“H92240-18-T-0009” in the subject line at the following address: NSWK2@socom.mil

(3) Comprehensive responses to the requirements of this Request for Quote (RFQ) are required to enable the

Government to evaluate the Quoter’s understanding of, capability and approaches to accomplish the stated requirements. Quotes shall be submitted in accordance with the instructions herein, and non-conformance with the specified required content may be cause for rejection of the quote. The quote shall be valid for no mailto:NSWK2@socom.mil less than 120 days from the date of RFQ closing, a statement affirming this fact shall be included in the

Introduction. The quote shall provide comprehensive responses to the areas provided for in this section. The quote shall be a complete response to the Attachment 1 - Performance Work Statement and the requirements of this RFQ, taking into consideration required quantities and delivery schedules specified in this solicitation.

(4) Quoters must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale in their quote.

(5) Proposals are due 15 May 2018 at 9:00 AM Eastern, within the government’s email inbox identified.

Email is the only acceptable method of proposal submission. Proposals shall be submitted to

NSWK2@socom.mil

(n) Proposal Format and Content. Electronic proposals shall address the sections listed below in separate files for each volume. Individual emails may not exceed 10 MB. Submissions with .zip files are not acceptable and will not be delivered by the government email server. The government server does not generate rejection notices and it may not forward a file if quarantined by the edge device. As such it is the vendor’s responsibility to ensure its proposal is received in the Government's identified email inbox. The proposal page format will be 8 1/2” x 11” except for fold-outs used for charts, tables, or diagrams, which may not exceed 11” x 17”. A page is defined as one face of a sheet of paper containing information. Type shall not be less than 10 pitch. Elaborate formats or color presentations are not desired or required. PAGES SUBMITTED IN EXCESS OF THE PAGE LIMIT WILL NOT BE EVALUATED.

THE PAGE LIMITATIONS APPLY TO BOTH THE INITIAL OFFER AND THE FINAL PROPOSAL

REVISION (IF APPLICABLE). Page limitations are as follows; the 25 page limit on the Technical Approach does not include resumes or letters of intent.

Section Page Limit

Administrative Information None

Technical Approach 25 pages

Corporate Experience 10 pages

Price Quote None

(1) ADMINISTRATIVE INFORMATION SECTION: Complete business address of the Offeror, the corporate name to be used on any resultant contract, and the remittance address if different from that above. If this name does not identify a "parent company" or sponsoring "corporation" name, also provide such identity, as appropriate.

(1) The Offeror’s Commercial and Government Entity (CAGE) Code and Dun & Bradstreet (DUNs)

Number.

(2) Name, telephone numbers and e-mail address of person(s) to be contacted for clarification or questions to the quote.

(3) Fill-In Clauses: Offeror must be registered in the System for Award Management (SAM) with completed FAR and DFARS representations and certifications to be eligible for consideration for award. Quoter must also contain any solicitation fill-ins.

(4) Terms and Conditions: The Offeror must include a statement that it either (a) agrees to the terms and conditions of this solicitation (which consists of the entire RFQ, including all documents, exhibits, and other attachments that are incorporated therein by reference and made a part thereof) and any solicitation amendments; or (b) takes exceptions to any terms or conditions of the solicitation, and clearly identifies those exceptions. Exceptions to any of the terms and conditions of this RFQ may be considered by the Government to be unacceptable.

(5) Specific Quote validity period.

(2) TECHNICAL APPROACH SECTION: Due to performance period requirements quotes which do not demonstrate the required facility clearance will NOT be further evaluated. The Offeror must have an active

SECRET FCL at the time of quote submission. The quote must address any FOCI issues or concerns as indicated in the National Industrial Security Program Operating Manual (NISPOM) that has not been properly negated. Quotes from vendors that do not Pass this subfactor will not be further evaluated and will be considered NOT to have met the technical requirements.

The offeror shall also demonstrate a technical understanding and provide a detailed approach to providing all requirements covered in the PWS and the solicitation. Offerors shall clearly communicate “how” they are going to meet each individual functional and performance requirement indicated in the Government PWS.

Failure to address every requirement may render the offeror’s submission as not responsive and simply restating the requirement may be sufficient grounds to remove the offeror from the competition. Resumes shall be submitted with letters of commitment for any proposed key personnel not currently employed by the offeror, its teaming partners, and or subcontractors. Key Personnel identified in clause 5652.237-9001 should possess an active Secret personnel security clearance and be eligible with a favorable adjudication for access at the Secret level. Offeror shall submit personnel clearance level information for the key personnel proposed.

(Letter of commitment does not count against the 2-page limit on resumes, and the letters and resumes do not count against the 25-page total limit for Technical.)

(3) CORPORATE EXPERIENCE SECTION: Offeror shall provide sufficiently detailed information for it to demonstrate that it has at least two years of substantive and recent experience (within the last three years) delivering the same type of software solution as is required in this solicitation; and have resources available to enable the offeror to fulfill requirements.

(4) PRICE SECTION: The price section is not page limited; however, the price proposal is to be strictly limited to price information. Upon examination of the initial offers, the contracting officer will review this documentation and if, in the contracting officer’s opinion, adequate price competition exists, no additional cost information will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness of the price.

(i) The Offeror shall populate Attachment 2, in Excel format, to include fully burdened rates including profit. There is no page limit to this volume. The government may require additional

“other than cost and pricing data” prior to award.

In order to calculate a Total Evaluated Price (TEP) for each Offeror, the Government will multiply the Offeror’s proposed rates for the ELINs by estimated quantities. Then the ELINs totals will be added together to produce a TEP for the Government to evaluate.

** Please note that IAW FAR 52.212-1(g), The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. **

CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate quotes are in descending order of importance:

Technical Capability: The quote will be evaluated to ensure the Quoter demonstrates a technical understanding and provides a detailed apIproach to providing all requirements covered in the PWS. The government will evaluate the quoter’s Technical Capability on how well it demonstrates that it can meet or exceed the governments requirements. Resumes will be evaluated on how well they demonstrate that the key personnel proposed possess the relevant knowledge and experience to perform the tasks detailed in the

PWS.

Corporate Experience: Offerors are expected to have at least two years of substantive and recent experience (within the last three years) experience in providing the same or similar types of software solution as is required in this solicitation.

Price: Price: The evaluated price will be determined using the data supplied by the vendor when completing Attachment 2. Specifically, the Government will calculate a total evaluated price using the following methodology:

annual net total price for each year of the 5-year ordering period will be calculated by multiplying the estimated quantities (provided by the Government) by the unit prices submitted in response to this solicitation.

-month option period discussed in FAR 52.217-8, an option net total will be calculated by multiplying the estimated quantities by the ELIN price of the 5th ordering year. Evaluation of the option price shall not obligate the Government to exercise the option. If the option period is exercised, it will be exercised at the ELIN prices specified in the immediate preceding ordering period.

the offeror's total evaluated price

Should competition results prove inadequate to satisfy requirement to perform price analysis, per FAR 13.106-2 other than certified cost or pricing data maybe required to establish reasonableness of the otherwise successful offeror’s price.

Technical Capability is more important than Corporate Experience. Technical Capability and Corporate Experience, when combined, are significantly more important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options, including the timeframe associated with 52.217-8, to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (NOV 2017)

(1) [ ___ ] Are, [ ___ ] are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals

Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
