About this file
This document is an Equal Employment Opportunity (EEO) certification form (CM 32-34) established by the U.S. Department of Labor and required for federal contracts and subcontracts. The form requires bidders to certify whether they have previously participated in contracts or subcontracts subject to the equal opportunity clause under Executive Orders 10925, 11114, or 11246, and whether they have filed all required reports with the Joint Reporting Committee, the Director of the Office of Federal Contract Compliance, or other relevant federal contracting agencies. The certification must be executed by the company and signed by an authorized representative with the date of execution. This form is applicable to the Minnesota state and local contract opportunity for upgrading traffic management systems, ITS, CCTV, and fiber optic cable.
The certification is required only for contracts and subcontracts that are exempt from the equal opportunity clause, generally those valued at $10,000 or under, as specified in 41 CFR 60-1.5. Bidders and proposed subcontractors who have participated in previous covered contracts but failed to file required reports are prohibited from contract award unless they submit the delinquent reports or reports for a period specified by the Federal Highway Administration or the Director of the Office of Federal Contract Compliance. Currently, Standard Form 100 (EEO-1) is the only report required under the Executive Orders and their implementing regulations.
