About this file

This is a Small Business Enterprise (SBE) Regular Dealer/Distributor Affirmation Form used by Metro to establish eligibility criteria and verify compliance for SBE participation in contract opportunities. The form serves as a preliminary counting determination tool to assess whether an SBE qualifies for either 60 percent credit (as a regular dealer) or 40 percent credit (as a distributor) based on demonstrated capacity and intent to perform. The form requires the SBE to provide detailed information including company name, total subcontract or purchase order amount, authorized representative details, and applicable NAICS codes related to items to be sold or leased. Bidders must submit a copy of their quote, commitment, contract, or purchase order demonstrating the materials the SBE will supply.

The affirmation process establishes performance requirements through a series of questions determining whether items will be provided from on-hand inventory, whether bulk or specialty items will be delivered using company-owned or long-term leased equipment, and whether written terms transfer responsibility for risk of loss or damage to the SBE at the point of origin. Regular dealers receiving 60 percent credit must provide all items from inventory or maintain at least 51 percent of items in inventory with remaining items of general character. Distributors receiving 40 percent credit must assume responsibility for items after they leave the point of origin and may accept drop-shipped items. The SBE owner and bidder's authorized representative must sign affirmations confirming the accuracy of information provided and commitment to independently negotiate prices, order quantities, and assume responsibility for item quality, including warranty claims. The bidder assumes ultimate responsibility for verifying SBE information accuracy and any shortfalls in counting methodology.

SBE FORM – 6

SBE Regular Dealer/Distributor

Affirmation Form

Metro will make a preliminary counting determination for each SBE listed as a regular dealer or distributor to assess its eligibility for 60 or 40 percent credit, respectively, of the cost of materials and supplies based on its demonstrated capacity and intent to perform as a regular dealer or distributor, as defined in the Instructions to Bidders/Proposers of the solicitation and in the Contract Compliance Manual, under the Contract at issue. A SBE regular dealer is a firm that owns (or leases) and-operates, a store, warehouse, or other establishment in which the materials, supplies, articles, or equipment of the general character described by the specifications and required under the contract are bought, kept in sufficient quantities, and regularly sold or leased to the public in the usual course of business. Items kept and regularly sold by the SBE are of the ‘‘general character’’ when they share the same material characteristics and application as the items specified by the contract. A SBE distributor is an established business that engages in the regular sale or lease of the items specified by the contract. A DBE distributor assumes responsibility for the items it purchases once they leave the point of origin (e.g., a manufacturer’s facility), making it liable for any loss or damage not covered by the carrier’s insurance. A SBE distributor may receive 40% credit for drop-shipped items. The amount of SBE credit will be made on a contract-by-contract basis. A copy of the bidder's quote, commitment, contract, or purchase order showing the materials the SBE regular dealer or distributor is supplying must be attached to this form.
