1 3.1.1 & 6.4.3.6 PWS

Sections 3.1.1 and 6.4.3.6 contradict one another in regard to training. Sec 3 states that training will be made available and paid for at manhours while Sec 6 says there will be no cost to the government. Will training labor be payable at a manhour rate as it is in other S&RTS contracts?

Section 6.4.3.6 relates to specifically GFE furnished / authorized by Govt for contractor's use during contract at the Charleston terminal, e.g. Shuttlewagon rail car mover.

The Govt will not pay for contractor's employees to learn how to use GFE for use in the performance of their work.

Section 3 refers to training operators in cargo moving in/out of the terminals which is payable by man-hour.

2 4.1.2 PWS

Section 4.1.2 states that detentions 15 minute or less shall be absorbed by the contractor. Why is this changing from the current 10 minute time?

This amount of time seems excessive given that multiple 15 min or less detentions may occur during any hour thus eliminating any ability to be productive. Will there be a mechanism in place to compensate the contractor should instances occur where there are multiple 10-15 minute detentions in an hour?

Upon review, the PWS will remain as posted.

3 2.9

Sec 2.9 states that all employees will participate in I-watch training. Will ILA be required to take the online testing?

Section 2.9 has been removed from the PWS.

4 5.14.1 & 6.23

5.14.1 lists load time for LMSR as 96 hours and discharge as 72 hours. In section 6.23 load is listed as 10 days effectively cutting 2 days of operations while discharging is listed as 7-8 days basically cutting 1-2 days. Why is there a lesser amount of time provided for APS3 LMSR vessels which historically have very low productivity?

Section 5.14.1 is a projection for NON-PREPO LMSR operations. Section 6.23 provides specific details for the APS-3 mission for Charleston. The table reflects historical information on the number of days actually used to discharge and load APS-3 LMSR. The Contractor is expected to conduct LMSR PREPO load within a 10 work day period, and download is expected to be completed within a 7-8 work day period. In 2014, the 841st conducted a load operation within 10 day load period. The 841st also conducted an offload operation in an 8 day period. There is a separate commodity APS-3 PREPO schedule for load/unload.

5 6.11.4

Sec 6.11.4 references ICODES scanning. Is this an additional function that will require additional personnel? How will compensation for this person be made?

One scanner used to capture ITV/ICODES Stow is included in the commodity rate for load. When two scanners are being used, (one for GATES capture/ one for ICODES capture), only occurs when requested by the Govt for an ICODES separate scan capture, the labor using the separate ICODES scanner would be compensated by utilizing XL labor rates.

6 6.15.1

Sec 6.15.1 States that the contractor shall designate the locations where cars are to be delivered. Can you please clarify this requirement and provide the determining factors that are to be used? How will compensation be made for this service?

The Contractor will determine what track lines they want specific type of cars to be pushed in by the railroad company based on Contractor’s plan for load.

No separate compensation will be provided, this should be considered as part of the Contractors' overhead for management. The Government will provide information on what cars are due to arrive;

the Contractor will state they want commercial cars on ‘x’ line; DODX 40s on ‘x’ line, wooden decks on ‘x’ line etc. There are 8 track lines, 4 with fixed ramp, and 3 storage lines that are not operation capable.

7 6.23.3 Sec 6.23.3 discusses damages and the stevedores responsibility. Given that ASLAC often does not report damages until after cargo is in their yard sometimes days after its initial discharge, will ALSAC be required to report and show damages prior to onward movement?

YES- any damage from IMPORT discharge cargo MUST be reported for joint inspection prior to cargo departing Wharf A compound for ASLAC yard in Goose Creek.

8 Defenitions

The definition of cargo class 45 is exceptionally broad and expansive. It includes many cargoes that require very little manning or equipment as well as cargoes that could require additional equipment and manning to safely perform the required action. It is unreasonable to expect that containers (as defined in the PWS) or commercial flatracks be classified as class 45 cargo. Can this definition be made more concise or can a separate rate class for containers/commercial flat racks be included?

Upon review, the PWS will remain as posted.

Given that travel time from the main gate to Wharf A is between 15 and 20 minutes, 4 times per day, isn’t this excessive to expect this to be included in the commodity rate. Can travel time for ops at Wharf A be reconsidered under manhour rates?

NO- Travel time from GATE 4 to Wharf A location is on average 10 minutes, distance is 4 miles from ILA park lot to trestle at Wharf A. The GOV rule is contractor absorbs 15 MIN of standby /delay/detention time. It is the contractor’s responsibility to have workforce in place on time for start. Movement of personnel to /from a work site is a contractor responsibility. During occasions when the guard gate purposefully obstructs gate traffic causing undue delay which affects base traffic and ILA movement; this time is given consideration for detention.

14 General Have any agreements with the International Longshoremen's Association, and the current contractor been made outside of the existing collective bargaining agreement.

The Government is not involved with agreements between the Stevedores and the union.

15 Defenitions

Direct Billing was referenced during the pre-bid conference and is defined in the glossary of the PWS. Is Direct billing to an Ocean Carrier by the stevedore legally acceptable for work performed at Joint Base Charleston as we are contracted with the SDDC? What assurances do we have that payment will be recieved for services rendered when we hold no contracts with the carriers for work to be performed under this S&RTS contract?

invoice Ocean Carrier for Other Ports Cargo (OPC). If no payment from Ocean Carrier, notify COR and Contracting Officer of Ocean Carriers refusal to pay, IAW FAR 52.233-1 Disputes.

16 General

We would also like to ask if a due date extension can be granted given that the answers to questions concerning the PWS are not available yet. Additionally with the due date following a holiday there could be potential package delivery issues.

Proposal due date has been extended to Monday, 20 Oct 14.
