About this file
This is a contract agreement between Ada County Highway District (ACHD) and a contractor for the Franklin Road improvement project in Meridian, Idaho. The project involves widening Franklin Road to five lanes from McDermott Road to Black Cat Road, adding multi-use pathways on both sides, constructing stormwater facilities, irrigation facilities, and continuous street lighting, and signalizing the intersection of McDermott Road and Franklin Road. The contractor is required to coordinate with all utility contractors throughout project execution. Work must commence within five calendar days after the Notice to Proceed, with irrigation and bridge work scheduled for completion by March 15, 2027, and the remainder of the project substantially complete by October 1, 2027. The completion timeline is predicated on ACHD issuing the Notice to Proceed on or about December 1, 2026, with a one-day extension granted for each calendar day of delay in issuance.
The contract amount is to be determined and will be based on actual quantities of work performed at contractor-proposed unit prices, with adjustments made through approved change orders. Liquidated damages of $5,000 per calendar day apply for failure to complete irrigation and bridge work by March 15, 2027, and $5,000 per calendar day for work remaining incomplete beyond the overall October 1, 2027 completion date. The contractor must pay or secure all state and local taxes, excises, and license fees, and provide written affidavit with final payment certification. Both Performance Bond and Labor and Material Payment Bonds, each in an amount equal to the full contract price, are required. Final payment is conditioned upon contractor submission of a completed Final Billing Certification affidavit and ACHD's receipt of a Public Works Tax Release from the Idaho Tax Commission.
