Ques.# Reference (page #, section #, etc.) Question Government Response
PAGE 31, 34-35, SEC. H.5 and H.17, Insurance Requirements and Limitation of Liability
Section H.5 requires Contractors to carry Pollution Exposure coverage under Marine Insurance. Section H.17 indicates 1) the Government assumes the risk for “(2) Hazardous-Substance and/or oil spill response, assessment, mitigation, clean-up;
restoration, and remediation.” And 2) “(g) The Contractor warrants that the contract price does not and will not include any charge or contingency reserve for insurance covering potential environmental fines or penalties even if the Government’s assumption may be terminated for unreasonable operations, practices or performance.” Please clarify the Government’s intent relative to Pollution Liability exposures, insurance requirements, and related pricing.
Coverage of marine insurance for pollution exposure at $2,500,000 per incident must be maintained during the entire performance period. Contractor assumes risk for unreasonable operations, practices or performance.
JL-4 Resources Worksheet Is it permissible to have a separate JL-4 Resources List for
Equipment, rather than including such a list on the same sheet(s) with the FTEs?
Yes, however, Offerors shall follow the page limits for Volume II Technical Proposal.
JL-4 Resources Worksheet The JL-4 Resources Worksheet is also cited in the RFP’s Section L.6, Technical Volume instructions, Factor C Staffing and Resources. Given the extensive amount of detail for the proposed equipment for all Annexes, would the Government consider revising the proposal instructions for Factor C, so that the required Attachment JL-4 forms are not included in the Factor C page count?
The overall page limit for Volume II, Technical Proposal will remain the same at 501 pages and includes attachments.
However, the page limit for Factors A, C & D have been combined and is now 489 pages.
Offerors can choose how to distribute the pages among Factors A, C & D. The page limits for Factors B and E remain at 5 pages and 7 pages respectively.

REQUIREMENTS, FACTOR E, SMALL BUSINESS
