SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

PROPOSAL EVALUATION

1.0 GENERAL

The Government intends to make a single Firm Fixed Price (FFP) award to the offeror whose proposal represents the Best Value to the Government after evaluation in accordance with the evaluation factors below.

Offerors are advised that the Government intends to make award on the basis of initial proposals without conducting discussions with Offerors, but reserves the right to conduct discussions if determined by the Contracting Officer to be necessary (see paragraph (f)(4) of FAR 52.215-1). Therefore, each initial offer should contain the Offeror’s best terms from a price, technical and past performance standpoint. Statements and representations made in the Offeror’s proposal may be subject to verification by other sources or through an onsite survey by Navy evaluators.

Offerors are advised that except for past performance information, the Government will not evaluate any proposal information not contained within the body of the proposal. Letters of transmittal and/or cover letters that forward the proposal to the Government are not considered part of the body of the proposal.

2.0 BASIS OF AWARD

1. The Government will make a Best Value source selection using the Lowest Price Technically Acceptable

(LPTA) approach. In order to be considered awardable, the offeror must be deemed responsible in accordance with FAR 9.104. Award shall be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-price factors.

2. All contract line items will be awarded to one offeror. Offers, therefore, must be on the basis of furnishing all contract line items.

3. The Government intends to award without discussions, but reserves the right to conduct discussions if necessary. Thus, offerors should submit their proposal with the best terms.

4. The Government will evaluate two non-price factors for acceptability and analyze the offeror’s total proposed price. Thus, the evaluation factors are:

Factor 1: Technical Approach

Sub factor 1: ABR/MSRA Requirement

Sub factor 2: Milestone/Delivery Schedule

Sub factor 3: Drydocking Facility Description

Factor 2: Past Performance

Factor 3: Price

5. Evaluation factors represent those specific characteristics that are tied to significant RFP requirements.

They are the uniform baseline against which each offeror’s proposal is evaluated allowing the Government to make a determination of acceptability.

6. After establishing whether the offerors’ proposals adhere to the instructions of Section L, the Government will distribute the price and non-price proposals for evaluation. The Government intends to award without discussions but reserves the right to conduct discussions if necessary. Thus, offerors should submit their proposals with the best terms.

3.0 EVALUATION FACTORS

Non-Price Factor 1: Technical

- The government will evaluate the Offeror’s technical proposal by technical acceptability using the ratings and descriptions in the table below:

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation

The Technical Approach Sub-factors listed below, which are of equal importance, will be evaluated based on the following:

Sub factor 1: ABR/MSRA Requirement:

The purpose of the ABR/MSRA Requirement is to ensure the offeror has the technical comprehension and capability to satisfy the Government’s requirements. To be eligible for award, a prospective contractor shall possess a valid Agreement for Boat Repair (ABR) or Master Ship Repair Agreement (MSRA) as described in DFARS 217.71 Master Agreement for Repair and Alteration of Vessels (MARAV).

Sub factor 2: Milestone/Delivery Schedule:

The purpose of the Milestone/Delivery Schedule is to assess the offeror’s proposal to make a determination of acceptability or unacceptability on the milestone/delivery schedule in order to satisfy the Government’s requirements in accordance with the earliest date the vessel will be available and latest date the

Government requires the vessel back.

The Government will evaluate the milestone/delivery schedule for capability and execution within the period of performance. To be considered awardable, the offeror’s proposed milestone/delivery schedule shall demonstrate a schedule to complete the contract performance within the required period.

Milestone/delivery schedules that do not meet the required period of performance or do not indicate that the contract will be performed in accordance with Attachment MARMCN-502-19 of Section J-8 will be rated unacceptable and will be considered un-awardable.

Sub factor 3: Drydocking Facility Description:

The purpose of the Drydocking Facility Description is to ensure the offeror has the physical resources necessary for docking the vessel. To be considered awardable, the proposed drydocking facility shall be adequate to accommodate the vessel’s dimensions as listed in Attachment J-1 for the USNS PREVAIL

(TSV-1).

Non-Price Factor 2: Past Performance

- Past performance will be evaluated for confidence. Evaluation will focus only on work experience already performed. Work yet-to-be performed, and work prior to the last 3 years, will not be considered.

- This consideration is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s past performance will be used as a means of evaluating the capability of the offeror and other competitors to successfully meet the requirements of the RFP. In determining the rating for the past performance evaluation factor, the Government will give greater consideration to the contracts which the Government feels are most relevant to the RFP.

- The Government will measure how well an offeror has performed on relevant contracts in the past as an indicator of the offeror’s probability of meeting the solicitation requirements and an indicator of the successful performance on the current requirement.

- To develop the overall rating, the Government’s evaluation will take into account relevant contract information to the requirements of this solicitation submitted by each offeror as part of its proposal including the Past Performance Information Form (Attachment J-3 ) as well as other sources of information. Other sources of information for past performance may include, but are not limited to, an offeror’s past performance information from the Past Performance Information Retrieval System (PPIRS), the Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract

Report System (eSRS), as well as any other sources reasonably available to the Government.

- Assessment of past performance will be a subjective assessment based on consideration of all relevant facts and circumstances. The Government is seeking to determine whether the offeror has consistently demonstrated a commitment to customer satisfaction and timely delivery of quality goods and services at fair and reasonable prices.

- If discussions are required, offerors will be given an opportunity to address unfavorable reports of past performance and the offeror's response, or lack thereof, will be taken into consideration. In particular, recent contracts will be examined to ensure that corrective measures have been put in place to prevent the reoccurrence of past performance problems. Prompt actions taken to correct performance problems will be a reflection of management concern for customer satisfaction; however, such action may not mitigate all negative performance trends.

- The Government’s past performance evaluation will focus on the following areas:

• Cost Control

• Schedule

• Technical Performance

- In accordance with FAR 15.305(a) (2) (iv), an offeror without a record of relevant past performance or for whom information on past performance is not available, will not be evaluated favorably or unfavorably on past performance. If an offeror lacks relevant past performance information, the evaluators will assign a

Neutral rating. In terms of Acceptable / Unacceptable, a Neutral rating is considered Acceptable.

The Government will evaluate the relevancy of an offeror’s past performance in accordance with the ratings table below:

Rating Description

Acceptable

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will successfully perform the required effort.

- The Government will determine how well the offeror performed on past efforts found to be at least somewhat relevant to the solicitation.
