PART I - THE SCHEDULE

SECTION F - DELIVERIES OR PERFORMANCE

1. PERIOD OF PERFORMANCE

a. Performance of this contract shall begin 01 October 2007, or the date of award, whichever occurs later. It shall continue through 30 September 2008 unless sooner terminated or extended by the Government under the provisions of this contract. All flights in progress at midnight of the last day of the contract shall not be affected by the expiration of this contract.

b. During performance of this contract, there may be a declaration of an airlift emergency or national emergency, or the CRAF may be activated, as described in Appendix 5. In such event, the Government may give notice to the Contractor to extend this contract for the purposes of ordering additional airlift services throughout the period of the emergency. In addition, the Contractor’s commitment to the CRAF program will be extended for the entire period of CRAF activation, and for up to six months thereafter.

2. SCHEDULES

a. For the purposes of this paragraph "Schedules" shall mean the detailed arrangements regarding the date and time of day of the flight operation required to perform the air transportation services called for under this contract.

To the extent such schedules are not specified in this contract, they shall be established by agreement between the Contractor and the CO or the Contracting Officer’s Representative (COR) in accordance with the provisions of this paragraph. Scheduling for missions will be accomplished by TACC.

b. Schedule Formation and Coordination.

(1) Fixed award cargo trips.

AMC will provide proposed schedules for Contractor coordination at the conclusion of negotiations (approximately 30 calendar days prior to the month of operation). Contractor shall provide the following in writing to appropriate planner/planning directorate in TACC within three (3) working days after verbal or other notification of the proposed AMC schedule;

(a) confirmation of proposed schedule; or

(b) a proposed alternative schedule.

(2) Fixed award passenger trips.

AMC will provide proposed schedules for Contractor coordination at the conclusion of negotiations (approximately 90 calendar days prior to the month of operation.) Contractor shall provide the following in writing to appropriate planner/planning directorate in TACC within three (3) working days after verbal or other notification of the proposed AMC schedule;

(a) confirmation of proposed schedule; or

(b) a proposed alternative schedule.

(3) Expansion Requirements.

All trips ordered under peacetime expansion provisions will be scheduled no later than 72 hours after notice of order; require confirmation within 24 hours, and will be ordered in accordance with Section H, paragraph 19.

However, for quarterly expansion requirements, schedules should be provided within an estimated 5-7 workdays after notice and confirmed within 5-7 days.

STEP 2 - If the percentage of commercial revenue computed in Step 1 above is 60% or higher, the 60/40 rule has been satisfied and no further action will be taken. If the percentage of commercial revenue computed in Step 1 above is less than 60%, that amount is subtracted from 60% to arrive at the percentage of reduction to be taken.

In this case - 60% (required to be commercial) minus 47% (actual commercial percentage) = 13% reduction to be taken.

NOTE: An offeror who feels extenuating circumstances contributed to the failure to meet the 60/40 rule may make a request to the CO for waiver. The request for waiver shall provide sufficient justification to support failure to meet the 60/40 requirement. The CO will review any such requests on a case-by-case basis and make a recommendation to the Acting Director, Acquisition, who will make a determination, which shall be final.

(d) Past Performance. Past performance will be evaluated for all requirements of this solicitation. Past performance for passenger and cargo requirements (except for CAT A cargo) will be evaluated as follows:

(1) The Government will make an assessment of performance confidence based on a review of the contractor’s relevant past performance history. Data for the period 1 Oct 05 through 30 Sep 06 will be evaluated along with any relevant performance information under current airlift contracts (1 Oct 06 – 31 Jan 07). A one-year (1 Oct 04 through 30 Sep 05 or 1 Oct 03 through 30 Sep 04) previous contract period will be used to evaluate contractors that did not participate in the FY07 international airlift contracts. Contractors may provide additional information regarding any problems encountered on current and previous AMC contracts and describe the corrective actions.

(2) The past performance evaluation will result in one of the following ratings: High Confidence, Significant Confidence, Satisfactory Confidence, Unknown Confidence, Little Confidence, or No Confidence. Contractors who have not participated in an international airlift contract will receive a rating of Unknown Confidence. If a contractor receives a rating of Little or No Confidence, they may be evaluated further to determine performance on specific routes. Contractors with ratings of Little or No Confidence on specific routes may be denied award of repeat business on those routes. If an alternate route cannot be awarded, the contractor may not receive its full entitlement and may reduce its aircraft commitment to the CRAF program to a level equal to its fixed award, but not below minimum requirements specified in this Section, paragraph 3(e). If the contractor’s entitlement is based on the aggregate commitment of a team, the team may reduce its commitment to a level equal to its fixed award. If the contractor or team decides to not reduce its commitment, entitlement to expansion business will remain proportionate to the commitment even though the contractor or team may not receive their full entitlement for fixed business.

The following criteria are used for specific ratings included in the Contractor Performance Assessment Reporting System (CPARS). CPARS forms the basis for the above ratings:

Quality of Product or Service (Violations): Schedule (Reliability):

Exceptional – 0 -.9% Exceptional – 97-100% Very Good – 1-3% Very Good – 90-96% Satisfactory – 3.1-5% Satisfactory – 85-89% Marginal – 5.1-7% Marginal – 80-84% Unsatisfactory - > 7% Unsatisfactory - < 79%

Deficit Traffic:

Cargo: Passenger:

Exceptional – 0 Exceptional – 0 Very Good – 1-2 Very Good – 1 Satisfactory – 3-4 Satisfactory – 2 Marginal – 5-6 Marginal – 3 Unsatisfactory - >6 Unsatisfactory - >3

Fuel Reports: Cancellations/Extended Aircraft Non-Availability:

Exceptional – 100% Exceptional – 0% Very Good – 80-99% Very Good –<1%
