About this file

This is a Minority Business Enterprise (MBE) Pre-Bid Meeting Script issued by the Office of State Procurement, Strategic Sourcing and Procurement Diversity Programs at the Maryland Department of General Services (DGS) for the Janitorial Services at the Towson District Courthouse contract. The script establishes the framework for MBE participation requirements, compliance procedures, and bid submission deadlines. Certified MBE primes may count self-performed work toward up to 50% of the overall 5% MBE goal, provided they are certified in the correct NAICS code and listed on the MBE Participation Schedule. All MBE subcontractors must hold active certification with MDOT at the time of bid submission, with no pending certifications accepted. The Attachment D-1A (MBE Utilization and Fair Solicitation Affidavit & Participation Schedule) must accompany the initial bid, and apparent low bidders have 10 business days following bid opening to submit Attachments D-2, D-3A, and D-3B to the Procurement Officer.

Material and supply cost participation rules vary by MBE classification: Regular Dealers may count up to 60% of material and supply costs; Manufacturers receive full participation credit; Brokers may only count fees or commissions, not material costs; and furnish-and-install work by certified MBEs counts in full. Dually certified MBEs are limited to counting toward one subgroup category per contract. Bidders unable to meet the 5% MBE goal may request a waiver by submitting Attachments D-1B (Waiver Guidance) and D-1C (Good Faith Efforts Documentation) with their bids. The Compliance Officer reviews waiver requests against COMAR standards, verifies stated reasons, contacts listed subvendors, and forwards recommendations to the Procurement Officer. This contract carries no VSBE requirement and does not base participation on third-tier vendors.

MBE Pre-Bid Meeting Script

5% MBE goal, no VSBE, not based on 3rd Tier vendors

Good morning. I am the MBE representative for the Office of State Procurement, Strategic Sourcing and

Procurement Diversity Programs at DGS. My team's Compliance Officers ensure the MBE goal is met on this contract, which is set at 5%.

MBE Prime Self-Performance

A certified MBE prime may count self-performed work toward up to 50% of the overall goal. To get credit, the

MBE prime must be certified in the correct NAICS code and list itself on the MBE Participation Schedule with the work it will self-perform. For any remaining portion of the goal, the prime must identify other certified MBE subcontractors or request a waiver. Self-performance credit does not limit how much additional work the prime can perform, only how much counts toward the goal.

MBE Subcontractors

All MBE subcontractors must be certified with MDOT at time of bid, no pending certifications. Check the MDOT list at marylandmdbe.mdbecert.com. Attachment D-1A (MBE Utilization and Fair Solicitation Affidavit &

Participation Schedule) is due with the bid. If the apparent low bidder, you then have 10 business days to submit

Attachment D-2, D-3A, and D-3B to the Procurement Officer.

Materials and Supplies

If an MBE is a Regular Dealer, up to 60% of the cost of materials and supplies it provides may count toward the goal. If the MBE is a Manufacturer, participation counts in full. If the MBE is a Broker, only the fees or commissions charged may count, not the cost of the materials. Furnish and install work by a properly certified MBE counts in full. A dually certified MBE may only count toward one subgroup category per contract.

Waivers

If you cannot meet the goal, you may request a waiver in writing using Attachments D-1B (Waiver Guidance) and

D-1C (Good Faith Efforts Documentation) with your bid. The Compliance Officer reviews good faith effort under

COMAR, verifies your stated reasons, contacts any subvendors listed as unavailable, and forwards a recommendation to the Procurement Officer.

Note: If you have questions or need assistance, contact the Procurement Officer in writing.
