About this file
This is a General Conditions document for Public Works contracts issued by Winnebago County Facilities and Property Management Department, applicable to the Wittman Airport Control Tower Chiller Replacement project in Wisconsin. The document establishes comprehensive contractual frameworks governing the relationship between Winnebago County (Owner) and the selected contractor, including requirements for independent contractor status, personnel management, subcontractor compliance, and safety protocols. Key project requirements include mandatory compliance with Winnebago County safety policies and OSHA standards, prohibition of asbestos and PCB materials, submission of affidavits certifying material compliance, and adherence to the county's Construction and Tree Preservation policy. A preconstruction conference must be scheduled with the Winnebago County Facilities and Property Management Department (920-236-4788) prior to work commencement, with contractors required to submit written clarification requests no later than 15 days before work begins. The contract requires contractors to have a minimum of five years' experience in the specific construction type and maintain proper licensing in the jurisdiction.
Payment terms provide for partial monthly payments based on certified estimates with a five percent (5%) retainage until 50 percent project completion, with full retainage applied until final acceptance of all work. As a Wisconsin tax-exempt municipal corporation under Wisconsin Statute 77.54(9a), Winnebago County permits contractors to purchase materials directly without sales tax when materials exceed $5,000 from a single supplier. The contract requires submission of Applications for Payment in triplicate using notarized AIA Document G702 with AIA Document G703 continuation sheets. The Owner retains authority to terminate the contract with 30 days' written notice for failure to fulfill obligations, and contractors are liable for liquidated damages of $1,000 per calendar day for failure to achieve Substantial Completion within the contract timeline, excluding excusable delays. Final payment requires submission of lien waivers from all subcontractors, suppliers, and vendors, along with Contractor's Release and Waiver of Lien, and is issued no later than 30 days after issuance of the final Certificate for Payment.
