Staffing Plan
At the beginning of the Base Year of this contract, incumbent personnel providing the functions of this contract for the Government at the time of award will be granted right of first refusal for positions each incumbent may qualify for based on the new positions descriptions (see
Attachment 4), in the new successor contract. Utilizing procedures written in 29 CFR 9.2, when a service contract succeeds a contract for performance of the same or similar services, as defined at 29 CFR 9.2, at the same location, the successor contractor and its subcontractors should offer those service employees that are employed under the predecessor contract, and whose employment will be terminated as a result of the award of the successor contract, a right of first refusal of employment under the contract in positions for which they are qualified. The
Government will provide a list of the incumbent personnel on the date of award. The Contractor
Company is responsible for submitting the right of first refusal results ten (10) business days after contract award. Should an incumbent contractor not accept a position or the company determine the incumbent is not qualified or a good fit to represent their company for a position, the contractor company will be required to fill the position with a candidate that is qualified as specified in the position description.
Upon receiving requests from the Government to fill new positions, positions not already filled by incumbent personnel, or upon replacement of departing incumbent individuals, the
Government reserves the right to review resumes and screen candidates to ensure their ability to meet the requirements of this IDIQ. However, the process for filling new positions or backfilling positions not classified as Key Personnel (unless otherwise requested by the
Government), will be for the contractor company to provide a suitable candidate, in accordance with the vacant position, no later than ten (10) business days after the Government requests the new position or a position to be backfilled. Key personnel positions will be required to have resumes submitted to the Government for review and to possibly screen, unless otherwise directed by the Government. When resumes are required, the contractor company will be required to submit resumes no later than five (5) business days after the request is made by the
Government.
Should the Contractor Company choose to replace or remove any individual providing services under this IDIQ, the company must provide a written notice to the COR, ACOR or CO, unless the circumstances dictate an immediate removal. When applicable, preemptive notifications will be made as soon as possible to provide FSI/EX/AVF the greatest amount of time to plan for and ascertain the impact the change will have on program and project needs. However, the contractor company has the unilateral ability to remove their employee from the FSI requirement should there be a performance issue or violation of company policy. Should this

situation occur, the company must notify the COR immediately following the removal. All removals from the FSI requirement will require the contractor company to obtain their employee’s badge and any other federal government property.
In the event that the performance of the awarded contractor company’s personnel is determined by the Government to be unsatisfactory at any time during the life of the contract, the
Government reserves the right to request removal from the FSI requirement. Notification will include the reason for requesting the removal and shall be consistent with requirements set forth in the contract.
The Contractor Company shall implement the Staffing Plan developed as part of its proposal. The approach for hiring and retaining contractor staff will be stated in the
Staffing Plan.
