1. What does the government consider to be proprietary software?
a. Proprietary software is any software which places restrictions on use, analysis, modification, or distribution (unchanged or modified) can be termed proprietary.
FAR Subpart 27.4 (b) Contractors may have proprietary interests in data. In order to prevent the compromise of these interests, agencies shall protect proprietary data from unauthorized use and disclosure. The protection of such data is also necessary to encourage qualified contractors to participate in and apply innovative concepts to Government programs. In light of these considerations, agencies shall balance the Government’s needs and the contractor’s legitimate proprietary interests.
The FAR is basically stating that the government agency must protect contactor’s proprietary information from being disclosed.
2. Examples of proprietary vs non-proprietary software, is existing source code for ASRS level and PLC level code available.
a. Both source code (human readable code - C:/exe) and/or object code (computer readable code - 00 and 11’s) can both be non-proprietary and proprietary software. This means that the contractor developed code exclusively at their own expense and it cannot be shared to anyone outside the US Government. In order for the US Government to share proprietary information, the US Government would need permission from the contractor that is marking the software code proprietary.
You need source code in order to modify object code. If source code is proprietary, the government cannot disclose the code outside of the federal government.
3. Please define 1.1.2.2 – What is defined as non–proprietary. Please provide examples of both proprietary & non-proprietary.
