About this file
This justification and approval document and related solicitation specify requirements for a competitive small business set-aside contract to procure workboats and docking equipment for up to ten boats for the Commander, Naval Installation Command. Brand name equipment will be specified due to lack of alternatives that meet technical and safety requirements. A synopsis was released in January 2020 and a brand name synopsis in October 2020 to notify potential vendors, with no questions received. Price analysis will determine if total prices are fair and reasonable based on adequate competition. The Navy will continue monitoring for new sources and reassess requirements if alternatives emerge. The solicitation was posted on the Federal Business Opportunities website with a response due date not provided, to procure workboats, docks and related equipment for the Naval Sea Systems Command.

J&A Number: 21,545
The proposed contract was synopsized on the FEDBIZOPPS website on January 29, 2020. Responses were received from vendors that are interested in and capable of performing the requirements. A synopsis of the brand name items was released on the FEBIZOPPS website on October 19, 2020 notifying builders of the related equipment that will be specified on the WBD boat. The Government did not receive any responses or questions to the brand name synopsis. In accordance with FAR
5.102 (a)(6), the Contracting Officer will include this J&A with the solicitation when publicized on the FEDBIZOPPS website.
7. Determination of Fair and Reasonable Costs
This requirement is for commercial items. As such, the Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the brand name J&A will be fair and reasonable. Price Analysis will be utilized to determine the fair and reasonable price prior to award. Furthermore, this contract award will be based on competition and these systems have multiple distributers which enables competitive pricing. Therefore, the prices of the brand name equipment contributing to the total price are expected to be determined fair and reasonable based on adequate price competition.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NAVSEA intends to specify the brand name and brand name or equal equipment for CNIC WBD boats under this contract vehicle. The contract will be awarded as a result of a competitive small business set aside. The Government will continue to monitor sources for the brand name and brand name or equal items, and if another potential source emerges, will assess whether the requirements can be competed.
