E.2 ACCEPTANCE AND APPROVAL OF DATA
(a) All contract data deliverables shall be reviewed by the Coast Guard for various purposes including progress monitoring, quality checks (random and systematic) and to ensure the Coast Guard has a reasonable expectation of the contractor meeting the contract requirements. Deliverables may be returned with comments, recommendations or with advisory notes concerning contract compliance.
(b) Final approval and/or acceptance of documentation required herein shall be by letter of approval and/or acceptance from the Contracting Officer. Any letter of acknowledgment of receipt of material shall not be construed as a waiver of review or as an acknowledgment that the material is in conformance with the contract.
(c) For all deliverables that require Government acceptance, the USCG may provide a response that indicates acceptance or rejection and may provide comments.
(d) For all deliverables that require Government approval, where a deliverable is submitted for approval, it is intended that only that work which is critically dependent on that approval shall not proceed until notification of approval is received. The Contractor may request a waiver from the USCG to continue work should the Contractor consider it necessary, and the USCG shall respond granting/denying the waiver request within seven (7) calendar days of receipt. (f) Prior to submission, all deliverables subject to Government approval/acceptance shall be clearly marked by the Contractor to indicate that the submission has not been approved or accepted. Subsequent to Government approval/acceptance, the data deliverable shall be clearly marked by the Contractor to clearly indicate the date of Government approval/acceptance.
(g) Approval of design deliverables shall not relieve the Contractor from meeting the contract requirements including, but not limited to, performance and testing requirements.
(h) Any data deliverable may be rejected if it (1) contains inappropriate legends or restrictive notations or (2) it is incomplete that the Coast Guard does not believe that it provides a reasonable basis for review.

The Contractor shall be responsible for all equipment testing prior to delivery to the USCG. The USCG shall perform all testing in accordance with the Contractor developed test plans and procedures. (a) When authorized in writing by the cognizant Contract Administration Office (CAO), the Contractor shall ship with a Certificate of Conformance any supplies for which the contract would otherwise require inspection at source. In no case shall the Government’s right to inspect supplies under the inspection provisions of this contract be prejudiced. Shipments of such supplies shall not be made under this contract until use of the Certificate of Conformance has been authorized in writing by the CAO, or inspection and acceptance have occurred.
(b) The Contractor’s signed certificate shall be attached to or included on the top copy of the inspection or receiving report distributed to the payment office or attached to the CAO copy when contract administration (Block 10 of the DD Form 250) is performed by the Defense Contract Administration Services. (b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding:
(1) five (5) calendar days for delivery of the award through the ordinary mail, or
(2) one (1) working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date; the offer shall be considered nonresponsive and rejected.
