About this file

This is an administrative attachment to an Invitation for Bids (IFB) Number C000972 issued by the NYS Office of Information Technology Services (ITS) for Omnissa Workspace ONE cloud-based software as a service. The attachment, titled "FOIL & Litigation Disclosure," requires bidders to complete mandatory administrative statements as part of their proposal submission. The document establishes two key disclosure requirements: bidders must identify any proprietary or trade secret information in their proposals that they claim should be redacted under the New York State Freedom of Information Law (FOIL), and bidders must disclose any legal proceedings, investigations, or lawsuits involving their firm over the preceding five years, with particular emphasis on any litigation with New York State departments, agencies, boards, or commissions. The attachment specifies that bidders must complete all designated fields and provides a structured format for these administrative disclosures.

The document does not contain pricing terms, set-aside information, incumbent details, or funding amounts, as it functions solely as an administrative compliance form. Bidders responding to IFB C000972 are required to submit this completed disclosure form as part of their administrative proposal package. There are no contracting goals established for Service-Disabled Veteran-Owned Businesses (SDVOB), Minority Business Enterprises (MBE), Women Business Enterprises (WBE), or Disadvantaged Business Enterprises (DBE). Bidders must be certified as members of the Omnissa Partner Program at the Platinum Level to be eligible for consideration.
