Consensus Audit Guidelines (CAG)

1. DESCRIPTION OF SERVICES

1.1. Scope of Contract. The contractor shall provide international commercial air cargo CAT A service for less than full pallet loads (non 463L palletized) to users authorized by United States Transportation Command (USTRANSCOM). CAT A service includes time-definite, door-to-door pick-up and delivery, transportation, Intransit Visibility (ITV), Government-Approved Third Party Payment System participation, and expedited customs processing and clearance of less than full pallet loads. It also includes the movement of hazardous, refrigerated/cold chain (perishable), life and death, oversized, and general cargo shipments. Definitions are provided in Appendix 6.1.

1.1.1. Service is required from Continental United States (CONUS) to Outside Continental United States (OCONUS), OCONUS to CONUS (retrograde routes), and OCONUS to OCONUS locations (lateral routes).

1.1.2. This contract is a limited source for the Department of Defense (DoD). DoD agencies/organizations must be approved and validated by USTRANSCOM J3 to use this contract. Approved/validated users are identified in Appendix 6.2.

1.1.3. DoD agencies/organizations not specifically identified in Appendix 6.2 may become mandatory users of the contract with approval/validation by USTRANSCOM J3. New users shall submit their requirements to TCAQ and the HQ AMC/A4TC Program Management Office for incorporation into the contract via bi-lateral modification. Ordering procedures are specified in Appendix 6.3.

1.2. CENTCOM Safety and Audit Oversight Program.

1.2.1. In order to provide service to a Central Command (CENTCOM) Area of Responsibility (AOR) location, the Civil Reserve Air Fleet (CRAF) carrier (prime contractor) is required to complete a safety and audit oversight program on all subcontracted air carriers that operate into or out of a military-controlled FOB/FOL airfield. This section does not apply to operations into or out of civilian-controlled airfields without a joint-use military presence where air carrier operations are governed by the applicable country Civil Aviation Authority (CAA) requirements. As a minimum, the contractor shall comply with the technical requirements identified in the attached CAT A Safety and Audit Oversight Checklist (Appendix 6.4). In addition, the prime contractor shall not use carriers listed on the European Banned Carrier Listing at http://ec.europa.eu/transport/air-ban/list_en.htm, the Excluded Parties Listing at https://www.epls.gov, and the Department of Treasury: Office of Foreign Assets Control, Special Designated Listing at http://www.ustreas.gov/offices/enforcement/ofac/sdn/.

1.2.1.1. If the contractor will utilize a subcontractor to perform any portion of the airlift requirement within the CENTCOM AOR, the contractor shall assess the level of safety for each subcontractor. This assessment will be based upon a safety audit performed by the contractor or an independent International Air Transport Association (IATA) accredited 3rd party audit organization. Air Mobility Command (AMC/A3B) approved US-flag or foreign flag subcontractors are exempt from the audit as long as they remain on the AMC/A3B DoD-approved carrier listing. The Government retains the right to request copies of all completed audit reports.

1.2.1.2. Following completion of each safety audit, the contractor shall issue a “Statement of Compliance” to the contracting officer affirming each subcontractor complies with the technical requirements of paragraph 1.2 and that the contractor accepts responsibility for the safety audit.

This certificate is valid for 24 months. The contractor shall develop a subcontractor audit program that provides for an onsite audit of subcontractors at least every 24 months in order to issue subsequent “Statements of Compliance.” The contractor may use subcontractors with pre-existing audits completed to satisfy other USTRANSCOM contract requirements until the audit becomes invalid.

1.2.2. The contractor shall complete all safety and audit requirements for applicable subcontractors prior to permitting the subcontractor to provide service into or out of military-controlled FOB/FOL airfields.

Within 30 days after contract award, the contractor shall provide the Contracting Officer a complete MS- Excel spreadsheet listing of all foreign flag subcontractors used in performance of this contract. The contractor shall provide an updated listing within five business days any time a foreign flag subcontractor is added or dropped from the contractor’s service providing network. The information shall include the carrier’s name, aircraft type, aircraft registration number, aircraft country of operating certificate, the date of the last audit, the date the Statement of Compliance was submitted on the subcontractor, and the contract number for which the audit and Statement of Compliance were originally submitted. Any subcontractor changes will require the prime contractor to complete the safety and audit oversight requirements prior to using a new subcontractor.

1.2.2.1. The United States Air Forces Central Command (USAFCENT) Safety office may conduct periodic on-site audits per carrier. The carrier and subcontractors shall be available to accomplish the on-site audit.

1.2.3. Incident Reporting.

1.2.3.1. The contractor shall take all appropriate measures to prevent air, surface, and ground safety incidents. In the event of an air, surface, or ground safety incident within the CENTCOM AOR, the contractor shall immediately notify the CENTCOM Deployment and Distribution Operations Center (CDDOC) (Tel: 011-965-2389-5217), the Contracting Officer at (618) 220- 6715, and the Program Manager at (618) 229-4591. The contractor shall state their name, which contractor they represent, incident type, incident location, aircraft or vehicle type, aircraft tail number, and incident time (Zulu).

1.2.3.2. The contractor shall provide email notification to the Contracting Officer at scott.amos@ustranscom.mil and the Program Manager at amc.a4tt@amc.mil, providing the circumstances surrounding the incident to include copies of cargo manifests within 12 hours.

1.2.4. Aircraft Recovery Process.

1.2.4.1. Within 12 hours, the contractor shall provide an aircraft recovery plan identifying their process to repair and remove the aircraft. The contractor shall provide daily status information to the Senior Airfield Authority, Contracting Officer, and Program Manager on the progress to repair/remove the aircraft.

1.2.4.2. The Government reserves the right to move the aircraft, at any time, off the active runway, taxiway or parking spot to another area as operational requirements dictate. The contractor shall be charged associated costs for movement of the aircraft.

1.3. Basic Service. The contractor shall provide international commercial air cargo less than full pallet load, door-to-door service to and from locations listed in each Contract Line Item Number (CLIN) and Sub-Line Item Number (SLIN) included at Attachment 2, CLIN Matrix. Service is required Monday through Friday, except holidays, including those holidays specific to international countries, as applicable. Pick-up shall be within 24-hours of notification except as otherwise stated in subsequent paragraphs. Required delivery times are noted in the individual CLIN or SLIN as specified in Attachment 2.

1.3.1. The contractor shall provide safe transportation, protection, accountability, and timely delivery of Government cargo in accordance with applicable Federal Aviation Regulations and the provisions of this contract.

1.3.2. The contractor shall be responsible for aircraft load planning, weight and balance, loading/off loading, secure fastening, and any required special handling. Cargo may include hazardous material (HAZMAT) Classes 1 through 9 as defined in the International Air Transportation Association (IATA) Dangerous Goods Regulation. At locations where the Government has operational responsibilities and representatives to load/unload the aircraft, the Government or it is contracted agency will be responsible for loading/unloading the aircraft.

1.3.3. At point of pickup and delivery Consignor may load and Consignee may unload the carrier’s vehicle. At a minimum, the Consignor and Consignee must be available for pickup and delivery of the cargo.

1.3.4. The contractor shall assign account numbers to all shippers and/or shipping locations, if one does not already exist.

1.3.5. Prepayment or collect charges from the consignee is not allowed.

1.3.6. The contractor shall comply with all local laws.

1.4. Cargo Acceptability and Special Cargo.

1.4.1. The contractor shall transport general merchandise, goods, wares, and products of all kinds, unless otherwise excluded by contractor's regulations, and provided:

1.4.1.1. The transportation, or the exportation or importation thereof, is not prohibited by the laws or regulations of any country to be flown from, to, into, or over.

1.4.1.2. They are packed in a manner suitable for carriage by aircraft.

1.4.1.3. They are accompanied by the requisite shipping documents, and they are not likely to endanger aircraft, persons or property, or cause annoyance to passengers or crew.

1.4.2. Goods Acceptable Only Under Prescribed Conditions. The following goods are acceptable for carriage:

1.4.2.1. Oversized Cargo. Air cargo exceeding the usable dimensions of a commercial unit load device (e.g., 88”W x 125”L x 60” H pallet). The dimensions may vary based on the type of cargo and usually requires the use of multiple pallet positions.

1.4.2.2. Perishables. The contractor shall add wet or dry ice to material and repack once the package has reached, but not exceeded, its expiration time and date.

1.4.2.3. Unusual Shipments. With CO approval, contractor may refuse cargo of extreme length, unusual shape or excessive weight for transportation unless handling arrangements have been previously made.

1.4.2.4. Hazardous Cargo Shipments. All hazardous materials will be in air authorized packaging and meet the type and/or quantity restrictions for cargo only aircraft and packaged, prepared, marked/labeled and certified in accordance with the IATA, Dangerous Goods Regulations.

1.5. CAT A Cargo. The following applies to CAT A cargo:

1.5.1. When applicable, dimensional weight shall be calculated by the contractor using the following formula:

1.5.1.1. International Shipments: Length x Width x Height divided by 139 equals dimensional weight (all measurements in inches). The contractor shall charge the greater amount of the actual weight or the dimensional weight.

1.5.1.2 Domestic Shipments (CONUS to Alaska and Hawaii): Length x Width x Height divided by 166 equals dimensional weight (all measurements in inches). The contractor shall charge the greater amount of the actual weight or the dimensional weight.

1.5.1.3. If the shipper does not indicate the shipping weight, the contractor shall weigh the item and annotate the weight. If the shipment weight listed on the order is different from the actual weight (e.g., as a result of reweigh or dimensional weight, or no weight was initially identified), the contractor shall indicate on the billing documents submitted to the paying activity those shipments that have been adjusted.

1.5.1.4. All weights and measures in the CAT A Contract shall be in pounds and inches.

1.5.2. Accessorial Service. Any proposed contractor accessorial charges not identified on the Schedule of Services/Supplies shall be submitted and approved by the CAT A shipper’s office prior to accepting cargo for shipment. In the event of a dispute between the shipper’s office and the contractor regarding an accessorial charge, the Contracting Officer will review the situation and render a Contracting Officer's decision. Further, unless otherwise stated, it is presumed all accessorial service not specifically identified and priced separately on the Schedule of Services/Supplies are included in the basic service contract price.

1.6. NAVSUP WSS Weapon System Support CAT A Cargo Unique Requirements.

1.6.1. The contractor shall provide an interface with the Navy’s Electronic Retrograde Management System (eRMS) as required in Appendix 6.5. This interface will allow eRMS to pass a URL containing the Tracking Number to access the contractor’s website and obtain and display Proof of Delivery (POD) information to the user. The contractor shall provide eRMS with the URL required for this interface.

1.6.1.1. The contractor shall provide the information required within Appendix 6.5 within one day of delivering material and obtaining POD signature. The POD information shall be sent to a designated file via Secure File Transfer Protocol (SFTP).

1.6.1.2. Development and execution of POD transaction sets within the scope of the contract shall be agreed upon by the NAVSUP WSS Retrograde Program Office. A Secure File Gateway (SFG) worksheet shall be completed and submitted to the NAVSUP WSS Retrograde Program Office before the FTP process of sending POD transaction sets will be authorized. The information required to provide on the SFG worksheet is listed on Appendix 6.6. Failure to accurately and timely send POD transaction sets will be reason to reduce or eliminate the partnership between the contractor and NAVSUP WSS.

1.6.1.3. Contractors must demonstrate, within 60 days of award, the capability to transmit data via eRMS. This capability will be validated by the Government before any shipments are tendered.

1.6.2. The contractor shall pick-up all shipments within 24 hours of notification. The day of pick-up does count, and there is no exception for weekends and holidays when calculating transit time.

1.7 United States Army Medical Material Center, Europe (USAMMCE) and United States Army Medical Materiel Center-Southwest Asia (USAMMC-SWA ) Class VIII medical CAT A Unique Requirements.

1.7.1. Cargo Pick-up Requirements.

1.7.1.1. The contractor shall pick-up all shipments within 24 hours of notification. The day of pick-up does count and there is no exception for weekends and holidays when calculating transit time.

1.7.1.2. The contractor shall be available to pick-up shipments 365 days a year, 24 hours a day.

1.7.1.3. The contractor shall provide USAMMCE and USAMMC-SWA a 24-hour point of contact to include name, telephone number, fax number and e-mail address.

1.7.2. Cargo Delivery Requirements.

1.7.2.1. The contractor shall notify the customer within 24 hours in the event shipping delays occur in excess of the required transit times specified in Attachment 2, CLIN Matrix and provide daily updates until delivery is completed.

1.7.3. Cold Chain Management/Reefer Shipments. USAMMCE/USAMMC-SWA is responsible for preparing refrigerated and frozen materiel (e.g. blood) for shipments. The contractor shall provide a temperature-controlled environment and have the capability to re-ice shipment if required.

1.7.3.1. The contractor shall ensure the temperature for shipments prepared using wet ice procedures is maintained between 35 to 46 degrees Fahrenheit (2 to 8 degrees Celsius).

1.7.3.2. The contractor shall ensure the temperature for shipments prepared using dry ice is maintained below 32 degrees Fahrenheit (0 Celsius).

1.7.3.3. The contractor shall ensure all other shipments are maintained between 47 to 77 degrees Fahrenheit (8 to 25 degrees Celsius).

1.7.3.4. The contractor shall not place any medical supplies in direct sunlight.

1.7.3.5. The contractor shall conform to the International Civil Aviation Organization (ICAO) regulatory guidance for cold chain shipments.

1.7.4. HAZMAT Shipments. “Cargo Aircraft Only”

1.7.4.1. Examples of “Cargo Aircraft Only” HAZMAT include, but are not limited to, the following United Nation (UN) numbers: UN2924, UN1230 and UN1037.

1.7.5. Life and Death Emergency Shipments.

1.7.5.1. The contractor shall pick-up the cargo within two hours of notification. Delivery shall be within 48 hours of pick-up. For Life and Death Emergency shipments, the contractor shall arrange for shipment of the material on the next available flight.

1.7.5.2. The contractor shall provide an on board courier service. Pending the size of the package, the courier shall hand carry the material on the aircraft to prevent frustration and expedite transitions and deliveries once the aircraft has landed.

1.7.5.3. Life and Death Emergency shipments requiring cold chain service shall follow the requirements in Paragraphs 1.7.3, Cold Chain Management/Reefer Shipments, including all subparagraphs thereto.

1.7.5.4. The contractor shall provide copy of digital receipt of cargo within two hours after acceptance by the consignee.

1.8. DLA Troop Support, Medical

1.8.1. All refrigerated medical shipments need to be constantly maintained in a controlled room temperature environment, between 59 degrees F and 86 degrees F, at the carrier hub while waiting for loading on an airplane or waiting for loading onto a truck for customer delivery. Active refrigeration or repackaging is not required.

1.8.2. The contractor shall not place any medical supplies in direct sunlight.

1.9 Commercial Forms and Procedures (CF&P).

1.9.1. The contractor shall provide all commercial forms (both electronically (if available) and in hard copy form) necessary for successful contract performance.

1.9.2. Both the hardcopy Commercial Bill of Lading (CBL) and electronic CF&P shall have 20 alphanumeric spaces for the agency or organization to use.

1.9.3. Terms and conditions of the CBL are applicable to shipments moving under CBLs, CF&P, or Government Bill of Lading (GBL).

1.10. Printed Airway Bills.

1.10.1. The contractor shall provide an automated system to print airway bills or provide each vendor with pre-printed airway bills for each customer.

1.11. Delivery Attempt or Refusal.

1.11.1. Attempted Delivery. The contractor shall attempt to deliver a shipment three times before contacting the shipper for disposition instructions. Each delivery attempt shall be made on the next business day. For perishables, the contractor shall continue to verify expiration date/time and add wet or dry ice as necessary to prevent expiration until disposition is received. The contractor shall leave a notice of attempted delivery on each delivery attempt. For purposes of contract performance, delivery shall be considered accomplished on the date of the first delivery attempt. The cost of any further disposition, or additional deliveries requested by the shipper, is the responsibility of the shipper.

1.11.2. Refusal by Consignee. If a consignee refuses to accept a delivery, the contractor shall annotate refusal on the order with date, time, and name of person who refused and contact the shipper for disposition instructions. For purposes of contract performance, delivery shall be considered accomplished on the date of the first delivery attempt. Changes in address for delivery is the responsibility of the shipper and billed accordingly.

1.11.3. When authorized by the shipper on the CBL, Electronic CF&P, GBL or other government documents as approved by the Contracting Officer, the shipment shall be considered delivered when the shipment is left without signature at the front door/loading dock (location approved by shipper) of the consignee’s address.

1.12. Intransit Visibility.

1.12.1. The contractor shall provide ITV for all shipments from the date and time of pickup to the date and time of delivery. The contractor shall continue to provide ITV information when shipments are transported by their subcontractors or partners.

1.12.2. The contractor shall update ITV shipment status information each day at least the same number of times as required for commercial customers.

1.12.3. ITV information shall include as a minimum: Government-furnished Transportation Control Number (TCN) if provided, shipper’s reference number, contractor’s unique identifying CBL number, dates and times for shipment origin departure, trans-shipment points, destination arrival, proof of delivery with consignee’s name (if applicable), and delay codes (if applicable). When shipments are delivered without obtaining a signature, the ITV system shall record the exact location where the shipment was left.

1.12.4. The contractor shall provide 24-hours a day, 7-days per week ITV information via the Internet and toll free telephone service.

1.13. IDE/GTN Global Convergence (IGC) (formerly Global Transportation Network (GTN) Interface.

1.13.1. The contractor shall provide interface with the DoD's IGC as required in attached Appendix 6.7.

The contractor shall provide this information without restriction.

1.13.2. Development and execution of Electronic Data Interchange (EDI) transaction sets within the scope of the contract shall be agreed upon by the IGC Program Office, detailed and documented in the standard Military Surface Deployment and Distribution Command (SDDC) Trading Partner Agreement (TPA) prior to contract performance. TPA information can be accessed via SDDC web page at http://www.sddc.army.mil/GCD/SiteAssets/TPA_Template%20Nov11.pdf.

1.13.3. The contractor shall be capable of providing an accurate data feed to IGC in accordance with Appendix 6.7 prior to starting performance.

1.14. Pre Alert Notification

1.14.1. The contractor shall provide consignor pre-alert notification within four hours of pick-up at origin for all shipments.

1.14.2. The contractor shall provide consignee pre-alert notification at least 24 hours in advance of delivery. If delays in transit occur, a revised pre-alert notice will be sent at least 24 hours in advance of delivery to the consignee (or as soon as delay is known if less than 24 hours). The pre-alert is intended to assure access to dock space and availability of government personnel and material handling equipment.

The pre-alert should provide, at a minimum, the following information: TCN, number of pallets, weight of pallets and pieces to be delivered, date and time to be delivered, and identification of any pallet(s) containing perishable items, medical priority shipments, or other cargo requiring special handling.

1.15. Supply Chain Security. The contractor shall follow their commercial security and customs procedures to safeguard cargo against theft, loss, tampering, or damage.

1.16. Misrouted Shipments. The contractor shall notify the consignee of misrouted shipment(s). The contractor shall provide the Bill of Lading number of the misrouted shipment and the new arrival time to the customer at this time.

1.17. Contingency/Redirection/Surges. In the event of a contingency/state of war (declared or not), where the shipments are undeliverable to a location/country, the contractor shall contact the shipping office for possible redirection of shipments. The shipping office will coordinate with the appropriate government offices, agencies, and contractor to ensure proper receipt and ultimate delivery of redirected shipment to the consignees. If any such redirection causes an increase or decrease in the cost of performance, the contractor shall notify the Contracting Officer in writing as soon as practicable. During a contingency/surge, the contractor may be required to support two to three times the normal Government traffic flow and at the same level of service prior to the contingency/surge.

1.18. Reduction/Cancellation of Service. The government reserves the right to reduce and/or cancel service over specific lanes due to withdrawal of forces or other mission necessity.

1.19. Shipping Systems. In accordance with the contractor’s commercial procedures, the contractor shall provide to the government, at no additional cost, a shipping system for qualified users under this contract to prepare labels and preprinted airway bills when requested by the shipper. The shipping system shall be capable of printing shipping labels with a TCN bar-coded format and in clear text.

1.20. Customs.

1.20.1. The contractor shall provide duty-free customs clearance for all shipments. In the event that a shipment is not duty free, the contractor shall process in the same manner provided for its commercial customers and shall properly itemize as an accessorial charge on their Government-Approved Third Party Payment System invoice.

1.20.2. Customs clearance procedures and updates can be reviewed in the Defense Transportation Regulation (DTR) Part V, Department of Defense Customs/Border Clearance Policies and Procedures, which is available on the public web page at http://www.transcom.mil/j5/pt/dtr_part_v.cfm.

1.20.3. Any additional customs fees or reductions arising during the contract performance period will be substantiated with the Department of State (Embassy) and/or the foreign government involved. Upon receipt of documentation the Contracting Officer will review and make a determination on a case-by-case basis whether a rate adjustment is warranted.

1.20.4. The contractor shall serve as an agent and appoint sub-agents, as may be necessary, to act directly or through such re-delegation, appointment, or designation to other customs brokers, persons, or business concerns as it deems necessary for performance of customs clearance, and shall provide all customs forms necessary for customs clearance.

1.20.5. The contractor shall notify the shipper and consignee within 24 hours if government shipments are detained in customs.

1.20.6. The contractor shall participate in the development and testing of DoD automated customs clearance systems by providing user feedback to the Government and by inputting manifest and other shipping data to the system(s) as necessary. Upon implementation of these systems in various destination countries, the contractor shall begin using electronic customs procedures to clear cargo as indicated in DTR Part V or interim instructions issued by USTRANSCOM.

1.21. Damage or Loss.

1.21.1. The contractor shall be liable for loss, damaged, or misrouted shipments. The contractor’s liability shall be limited to the lower dollar amount of $50,000 or $9.07 per pound or the actual amount of the cargo.

1.21.2 The contractor shall provide notification to the shipper of any incident (e.g., hard landing or crash) within 24 hours and shall provide a copy of the manifest to shippers within 48 hours if available.

1.21.3. Claims shall be filed by the shipper within 30 days of receipt of the manifest (or ship date if no manifest is provided) unless the contractor’s commercial practice allows for a longer period for shippers to file claims, in which case the contractor’s commercial claim filing deadline will apply.

1.22 Invoicing/Billing/Payment.

1.22.1. Government-Approved Third Party Payment System (TPPS).

1.22.1.1. The Deputy Secretary of Defense directed the implementation of TPPS system to pay for transportation services. DoD contracts and voluntary tenders require the use of TPPS, and all DoD cargo movements must be offered only to commercial carriers who utilize TPPS as their billing and payment system.

1.22.1.2. The Government-Approved TPPS is an automated on-line payment processing and transaction tracking system that supports logistical transactions. The Government-Approved TPPS receives a transaction processing fee for every paid transaction. It consists of five primary functions: (1) electronic data transmission, (2) payment approval process, (3) electronic payment and billing, (4) communication for dispute resolution, and (5) customized data analysis.

1.22.1.3. The contractor shall have a signed Government-Approved TPPS Trading Partner Agreement in place before moving freight. Providing a signed copy of the Trading Partner Agreement or formal notification in writing/email to the Contracting Officer shall constitute verification.

1.22.1.4. The contractor shall work with each service representative and military installation to develop individual Government Approved TPPS Trading Partner Agreements. This process shall commence once contacted by the installation and/or the service representative to begin testing for accurate Government Approved TPPS billing EDI interfaces. The contractor shall coordinate with U.S. Bank, shipper, and service representative to facilitate to the maximum extent possible Government Approved TPPS implementation.

4. GENERAL INFORMATION

4.1. Administrative Service Charge. All sales of contract items to users identified in Appendix 6.2 shall incur contractor liability for payment of a 3% Administrative Service Charge (ASC).

4.1.1. The contractor shall pay USTRANSCOM a 3% ASC. The Government will develop the ASC amount by multiplying the sum of the total shipment costs, identified in the Contractor detail report (4.2.1), by 3% on a semi-annual basis. The Government will submit the ASC amount to the contractor within 30 days after the end of semi-annual period.

4.1.2. The contractor shall submit one payment for the semi-annual period. To ensure that the payment is credited properly, the contractor shall identify the check or electronic transmission as a “CAT A 3% Administrative Fee, EEIC 45416” and include the following information: contract number; report amount(s); and report period(s). If the contractor makes payment by check, they shall provide this information on either the check; check stub, or other remittance material.

4.2. Contractor Reports.

4.2.1. Detail Report. The detail report, Appendix 6.8, will be the master data source and all additional reports will be developed using this as the data source with the same reporting periods. The contractor shall submit detail reports no later than the 18th of each month for the previous month’s activity (shipments delivered during the previous month). Reports shall include monthly totals for each element.

4.2.1.1. Detail Reports are required in electronic format (Microsoft Excel 2007 or later) and, when requested, in hardcopy format. The following is a list of the submittals necessary to satisfy this requirement.

4.2.1.1.1. Shipment Information Data File (Referred to as the "Detail Report"): The Detail Report is required monthly, no later than the 18th calendar day of each month following the month of delivery. If there were NO deliveries during the reporting period, an email stating “Negative Shipment Information Report for (month/year) is hereby submitted.”

4.2.1.1.2. Assessorial Information Data File (Referred to as the "Assessorial Report"): The Assessorial Report is required monthly, no later than the 18th calendar day of each month following the month of delivery. If there were NO Accessorial charged during the reporting period, an email stating “Negative Assessorial Report for _______ (month/year) is hereby submitted.”

4.2.1.1.3. Accessorial codes Reference Data File: This file must be provided at the beginning of each contract/option year or when changes are made to the codes and/or their corresponding descriptions.

4.2.2. The contractor shall submit the reports required by paragraphs 4.2.1. in the format and to the recipients listed below.

4.2.2.1. E-mail Addresses. The contractor shall submit monthly reports (except census reports) to all Government email addresses specified in Appendix 6.9. Monthly census reports shall be submitted to only the Contracting Officer and Contract Specialist identified in Appendix 6.9. If the file(s) are unable to be distributed via email, the contractor shall follow the Electronic Reporting Instructions outlined below (PWS paragraph 4.2.3.2).

4.2.2.2. Electronic Reporting Instructions are established as a result of various Government firewalls. The following procedures are added for submitting reports via the Army Portal (Large File Transfer Page) in the event the contractor is unable to submit the required reports via email:

4.3. Regular Meetings. The Contracting Officer may request status and performance review meetings to be held at a government identified location at no additional charge. The government anticipates at least one yearly meeting and semi-annual meetings held on an as needed basis. CAT A customers shall be invited to attend status and performance review meetings. The purpose of the meetings will be to discuss contract performance and address contractor/customer concerns.

4.4. Installation Access. Each individual installation commander is responsible for establishing the rules governing installation access. Contact the installation visitor control center to determine the individual installation access requirements. The ACO will provide assistance as necessary.

4.5. Installation Security. While on military installations or on military portions of civil installations, contractor personnel shall comply with security regulations promulgated by the military installation commander. Security regulations are directive in nature and shall be adhered to by all contractor personnel. In addition, the contractor shall (consistent with their commercial procedures), provide a method to protect the integrity and proper functioning of all equipment and systems involved in the operation of this contract. Any equipment and information processing systems containing government information shall have security measures to protect against unauthorized disclosure.

4.6. Contractor Logistical Support.

4.6.1. Contractor Logistical Support. Logistical support varies by location as determined by the FOB/FOL Commander. The contractor shall comply with the FOB/FOL reimbursement procedures for contractor logistical support services rendered.

4.6.2. The contractor will be responsible to work with the local CENTCOM assigned alternate Contracting Officers Representative (COR) located at the Air Mobility Division, Al Udeid Qatar, and the USTRANSCOM Contracting Officer to comply with the Synchronized Predeployment and Operational Tracker (SPOT) requirements prior to seeking badging and contractor logistical support. Pursuant to clause 952.225-0011 Government Furnished Contractor Support (Afghanistan/Iraq) and clause KSCR1-11 Government Furnished Contractor Support (Kuwait), contractor personnel shall be provided contractor logistical support as specified in the applicable clause for the particular area where personnel may be domiciled; however, prior to approval, the contractor shall provide a letter listing each employee by location, identify the logistical support requested, and provide the supporting rationale why the contractor cannot provide the logistical support.

4.6.3. Any exceptions to the contractor logistical support identified in the clauses shall be reviewed on a case-by-case basis and shall be validated by the FOB Authorized Government Representative (AGR) and the Contracting Officer. The contractor shall provide sufficient justification to warrant additional contractor logistical support. The method of reimbursement for additional logistical support shall be determined by the Contracting Officer with the FOB AGR’s assistance.

4.7. Contractor Point of Contact. Not later than 5 calendar days after contract award, the contractor shall identify (in writing to the attention of the Contracting Officer) the name, address, and phone number of the point of contact for administrative matters.

4.8. Subcontractor Responsibility. The contractor shall determine the responsibility of its prospective subcontractors. Special factors related to performance of this contract compel the contracting officer to assist in that determination of subcontractor responsibility. These factors include critical requirements, substantial subcontracting, safety concerns, risk of terrorism and hostilities, and rapidly changing organizational forms of subcontractors that mask prior performance records and relationships with affiliated concerns. Periodically, the contracting officer shall make available to the contractor the name of potential subcontractors with questioned responsibility. These names shall be periodically updated to reflect more recent information and changing evaluations. The contractor shall not allow named entities to perform any role in performance of a task order under this contract unless it first provides written evidence to the contracting officer that affirmatively demonstrates to the contracting officer's satisfaction the responsibility of the proposed subcontractor.

5. INFORMATION ASSURANCE

5.1. Requirement for Contractor Information Assurance (IA) Report. The Contractor shall provide an Information Assurance Report to describe their environment that safeguards DOD non-public information resident on or transiting the contractor's unclassified information systems from unauthorized access and disclosure.

Protection measures applied should consider the risks (i.e. consequences and their probability) of loss, misuse, unauthorized access, or modification of information. The report shall address the SANS (SysAdmin, Audit, Network, Security) Institute's Twenty Critical Security Controls for Effective Cyber Defense: Consensus Audit Guidelines (http://www.sans.org/critical-security-controls) and be provided in accordance with the template at Appendix 6.11. The contractor is encouraged to provide additional information above and beyond what is outlined in the SANS guidelines to enhance the government’s understanding of their information security posture. The report will be updated 30 days prior to exercise of an option period, if applicable.

5.2 Cyber Security Incidents

5.2.1 Reporting Requirements. The contractor shall report to the following two Government organizations as soon as possible upon discovery of any suspected cyber intrusion events that affect DOD information resident on or transiting the contractor's unclassified information systems.

Initial report shall be provided even if some details are not yet available, with follow-on detailed reporting within 72 hours. Reportable cyber intrusion events include the following:

1. A cyber intrusion event appearing to be an advanced persistent threat

2. A cyber intrusion event involving data exfiltration or manipulation or other loss of any DOD information resident on or transiting the contractor's, or its subcontractors', unclassified information systems

3. Intrusion activities that allow unauthorized access to an unclassified information system on which DOD information is resident or transiting

Definition of advanced persistent threat: An extremely proficient, patient, determined, and capable adversary, including two or more of such adversaries working together.

5.2.2 Incident Report Content. The incident report shall include, at a minimum, the following information:

1. Applicable dates (date of suspected compromise and date of discovery)

2. Threat methodology (all known resources used such as Internet Protocol (IP) addresses, domain names, copies malware, etc.)

3. An account of what actions the threat(s) may have taken on the victim system/network and what information may have been accessed

4. A description of the roles and functions of the threat-accessed system

5. An initial list of potentially impacted government programs and each program’s classification

6. What information may have been exfiltrated that may impact government programs

7. A list of all employees and subcontracted employees who work or have worked with the victim system/network

8. A point of contact to coordinate damage assessment activities

5.2.3 Incident Report Submission. The contractor will submit unclassified network cyber incident reports to the USTRANSCOM Technical Information Analysis Center (TIAC) and USTRANSCOM designated government personnel via encrypted email or another mutually agreed upon secure communications method. Copies of malware require special handling and pre-coordination must be accomplished prior to submission.
