About this file
This document outlines fair opportunity scenarios for task order awards under the JWCC (Joint Warfighting Cloud Capability) UCM Core contract. The JWCC UCM Core is a hyperscale cloud services contract vehicle administered by the Defense Information Systems Agency (DISA) at Scott Air Force Base.
The document presents four primary fair opportunity scenarios for awarding task orders to Cloud Service Providers (CSPs). Scenario 1 applies to Lowest Price Technically Acceptable (LPTA) acquisitions without technical proposals, requiring CSPs to provide pricing and map cloud service offerings with catalog item numbers/SKUs to specific performance requirements in the Description of Work (DoW). Scenario 2 encompasses two approaches: Scenario 2a uses LPTA evaluation with technical proposals, while Scenario 2b employs Best Value Tradeoff (BVTO) methodology that evaluates technical solutions, pricing, and optional differentiators such as reduced complexity, added capabilities, schedule improvements, automation enhancements, and integration efficiencies. Scenario 3 involves white paper submissions within a set Not-to-Exceed (NTE) funding amount, with awards made to multiple CSPs based on "best use" or "lowest risk" criteria. Scenario 4 provides equal lump-sum funding awards to all interested CSPs that respond affirmatively to the RFP. The document also identifies exceptions to fair opportunity procedures authorized under 41 USC 253j and FAR 16.507-6(a), including sole-source awards for unique or highly specialized services and logical follow-on orders. All scenarios require CSPs to provide complete pricing breakdowns with unit prices, quantities, and catalog item mappings to DoW requirements.

Fair Opportunity Scenarios Scenario 1
Government User does not require a technical proposal - Lowest Price Technically Acceptable (LPTA)
Request CSPs provide a price proposal that includes the total price and a complete list of cloud service offerings with catalog item numbers/Stock Keeping Unit (SKUs), the unit price, unit of issue, and quantities calculated for each catalog item number/SKU required to meet the requirements in the Description of Work (DoW). CSPs shall map each proposed catalog item number/SKU to the specific DoW Performance Requirement(s).
Compliance Standard(s) (acceptable/unacceptable ratings):
· (Required) Each DoW Performance Requirement has one or more specific catalog item number/SKU mapped to the specific requirement
· (Optional) Mission partner writes detailed compliance standard applicable to specific need
Procedures:
· The Government will issue an Request for Proposal (RFP) to each CSP. The RFP will require the CSP to certify that minimum requirements identified by the Government can be met and completion of a required pricing template.
· The CSPs will respond with either a “No Bid” or by submitting a timely proposal certifying compliance with the RFP and a completed pricing proposal using the provided pricing template.
· After receipt of proposals, the Government will first evaluate the lowest price proposal. If the lowest priced proposal is determined to be compliant with the RFP and otherwise properly awardable, then award will be made to that offeror. The Government reserves the right to evaluate only the lowest price proposal or to conduct further evaluations of additional proposals as needed.
· Award to the lowest priced offeror meeting the compliance standards on an LPTA basis.
Scenario 2
Government User requires a technical proposal Scenario 2a RFP: LPTA Request CSPs propose a technical solution to meet the DoW and provide a price proposal that includes the total price and a complete list of cloud service offerings with catalog item numbers/SKUs, the unit price, unit of issue, and quantities calculated for each catalog item number/SKU required to meet the requirements in the DoW. CSPs shall map each proposed catalog item number/SKU to the specific DoW Performance Requirement(s).
Compliance standard(s) (acceptable/unacceptable ratings):
· (Required) The proposed solution fully addresses each DoW Performance Requirement by identifying all proposed catalog items and quantities necessary to meet the requirements
· (Required) Each catalog item is mapped to a specific DoW requirement, and an explanation of how the item will contribute to the solution is provided
· (Optional) MP writes detailed compliance standard applicable to specific need
Procedures:
· The Government will issue an RFP to each CSP; the RFP will include the basis for technical acceptability and a required pricing template.
· The CSPs will respond with either a “No Bid” or by submitting a technical proposal and pricing using the provided pricing template.
· After receipt of proposals, the Government will first evaluate the lowest priced proposal. If the lowest priced proposal is determined to be technically acceptable and otherwise properly awardable, then award will be made to that offeror. The Government reserves the right to evaluate only the lowest priced proposal or to conduct further evaluations of additional proposals as needed.
· To increase transparency, the Government will share an evaluation summary with any unacceptable offerors upon request.
· Award to the lowest priced offeror meeting compliance standards on an LPTA basis.
Scenario 2b RFP: Best Value Tradeoff (BVTO) Request CSPs propose a technical solution to meet the DoW and provide a price proposal that includes the total price and a complete list of cloud service offerings with catalog item numbers/SKUs, the unit price, unit of issue, and quantities calculated for each catalog item number/SKU required to meet the requirements in the DoW. CSPs shall map each proposed catalog item number/SKU to the specific DoW Performance Requirement(s).
Compliance standard(s) (acceptable/unacceptable ratings):
· (Required) The proposed solution fully addresses each DoW Performance Requirement by identifying the proposed catalog items and quantity that are necessary to meet the requirements
· (Required) Each catalog item is mapped to a specific DoW requirement and an explanation of how the item will contribute to the solution is provided
· (Optional) MP writes detailed compliance standard applicable to specific need Possible Differentiators (color ratings): The solutions offer benefits beyond the solution itself (MP must select a minimum of one differentiator, but no more than three)
· (Optional) Level of complexity reduced due to proposed solution
· (Optional) Added capability (beyond the Government’s requirement) by implementing the solution
· (Optional) Reduction in schedule/timeline achieved due to proposed solution
· (Optional) Any automation capability proposed to improve reliability and reduce human error
· (Optional) Efficiencies achieved by ability to integrate with current environment
· (Optional) MP writes detailed differentiator applicable to specific need
Procedures:
· The Government will issue an RFP to each CSP; the RFP will include evaluation factors and a required pricing template.
· The CSPs will respond with either a “No Bid” or by submitting a technical proposal and pricing using the provided pricing template.
· After receiving proposals, the Government will evaluate all proposals IAW the stated evaluation factors.
· Award will be made to the CSP whose proposal is determined to represent the overall best value to the Government based on the trade-off analysis.
Scenario 3 Government would like to purchase an equal set lump sum dollar amount of offerings from a maximum number of CSPs as specified in the solicitation – White Paper
Request CSP submit a white paper identifying a strategy and approach that will meet or exceed the DoW requirements within the cost limit provided; must provide a price break-out which includes a complete list of cloud service offerings with catalog item numbers/SKUs and quantities to meet the requirements. Government will specify basis of selection as either “best use” or “lowest risk to the Government”.
Compliance standard(s) (acceptable/unacceptable ratings):
· (Required) The proposed solution fully addresses each DoW Performance Requirement by identifying the proposed catalog items (and quantities) that are necessary to meet the requirements
· (Required) Each catalog item is mapped to a specific DoW requirement with an explanation of how the item will contribute to the solution Assessment areas (best use/lowest risk ratings):
· (Required) The solution addresses how the CSP will facilitate the described need
· (Optional) Any automation capability proposed to improve reliability and reduce human-error
· (Optional) Efficiencies achieved by ability to integrate with current environment
· (Optional for “best use”; Required for “lowest risk”) Risk to the Government (MP must select a minimum of one and specify the associated risk):
· (Optional) Security
· (Optional) Schedule
· (Optional) Availability
· (Optional) Other
· (Optional) MP writes detailed assessment criteria applicable to specific need Procedures:
· The Government will issue an RFP to all CSPs stating a user has a Not to Exceed (NTE) amount of funding for offerings, identify the maximum number of awards, and provide a brief description of the requirement and evaluation criteria.
· Each CSP will respond with either “not interested” or by submitting a white paper solution of catalog offerings that the CSP considers to be the “best use” or “lowest risk” of the set funding amount. Note: an MP can assess risk as part of their “best use” evaluation.
· Evaluators will review the white papers and determine acceptability based on stated evaluation criteria.
· Award will be made to the CSP(s) determined to have the “best use” or “lowest risk” solution.
Scenario 4 RFP: Government would like to purchase an equal set lump sum dollar amount of offerings from each CSP.
Request CSP to respond if “interested” or “not interested”.
Issue task orders to all interested CSPs
Procedures:
· Issue the RFP to all CSPs stating a user has an NTE amount of funding for offerings, listing the applicable CLIN(s).
· Each CSP will respond with either “not interested” or “interested” and certify that they agree to the RFP minimum requirements.
· The Government will review the responses, and equal awards will be made to each CSP that responded to the RFP as “interested”.
Exceptions to Fair Opportunity
Task orders may be issued with an exception to the fair opportunity process when circumstances warrant the exercise of any exception as set forth in 41 United States Code (USC) §253j and as further amplified in FAR 16.507-6(a). The statutory exceptions that are anticipated to be more common under the JWCC Contracts include:
FAR 16.507-6(b)(2) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
FAR 16.507-6(b)(3) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the JWCC Contract, provided that all awardees were given a fair opportunity to be considered for the original order.
The justification for an exception to fair opportunity shall be in writing. The approving officials for the justification are, IAW FAR 16.507-6(e), based on dollar values of the proposed TO and applicable local procedures.
