Upon request of Forest Service, Contractor must arrange with CO for Forest Service to inspect each piece of off-road equipment prior to it being placed into service. If Contractor desires to clean off-road equipment on National Forest land, such as at the end of a project or prior to moving to a new unit that is free from noxious weeds, Contractor and Forest Service CO shall agree on methods of cleaning, locations for the cleaning, and control of off-site impacts, if any. New infestations of noxious weeds, of concern to Forest Service and identified by either Contractor or Forest Service, within the project area or on the haul route, shall be promptly reported to the other party.

The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.
SUPERINTENDENCE BY CONTRACTOR
The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the English language.
INCIDENTAL PAY ITEMS
The intent of the contract is to provide for the complete construction of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items.
All other work and materials will be considered as incidental to and included in the payment for items shown.
WITH DRAWINGS AND SPECIFICATIONS
Rock and mineral soil excavated within the normal excavation shall be conserved and used as needed. No Government designated rock source areas are provided for this contract.
Borrow material may be obtained on-site, but only at the approval of the Contracting Officer.
Unless designated in the contract, disposal areas shall be designated by the Contracting Officer prior to placement of any material at the designated staging areas shown on the plans and are for clearing, grubbing and excavation materials only. No man-made products shall be placed in designated disposal areas unless approved in advance by the Contracting Officer.
SALVAGE RIGHTS
No Contractor salvage rights exist under the contract unless specifically provided elsewhere herein.
LEAD CONTAINMENT & REMOVAL
The contractor is notified of the presence of red lead paint on the existing truss bridge structure.
Contractor is fully responsible for plans, preparations, and implementation to address proper containment of the lead paint during demolition and removal operations of the existing bridge. No lead paint will be allowed to enter the Pedlar River or surroundings. The contractor shall be required to submit a lead containment plan to the Contracting Officer for approval during the pre-work meeting and at least 10 days prior to the start of demolition operations of the existing bridge. The plan preparers shall certify that the plan is in compliance with all applicable federal, state, and local laws. The CO shall review and provide feedback or approval of the plan within 5 days of receipt of the lead containment plan.
CAMPING PERMIT COMPLIANCE
Contractor shall comply with all terms and conditions of any camping permit issued to allow use of premises. Any non-compliance will result in suspension of work until compliance is achieved.
BLASTING
Blasting shall NOT be allowed at any time during the duration of this project.
AIRCRAFT USE
The Contractor shall advise the Contracting Officer of any intent to utilize aircraft in the performance of this contract at least 30 calendar days prior to planned use. Special requirements will apply to all work associated with aircraft, including compliance with a Project Aviation Safety Plan and current Forest Service guidelines for aviation management.
LANDSCAPE PRESERVATION AND HAZARDOUS MATERIALS
(a) The Contractor shall confine operations to within the clearing limits or other areas designated in the contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer.
The Contractor shall make all reasonable attempts to preserve the scenic and natural environment within and adjacent to this construction project.
(b) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, lakes, reservoirs, and other surface waters.
(1) Wash water or waste from concrete, aggregate or other operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.
(2) Mechanized equipment shall not be operated in live streams without written approval by the Contracting Officer. If necessitated by contractor’s operational procedures, the contractor shall be responsible to obtain necessary permits from agencies with jurisdiction, including the US Army Corp of Engineers, for any extensive work by equipment or other structures in the Pedlar River.
(c) No petroleum products or other hazardous substances shall be released on or into land or rivers, streams, impoundments or other waters, or into natural or manmade channels leading thereto or therefrom. Servicing of all equipment shall be done only in the areas approved by the Contracting Officer. The Contractor shall transport off government lands all waste oil, vehicle oil filters (drained of free-flowing oil), and oily rags and shall dispose of such materials in accordance with applicable State and Federal regulations. See H-11 Spill Plan for additional details.
ARCHAEOLOGICAL AND HISTORIC SITES
Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433)--will be identified for the contractor prior to the commencement of work. The Forest Service shall unilaterally modify, or cancel, this contract to protect an area, object of antiquity, artifact or similar object which is, or may be, entitled to protection under these Acts regardless of when the area, object or artifact is discovered or identified. Discovery of such areas or objects by either party shall be promptly reported to the other party.
Contractor shall protect all known and identified historic or prehistoric sites, buildings, objects and properties related to American history, architecture, archaeology and culture against destructions, obliteration, removal or damage during Contractor’s Operations. In accordance with 36 CFR 296.14(c), the Contractor shall bear costs of restoration, provided that such payment shall not relieve the Contractor from civil or criminal remedies otherwise provided by law.
Wheeled or track-laying equipment shall not be operated within such areas, except on roads.
Unless agreed otherwise, trees will not be felled into such areas.
PROTECTION OF HABITAT OF ENDANGERED, THREATENED AND
SENSITIVE SPECIES
Location of areas needing special measures for protection of plants or animals listed as threatened or endangered under the Endangered Species Act of 1973, as amended, or as sensitive by the Regional Forester under authority of FSM 2670, will be identified on the ground by FS staff.
At least one tree species (Butternut) is identified on site with several specimens that need to be protected during construction. Also, sedimentation must not occur from construction activities due to the presence of James Spinymussel, a Threatened and Endangered (T&E) species known to exist downstream from this site.
If protection measures prove inadequate, if other such areas are discovered, or if new species are listed as federally threatened or endangered, or as sensitive by the Regional Forester, Forest Service may either cancel or unilaterally modify this contract to provide additional protection regardless of when such facts become known. Discovery of such areas by either party shall be promptly reported to the other party.
STREAM & OTHER RESTRICTIONS
The Pedlar River is identified as a wild trout stream and has time of year restrictions, from October 1 to April 30, when no in-stream disturbance may occur. The contractor shall organize their construction schedule accordingly to account for this restriction.
There is a local event known as “Heritage Day” (for trout fishing) that takes place along FS 76 around the bridge and the campground. It is typically scheduled in the first week of April and the river is stocked in this area the day before. No work shall be scheduled during these two days to facilitate public access to the river for stocking and the event. The contractor shall organize their construction activities accordingly to avoid work activities on these days.
SPILL PLAN
If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer and containment capacity of up to 120% of the tank capacity. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations.
The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and cleanup of petroleum products spills caused by Contractor's employees or resulting from contract operations. The Contractor shall immediately report all petroleum products spills to the Contracting Officer.
EQUIPMENT CLEANING
All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.
Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer in accordance to Project Specifications, so that arrangements can be made for inspection.
If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.
