About this file

This amendment to a solicitation provides clarification regarding a Northeastern Regional Hazardous Waste Incineration contract. The purpose of the contract is to allow the Defense Logistics Agency to dispose of hazardous wastes requiring incineration or thermal treatment when other disposal options are not available, to ensure generators do not exceed storage limits. Work will involve removing, transporting, incinerating, and disposing of RCRA, non-RCRA, PCB and other wastes from Department of Defense and Coast Guard sites in 19 eastern states. The amendment extends the response deadline by one week to December 6th, 2022, and answers questions from offerors clarifying contract requirements such as units of measure for certain waste types and explaining the historical turn-in data provided.

Amendment 0005:

The purpose of Amendment 0005 is to answer questions and notify offerors that there is a one week extension on the closing date of the solicitation as requested. The new closing date of this solicitation is December 6, 2022 at 3:00 PM EST.

Questions followed by answers in red.

1. The following ‘C7” suffixed CLINs FL99C7, NR78C7, RX96C7, RX98C7, TX98C7, TX99C7, have the U/M as per “LB”. This offeror is requesting that these line item be priced by the container size, i.e. CLIN suffixes C1, C2, C3, C4, C5, C6 similar to the other hazardous CLINs.

It’s the Generator’s request to have the U/M as per “LB” for Demil items FL99C7, NR78C7, RX96C7, RX98C7, TX98C7, TX99C7, it makes it easier for their internal tracking processes.

2. CLIN FL03xx - Should change to NEW Description in MasterCLINCatalog, Date of Publication: May 13, 2022, stating… "No isocyanates (See FL16). Use LP03 for loose packs."; Add CLIN FL16xx to Price Schedule.

Answer will be forthcoming.

3. Please explain the 18-Month Turn-In Hx information. Is this historical data that we may likely see, or is this actual material that is currently in storage that will be picked up on this contract?

It’s the based on the historical data. It’s what the awarded Contractor will likely see turned in for disposal.

4. Will the Lab Packs / Loose Pack CLINs already be prepackaged? If so, we will require a complete container inventory report to be provided at time of TO. How will this be accomplished?

No, Generators are not allowed to lab pack, and it will the responsibility of the Contractor. The Contractor is compensated by using the appropriate CLINs ranging from 6311AA to 6311EE.

5. Given that incineration capacity is in high demand, award should be based on Companies who own incineration assets or can demonstrate dedicated capacity under contract at a 3rd party Incinerator. Please see ADDENDA TO FAR 52.212-2 EVALUATION: Management Plan Evaluation

6. We have concerns that this HW Incineration contract will be used by Contractors to rid itself of the difficult / high cost incineration items issued on its TO’s. How will a Contractor on an existing HW contract with DLA be held accountable so that this does not happen?

The Incineration contract will be used by the Generators to turn in all items that require incineration to alleviate the backlog and stay compliant with state regulations.

Due to the above need for clarifications, and with the upcoming Thanksgiving Holiday, this offeror is respectively requesting a minimum one (1) week extension in order to offer our best possible pricing. As stated above this solicitation has been extended one week and has a new closing date of December 6, 2022 at 3:00 PM EST.

More Questions:

· Why is this contract out to bid? Have the base and all option years expired?

The contract is out to bid so that the Generators can dispose of HW that requires incineration.

· Is this a multi-vendor award contract?

No

SP4500-23-R-0002

· In order to properly evaluate performance guarantee, is this contract used in the event that the prime disposal contractor is not able to service a task order or is to replace the existing prime?

This contract will allow the Generators to dispose of current backlog of HW requiring incineration and a means of disposal for future HW turned in requiring incineration.

· Considering the capacity issues within the incineration industry, if there is a delay of service 30-60 days by the awarded vendor, under these circumstances, what would be the best course of action?

The Contractor who wins the award should expect to see Task Orders cut immediately and should be prepared to meet the timeframe outlined in the PWS.

· Can the DOD please provide a 1- week extension?

· As stated above this solicitation has been extended one week and has a new closing date of December 6, 2022

· at 3:00 PM EST.
