PRE-PROPOSAL QUESTIONS & ANSWERS

RFP N62742-22-R-1322

PAF 198127 TACMOR UTILITIES AND

INFRASTRUCTURE SUPPORT

NOTE: The following questions and answers are provided for INFORMATION ONLY.

The RFP remains unchanged unless it is amended in writing on a Standard Form 30.

RESPONSES DEFERRED FROM NOTICE NO. 1

55. Drawing S-501, S-503, CG101,102,104,105, Tx Site - Drain Pipe Connection to MSE Wall Underdrain.

a. Please indicate which S-501 underdrain pipe run(s) applies to detail C2/S-503. It is unclear if detail C2/S-503 applies only to the underdrain at the MSE Wall levelling pad.

RESP: At each location shown on the grading plans, each of 3 underdrains shown on A1/S-501 requires an outlet per detail C2/S-503. Outlets may be combined such that only one pipe penetrates the MSE wall at each location. See forthcoming amendment.

b. Does the underdrain pipe located at the bottom of the reinforced fill and retained fill intersection (bottom right of S-501) receive an outlet pipe?

RESP: See response to Question No. RFI 55a.

78. Reference: SPEC SECTION 01 32 17.00 20 Page 10 - Subpart 1.10.2.8 Adverse Weather Lost Work Days – last paragraph reads: “The Contracting Officer will issue a modification in accordance with the contract clauses, giving the Contractor a time only extension for the difference of days between the anticipated and actual adverse weather delay if the number of actual adverse weather delay days exceeds the number of days anticipated for the month in which the delay occurs and the adverse weather delayed activities are on the longest path to contract completion in the period when delay occurred. A lost workday due to weather conditions is defined as a day in which the Contractor cannot work at least 50 percent of the day on the impacted activity. Make changes to P6 project calendars to reflect as-built conditions where work occurred where originally anticipated as non-work days, and where work did not occur (lost work day).”

Please clarify how will the stated 50% of the day be calculated? Does it mean one period of several hours rain or sum of interrupted hours at different times of work day?

RESP is deferred.

If it is calculated based on sum of total interrupted hours at different times of work day, please be advised that due nature of this project (major earthwork and site concrete work) if the calculated 50% of rainy weather happens in different times of the day will lead to non-work day, because once crews commence working, prepare the site to recover from storm then another rain shower took place, crews have to stop before performing any work. However, if rain is continuous for 50% of work day (takes place in one continuous period) then contractor is able to get 50% of continuous ½ work day without interruption, in this case contractor’s crew can be to some extent productive.

RESP is deferred.

Accordingly, we respectfully request to add a clause in the spec to entitle the contractor to claim for weather lost work days if 50% of rainy weather in certain days took place during different times of work day.

RESP is deferred.

NOTICE NO. 3 QUESTIONS AND ANSWERS CONTINUE

119. Reference: Existing Man-Camp and Structures at Angaur Island. Question:

Please advise if NAVFAC is able to assist all bidders to contact the owners of existing vacant portable modular containers at the newly constructed Antenna site and old concrete structure barracks. There will be some cost saving if the contractor is able to utilize these temporary structures for man-camp. Contractor may purchase some of existing portable containers or renovate existing concrete structures if they are structurally sound.

RESP: Response is deferred.

120. Reference: Price Proposal Schedule – CLIN No. 0001AB – Mobilization and Demobilization. Questions:

a. Is there a limited amount or percentage of total price proposal allowed for mobilization and demobilization?

RESP: No.

b. Is it allowed to allocate cost of purchasing new heavy construction equipment to CLIN No. 0001AB?

RESP: No. In accordance with DFARS 252.236-7004 and DFARS 236.570(2)(b)(ii), the Government will pay all costs for the mobilization and demobilization of all of the Contractor's plant equipment and material only.

c. Is it allowed to allocate cost of man-camp and all temporary facilities to CLIN No.

0001AB?

RESP: See response to Question No. 120.b.

d. Is it allowed to allocate cost of concrete batching plant(s) to CLIN No. 0001AB?

RESP: See response to Question No. 120.b.

121. Reference: Cost of Soil Disposal area preparation. Question: There will be a significant effort required to prepare, maintain and store soil disposal area, please advise if this is acceptable to allocate this cost in CLIN No. 0001AB mobilization & demobilization pay item.

RESP: See response to Question No. 120.b.

122. Reference: Drilled shaft required for the security and light poles. Question:

Due to unavailability of drill rig on island of Palau, to perform drilling for the security and light poles foundation drill rig has to be shipped from off island for Tx & Rx sites.

Is it feasible for the engineer to re-design drilled shaft foundation to replace it with cast in place spread footing and concrete pedestal?

RESP: A shallow foundation/spread footing system may be used for the lightning and camera poles. See forthcoming amendment.

123. Reference: SPEC SECTION 03 30 00 Page 26 - Sub-section 3.6 BATCHING, MEASURING, MIXING, AND TRANSPORTING CONCRETE reads:

“In accordance with ASTM C94/C94M, ACI 301, ACI 302.1R and ACI 304R, except as modified herein. Batching equipment must be such that the concrete ingredients are consistently measured within the following tolerances: 1 percent for cement and water, 2 percent for aggregate, and 3 percent for admixtures. Furnish mandatory batch ticket information for each load of ready mix concrete.” Question: Please confirm that batching aggregate and cement shall be based on mass (weight) not volume per ASTM C94/C94M. In other words, volumetric mixer is not allowed to be used to batch and mix concrete.

RESP: On-site batching will be allowed. Volumetric batching will be allowed per ASTM

685. See forthcoming amendment.

124. Reference: RFP due date of March 21st, 2022. Question: Due to the complexity of this project, logistics, number of unanswered critical RFIs, required extensive time and effort to perform testing and investigation for available local materials to verify compliance with the specs, also taking into consideration long time required to search for alternative off-island suppliers we respectfully request to extend the RFP due date at least four weeks. Please be advised, additional time will help tremendously to submit competitive pricing which will eventually reduce the ultimate cost of this project.

RESP: See Amendment 0003.

125. Reference: Angaur Site – manufactured on site fill. Questions:

a. Can the government’ geotechnical engineer assure bidders that crushed / manufactured onsite soil is competent / suitable to meet fill spec and can be used to balance the site?

RESP: Base bids on the assumption that the crushed/manufactured onsite soil is suitable to meet fill specifications. See forthcoming amendment.

b. If onsite soil is not suitable to balance Angaur site, will the contractor be entitled for cost adjustment / change order?

RESP: If the onsite material is determined not suitable to use as fill, it will be handled as a changed condition. See forthcoming amendment.

c. Considering the massive risk associated with scenario of having on site soil not meeting spec of fill material which means imported material from other island and export excavated unsuitable soil off-Angaur bidders will include large contingency.

Accordingly, we respectfully provide guidance to all bidders to base price on certain scenario (e.g. using manufactured onsite material to balance the site), in this case all bidders price same scope.

RESP: See response to Question 125a.

126. Drawing S-001, Foundation Note: 7 States - “POCKETS OF ELASTIC SILTS

MUST BE REMOVED AND REPLACED WITH CONTROLLED LOW STRENGTH

MATERIAL (CLSM). PROBE HOLES AND CAVITIES MUST BE GROUTED WITH

CLSM AS SPECIFIED. “

For bidding purposes, please clarify extent of Elastic Silt pockets to be removed and replaced.

RESP: Pockets of elastic silt must be removed to a maximum of 1 meter under the slab subgrade and replaced with Controlled Low Strength Material (CLSM). The elastic silt pockets to be removed will not exceed 10% of the slab area. See forthcoming amendment.

127. Drawing s-501. TYPICAL MSE WALL SEC A1 shows “UNDERCUT TO 610

BELOW TOP OF BEDROCK AND REPLACE WITH SELECT FILL, SEE NOTE 2.”

For bidding purposes, please advise how above note will be applied in case of other materials?

With respect to this note, what assumptions should we use for bed rock elevations?

RESP: Undercut to 610 below top of bedrock and replace with select fill, see note 2;

undercut is limited to 1/2H (height of the wall). See forthcoming amendment.

128. Drawing CS106. Referring to CS106-Tx Site plan, FRP fence around the QVIS Antenna will be with barbed wire or not, please clarify.

RESP: See Response to Question No. 9c.

132. General. Please clarify if workforce housing facilities will be permitted at the construction sites (TX & RX).

RESP: Response is deferred.

133. Contract Performance Period.

COMMENT: The Standard Form SF1442 and the Government’s response to RFI No. 12 appears to be at odds regarding the likely date of a common Notice to Proceed (NTP) for both the Transmit & Receive sites. SF1442 references a bid validity period of 180 calendar days following the proposal submission date. If this were to run its full course the forecasted NTP following the 21-day grace period for submission of bonds would be October 08, 2022. The government response to RFI No. 12 puts the anticipated completion of the separate contract for UXO/MEC clearance of the Receive Site as June 2023, an interval of some 240 calendar days later.

QUESTION: Are we to assume that each site will have separate NTP dates and that the period of performance confirmed as 1,095 calendar days (Notice 01) will be extended by approximately 240 calendar days to accommodate the latest of the two release date?

Alternately, are we to assume that the performance period for the Receive Site will be compressed by an identical period needed to complete the UXO/MEC removal, clearing and grubbing under a separate contract prior to granting possession to the Offeror?

RESP: There is only one contract completion date of 1,095 calendar days after NTP.

Base bids on receiving the Rx site no later than June 30, 2023.

134. Contract Performance Period.

COMMENT: Document 00 70 00 listed the period of performance to execute the entire work ready for use as 1,095 calendar dates following issuance of the Notice to Proceed.

The logistical challenge of undertaking twin operations of this magnitude on Babeldaob and the equally remote and austere island of Anguar is a monumental task with a low likelihood of success given the better part of 220 rainy days per year and the shortage of homegrown skilled labor.

QUESTION: It is our belief that the performance period needs to be extended by a further 240 calendar days to 1,338 calendar days in order to provide a reasonable opportunity for success.

RESP: The performance period remains unchanged. See Section 01 14 00, paragraph

1.3 and Section 01 32 17.00 20, paragraph 1.10.2.8.

135. Drawing sheets CG151 & CG152, Finish elevations at the borrow pits. Please clarify if the indicated finish elevations at the borrow pits can be adjusted to minimize surplus or allow a balanced site earthwork

b. Who has to install the ground mat 0.10x0.10 grid in the Earth Mat area? If the general contractor has to install it, please provide Specs and details for this scope.

RESP: See response to Question No. 163a

c. If installed by others, does it have to be installed during the duration of the current project? What’s the duration required to install the grid? This info is required to incorporate it in the project overall schedule.

RESP: See response to Question No. 163a

165. Reference: Supplementary Drawing 91-00560-00 – RX Site Layout TACMOR Question: Who has to install the cables and cable trenches indicated in this drawing?

RESP: Cable and cable trenches and are to be installed by others after completion of the construction contract.

166. Reference: Supplementary Drawing 91-00560-00 – RX Site Layout TACMOR Question: There is a note in this drawing about cable pit dimensions being 2mx2mx2m.

In the Telecom Drawings (Sheets TS151-TS155) of PAF 198127 TACMOR Drawings, there is a Telecom Handhole to be installed in the same location of the cable pits. THH dimensions per detail A2/E501 are 1.41mx1.21mx1.135m. Please clarify which dimensions to follow?

RESP: Response is deferred.

167. Reference: CLIN 0001AC & CLIN 0001AD. Question:

a. Please clarify how will the quantity of the above two items be measured? Will it be measured as a stockpile at disposal areas (SD1 & SD2)? If so, what’s the height of stockpile? Please note that reduction in volume of stockpiled material depends on the height of stockpile, in other words the higher stockpile will lose more volume due to consolidation. Therefore, for fair price comparison, please provide stockpile plan or at min provide standard height of the stockpile to allow all bidders price this item based on same condition.

RESP: See response to Question No. 37a and Amendment 0002.

b. Description of the above items indicates excavation and removal off-site. Since Excavation is part of earthwork scope please confirm that the contractor has to allocate cost of excavation in the above CLIN items and does not have to include any excavation cost in CLIN 0001AA.

RESP: Yes, allocate cost of basalt excavation in SLIN 0001AC and soil excavation in

SLIN 0001AD.

c. If there is a discrepancy in provided quantity in price schedule and actual quantity based on field measurements, does this means that the contractor will be compensated based on actual quantities to be determined during construction? Please clarify, this is a very critical cost item.

RESP: Yes, see SF1442, Price Schedule, Note 8.

d. Do the above CLIN items cover only mass grading? Or do they cover other site structural excavation and trench excavation?

RESP: SLIN 0001AC and SLIN 0001AD only cover mass grading.

e. What’s the criteria to classify to determine excavated material as basalt rock / hard material?

RESP: Unweathered basalt bedrock is defined in Section 31 23 00.00 20, paragraph 1.2.3.

f. If certain excavated soil is encountered with hardness between basalt rock and soil, how will this material be paid?

RESP: It will be paid as soil.

g. During bidding stage, if there is a discrepancy between provided quantities in price schedule and contractor’s take off quantities, please clarify how the two cases will be addressed:

Case (1) If the contractor’s quantity is more than provided quantity in price schedule, does this mean that the contractor has to follow the price schedule quantity with the intent to get compensated for additional quantity during construction?

RESP: If the actual quantity is more than the estimated quantity stated in the price schedule, FAR 52.211-18, Variation in Estimated Quantity will apply. See SF1442, Price Schedule, Note 8.

Case (2) If the contractor’s quantity is less than provided quantity in price schedule, does this mean that the contractor has to price based on higher quantity provided in the price schedule with the intent to give credit during construction?

RESP: Base bids on the estimated quantity stated in the price schedule. Should the actual quantity be less than the estimated quantity stated in the price schedule, FAR 52.211-18, Variation in Estimated Quantity will apply. See SF1442, Price Schedule, Note 8.

h. Since the actual surplus quantities of basalt rock and soil be derived by the contractor’s means and methods, therefore if a contractor “A” intends to process and utilize onsite material will be compensated less because he/she will generate less surplus than contractor “B”, if contractor “B” intends not to maximize utilizing onsite material. This case will cause unfair price evaluation. Therefore, we respectfully remove these two CLIN items CLIN 0001AC & CLIN 0001AD and have all bidders to include these costs in base bid and direct all bidders to just haul surplus soil to designated soil disposal site. In this case contractor who is planning to balance the site using processed on site material will be rewarded for this effort due to reducing the cost and not on the contrary to be at price disadvantage. Please review this critical matter and advise.

RESP: Response is deferred

168. Reference: RFP due date of March 21st, 2022. Question:

We have been approached by several vendors requesting to extend the proposal due date. Please be advised, after receiving clarifications to all RFIs, we need to modify or complete relevant quantity take off or scope of works then send the info to the vendors and shipping companies for pricing. Due to pending answers to critical RFIs have been / will be submitted, we respectfully extend the RFP submittal due date to at least 4 weeks from date of receiving answers to all RFIs

RESP: See response to Question No. 124.

169. Reference: Supplemental drawing No 91-00560-00 indicates mass concrete.

Question:

We did not find any spec related to mass concrete. Please confirm that there is no structural element qualified to be as mass concrete.

RESP: See response to Question No. 156.

170. Reference: Man-Camp / Temporary Facilities. Question:

a. Is it allowed to leave Man-Camp / Temporary Facilities on site at free charge to be utilized by others (e.g. subsequent contractor(s))?

RESP: Response is deferred.

b. After construction is completed, is it allowed to dispose crushed concrete. green waste and other uncontaminated materials on site at designated location(s) to be provided by NAVFAC? If yes, please provide locations of onsite designated dump sites.

RESP: Response is deferred.

171. Follow-up to Q&A No. 9C, Terms for the use of SD 1 (disposal site 1).

190. RFP Factor 2 Past Performance. Factor 2 of the RFP states: “PPQ shall be completed and signed by the contracting agent and/or their representative responsible for the construction contract administration. A PPQ shall not be from a prime contractor to a subcontractor. The Offeror shall provide completed PPQs in the proposal. Offerors may submit PPQs previously submitted for other solicitations. We presume a subcontractors’ past performance will be acceptable if a PPQ is provided by the “contracting agent”. In this case the contracting agent is a prime contractor that issued a subcontract. We are interrupting the language above to mean the prime contractor for this Palau RFP is unacceptable to prepare a PPQ for a subcontractor. Is this correct?

RESP: No, a PPQ cannot be from a prime contractor to a subcontractor.

191. Spec. Section 31 23 00.00 20, Para. 2.1.1 / 2.1.5. At the Tx site, any common fill must meet the requirements of Section 31 23 00.00 20, Para. 2.1.5. 206. Section 03 30 00, par 2.3.3, Concrete Aggregates. Question:

The only concrete and aggregate supplier in Palau does not have all the testing records required of the local aggregates for evaluation. Additional tests are required to determine if it complies with the project requirement, the ASR test, LA abrasion test, sand test per ASTM D304, aggregates test per ASTM C33 test for deleterious materials are not available. Turn around for these tests is approx. 60 days which includes shipping of samples to an off-island laboratory.

Note: Without these test results, we have no recourse but to use imported concrete aggregates at a very high premium

Proposed solution:

1. Extend the bid date by 60 days to allow completion of the necessary testing.

2. For bid purposes, allow the use of the local aggregates subject to a change condition if found to be unacceptable after contract award.

For bid purposes provide bid allowance, a per ton U/C of aggregates FOB plant.

RESP: Base bids on using local aggregates. Contractor will be responsible to perform the required testing in accordance with the specifications. Should the aggregate be found to be unacceptable, it will be handled as a changed condition.

207. Reference: Notice 2 – Answers to Question 59 a & d indicate that Topographic surveys and soil boring logs of SD1 and SD2 are not available.

Question:

RFP specs - Figure 6 is provided as a Reference Images of the Proposed Soil Disposal 1.

RFP specs - Figure 11 is provided Slope of access route to proposed SD 1. One-meter contours are extrapolated from the 1980 USGS topographic map and are not precise.

RFP specs - Figure 23 indicates Location of SD 2.

Based on the above provided information:

a. SD1: Total Area is approximately 10 Acres site, with elevation difference more than 60 ft North South. In order to utilize the SD 1 site as stockpile to accommodate all surplus basalt & soil, major site grading and retaining walls (60 ft tall) will be required to provide safe flat area for trucks to access the site. In order to avoid constructing costly retaining walls @ SD 1, please advise if the government is able to expand SD1 area to allow sloping / daylighting cut / fill to encroach into adjacent property to SD1?

Otherwise, we respectfully request the project design team to provide design for the SD1 site preparation including permanent structures (retaining walls), drainage..etc this is a design bid build solicitation and bidders are not responsible for design.

Please be advised, this is a major cost (millions of dollars) that all bidders shall include in the bid and more information is required from designers to avoid costly assumptions.

b. Assuming that existing SD 1 is flat or the wining contractor will make it flat, based on volume of surplus materials and in order to provide safe access and safe stockpile plan, please be advised that 10 Acres Area is not sufficient to accommodate two separate stockpile (basalt & soil).

Please advise if all bidders shall assume that the government will be able to expand SD 1 area to accommodate ALL generated surplus materials. Please provide clear directions regarding this matter to allow all bidders to fairly price same conditions.

c. SD2: Total Area is approximately 5 Acres site, assuming that existing SD 2 is flat, please be advised that based on volume of surplus materials and in order to provide safe access and safe stockpile plan, the 5 Acres Area is not sufficient to accommodate two separate stockpile (basalt & soil). The 5 Acres SD 2 site will accommodate small portion of surplus basalt / soil which does not justify the cost to prepare access, BMPs, grading ..etc.

Please advise if all bidders shall assume that the government will be able to expand SD 2 area to accommodate ALL generated surplus materials. Please provide clear directions regarding this matter to allow all bidders to fairly price same conditions.

RESP: Response is deferred.

d. In case SD1 & SD2 are inadequate to accommodate stockpiles of surplus soil and basalt rock, will the contractor be entitled for price modification / change order?

Please provide clear directions regarding this matter to allow all bidders to fairly price same conditions.
