About this file

This is a Project Manual containing construction documents for a roof replacement project at the West Virginia School for the Deaf and Blind (WVSDB) located in Romney, West Virginia. The project involves the replacement of the roof on the Elementary Dorm Wing and is being managed by Williamson Shriver Architects, Inc. (Architect's Project Number 2026-068) with Tower Engineering serving as the Mechanical/Electrical/Plumbing Consultant. The construction documents include general bidding requirements, conditions of contract utilizing AIA standard forms (A201-2017), contract forms for payment applications and change orders, and detailed specifications organized by construction divisions including selective demolition, metals, carpentry, thermal and moisture protection (EPDM roofing), finishes, plumbing, and electrical work. The specifications reference an WECI 3-Year Asbestos Inspection Report for reference purposes, indicating potential asbestos-containing materials in the existing structure requiring careful handling during demolition.

The pricing sheet requests bidders to provide a base price for all labor, materials, tools, equipment, and supervision required to complete the general construction work, with the base bid to include allowances as indicated in the specifications. Bidders are required to submit their WV Business Registration ID Number and WV Contractor License Number as part of the proposal. The document includes standard notice and resolution forms for defective or non-conforming work, non-compliance with project requirements, and breach of contract, establishing the contractual framework and remedies available to the owner. No specific contract term, award date, or site visit requirements are detailed in this project manual excerpt.

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and other Division 01 Specification Sections, apply to this Section.

1.2 SUMMARY

A. Section includes administrative and procedural requirements governing allowances.

1. Certain items are specified in the Contract Documents by allowances. Allowances have been established in lieu of additional requirements and to defer selection of actual materials and equipment to a later date when direction will be provided to Contractor. If necessary, additional requirements will be issued by Change Order.

B. Types of allowances include the following:

1. Contingency allowances.

1.3 SELECTION AND PURCHASE

A. At the earliest practical date after award of the Contract, advise Architect of the date when final selection and purchase of each product or system described by an allowance must be completed to avoid delaying the Work.

B. At Architect's request, obtain proposals for each allowance for use in making final selections.

Include recommendations that are relevant to performing the Work.

C. Purchase products and systems selected by Architect from the designated supplier.

1.4 ACTION SUBMITTALS

A. Submit proposals for purchase of products or systems included in allowances, in the form specified for Change Orders.

1.5 INFORMATIONAL SUBMITTALS

A. Submit invoices or delivery slips to show actual quantities of materials delivered to the site for use in fulfillment of each allowance.

B. Submit time sheets and other documentation to show labor time and cost for installation of allowance items that include installation as part of the allowance.

B. Contractor's overhead, profit, bonds, insurance, and other related costs are to be part of the Contract Sum. Cost items to be priced under the allowance will include the proper labor, materials, equipment, subcontractors, freight, material handling, and other related costs and will be deducted from the allowance.

C. At Project closeout, credit unused amounts remaining in the contingency allowance to Owner by Change Order.

1.8 ADJUSTMENT OF ALLOWANCES

A. Allowance Adjustment: To adjust allowance amounts, prepare a Construction Change Directive Request proposal based on the difference between purchase amount and the allowance, multiplied by final measurement of work-in-place where applicable. If applicable, include reasonable allowances for cutting losses, tolerances, mixing wastes, normal product imperfections, and similar margins.

1. Include installation costs in purchase amount only where indicated as part of the allowance.

2. If requested, prepare explanation and documentation to substantiate distribution of overhead costs and other margins claimed.

3. Submit substantiation of a change in scope of work, if any, claimed in Change Orders related to unit-cost allowances.

4. Owner reserves the right to establish the quantity of work-in-place by independent quantity survey, measure, or count.

B. Submit claims for increased costs because of a change in scope or nature of the allowance described in the Contract Documents, whether for the purchase order amount or Contractor's handling, labor, installation, overhead, and profit.

1. Do not include Contractor's or subcontractor's indirect expense in the Change Order cost amount unless it is clearly shown that the nature or extent of work has changed from what could have been foreseen from information in the Contract Documents.

5. Cost to which overhead and profit is to be applied shall be determined based upon the estimated labor hours shall include hours only for those workmen and working foremen directly involved in performing the Change Order work. Supervision above the level of working foremen (such as general foremen, superintendent, project manager, etc.) is considered to be included in the Overhead and Profit. Hand tools are defined as equipment with a value of $1,000 or less. For Contractor owned equipment, the "bare" equipment rental rates allowed to be used for pricing Change Order proposals shall be not more than the monthly rate listed in the most current publication of The AED Green Book divided by 176 to arrive at a maximum hourly rate to be applied to the hours the equipment is used performing the Change Order work.

7. Local Business and Occupation Taxes, if applicable, shall be calculated on the cost of the Work, overhead and profit.

8. Overhead and profit shall not be calculated on changes in the Work involving unit prices or allowances. Unit prices and allowances are to have overhead and profit included in the price quoted

9. Under no circumstances is Contractor permitted to charge for the passage of time (often referred to as general conditions or winter conditions) without an identified, itemized, and concretely provable cost borne by Contractor. Contractor has a duty to mitigate costs during a delay period to the fullest extent possible and Contractor will not be paid for costs that could have been mitigated. Calculating a daily delay rate without properly identifying, itemizing, and proving actual, unmitigateable costs, is prohibited.

Contractor understands and accepts that it has the responsibility to prove that costs could not be mitigated prior to submitting a request for payment.

10. For revisions to the Work requested by the Owner or Architect and for substitutions requested by the Contractor and approved by the Owner and Architect, overhead and profit shall be limited to the net difference between the cost of the specified Work and cost of the revised or substituted Work.
