragraphs A through C, this Category (total destruction by shredding, pulping or burning).

D. The following items are designated as MLI and do not require demilitarization. They are normally assigned a Demilitarization Code "B".

Rubber track pads.

Specifically designed or modified components, parts, accessories, attachments and associated equipment not otherwise enumerated above including but not limited to military bridging equipment and deep water fording kits.

All other technical data and defense services directly related to any defense article enumerated this Category.
