SECTION 01800 - ENVIRONMENTAL PROVISIONS

PART 1 - GENERAL

1.1

RELATED DOCUMENTS

A.

Drawings and general provisions of the Contract, including other Division 1 Specification Sections, apply to this Section.

1.2

SUMMARY

A.

This section contains administrative and procedural requirements for environmental issues.

1.3

DEFINITIONS

Operable units: Operable Units (OU) are defined as a discrete response action within a comprehensive environmental restoration program. OUs are areas that have been shown by conceptual models of contaminant sources, migrations, and receptors to require specific source control and/groundwater response actions. Maps showing the locations of the OUs on EAFB can be obtained from 28 CES/CEA office at 2125 Scott Drive, (605) 385-2677.

1.4

SUBMITTALS

A.

Storm Water Pollution Prevention Plan.

B.

Environmental Plan.

C.

Copies of waste analysis sheets for chemicals that will be turned into EAFB for disposal.

D.

Waste Inventory Sheet for wastestreams discharged to the Waste Water Treatment Plant.

E. Recycled and Reclaimed Goods Determination/Exemption forms.

STORM WATER POLLUTION PREVENTION REQUIREMENTS

A.

Permits:

1.

If the construction activities include clearing, grading, stockpiling or excavation activities which result in the disturbance of one or more acres of total land areas, the contractor shall comply with the current South Dakota General Permit for Storm Water Discharges Associated with Construction Activities. The contractor shall complete a Storm Water Pollution Prevention Plan (SWPPP) using the EPA template. The SWPPP will be submitted as a draft, draft final, and final. The contractor will address all of the Air Force comments on each submittal. Once the Air Force has an approved SWPPP and a copy of the contractor’s signed certification form, the base will submit the Notice of Intent to South Dakota Department of Environment and Natural Resources (SD DENR) to be covered under the South Dakota General Permit for Storm Water Discharges Associated with Construction Activities. No field work can be started until the base gets the letter from SD DENR stating they are covered under the permit. Failure by the contractor to comply with the above subject permit will result in work stoppage at no cost to the government.

2.

If the project will involve dewatering which will reach the waters of the state the contractor shall apply to be covered under the SD DENR General Permit to Discharge under the Surface Water Discharge System for Temporary Dewatering Activities in South Dakota.

B.

C.

Procedures: When the construction activities include clearing, grading, stockpiling or excavation activities which result in the disturbance of land cover of less than one acre the contractor shall develop a storm water pollution prevention plan for approval by the Contracting Officer. This plan shall be completed and implemented prior to the time the project breaks ground and revised (if necessary) as construction proceeds.

Stabilization will be initiated on all disturbed areas where construction activity will not occur for a period of more than 21 calendar days. The stabilization work will begin by the 14th day after construction activity has permanently or temporarily ceased.

2.

Construction Related Excavation De-watering and Hydrostatic Tests. The contractor shall follow one of the following procedures for excavation de-watering and hydrostatic testing.

a.

The contractor can apply to be covered under the General Permit to Discharge under the National Pollutant Discharge Elimination System for Construction Activities under the current South Dakota permit (The EAFB Environmental Specifications Handbook contains this general permit). (If the permit is requested for an area in an operable unit the water quality data must be forwarded to the SD DENR along with the notice of intent) b.

The contractor can discharge the water to a level area at such a rate that it infiltrates and does not run off into a road ditch, storm drain or any drainage ditch. (This cannot be used for construction activities in operable units) c.

The water can be containerized and disposed of in the Sanitary Sewer System. (For construction activities in operable units the water must first be analyzed for the contaminates of concern for the specific operable unit and the results reviewed and disposal approved by 28 CES/CEVC at 385-2680 prior to discharge to the sanitary sewer system)

3.

Road and Parking Lot Surfacing: The contractor shall be responsible for any and all releases from the construction site during road surfacing work such as, but not limited to, asphalt placement, chip sealing and concrete work. The contractor shall pay close attention to the weather forecast to ensure the effects of rain are minimized. The contractor shall have the personnel, material, and equipment available to ensure there is no release off the site into the storm drainage areas. If a release does occur, the contractor will be responsible for the clean-up.

1.6

SPILL REPORTING

A.

Permits: N/A

Licensing/Certifications: N/A

C.

Procedures: The contractor shall report any spill of oil or hazardous material in accordance with the EAFB Spill Prevention Control and Countermeasure Plan. The contractor shall take every reasonable precaution to prevent the spillage of oil or other hazardous substances. Should a spill occur, the contractor shall be totally responsible for having the material and resources on hand for the containment and clean-up of the spilled material. The contractor shall perform all sampling to verify clean-up of the spill site and ensure proper disposal of the contaminated material, as required by the Contracting Officer or the South Dakota Department of Environment and Natural

Resources (DENR). The contractor shall develop and have on site Spill Prevention, Control and Countermeasure Plan (SPCCP). The contractor shall provide a copy of the SPCCP to the Contracting Officer for review and approval prior to starting work.

1.

The contractor shall analyze all wastes suspected to be hazardous wastes as defined by the Resource Conservation and Recovery Act (RCRA). Wastes determined to be RCRA hazardous wastes will be delivered to the Hazmart at Twining Street with a copy of the waste analysis in a Department of Transportation (DOT) approved container for proper handling and disposal.

2.

The contractor shall analyze all oils and equipment suspected to be contaminated with Polychlorinated Biphenyls (PCBs). Materials contaminated with PCBs shall be turned over to the Environmental Element, 28 CES/CEANC, for proper handling and disposal, telephone 385-2674.

1.7

HAZARDOUS WASTE

A.

Permits: N/A

B.

Licensing/Certifications: N/A

C.

Procedures:

1.

The contractor shall analyze all wastes suspected to be hazardous wastes as defined by the Resource Conservation and Recovery Act (RCRA). Wastes determined to be RCRA hazardous wastes will be delivered to the Hazmart at Twining Street with a copy of the waste analysis in a Department of Transportation (DOT) approved container for proper handling and disposal.

2.

The contractor shall analyze all oils and equipment suspected to be contaminated with Polychlorinated Biphenyls (PCBs). Materials contaminated with PCBs shall be turned over to the Environmental Element, 28 CES/CEANC, for proper handling and disposal, telephone 385-2674.

1.8

DISPOSAL OF MATERIALS

A.

All materials removed under this contract, except that noted, shall be disposed of off base in such a manner that meets federal, state and local environmental codes. (NO SOIL CAN BE REMOVED OFF SITE WITHOUT FIRST CONTACTING 28 CES/CEANR, THE ENVIRONMENTAL RESTORATION ELEMENT, 385-2677).

1.9

INDUSTRIAL WASTE MANAGEMENT PROGRAM

A.

The contractor shall fill out and submit for approval a Waste Inventory Sheet prior to discharging any wastestream down an industrial or sanitary sewer drain.

1.10

CULTURAL RESOURCE PRESERVATION

A.

ARCHEOLOGICAL PRESERVATION: Should the Contractor uncover human remains or other skeletons, Native American artifacts or other archaeological resources during the course of excavation, the work shall be stopped and the Base Historic Preservation Officer in the 28CES/CEA office at 2125 Scott Drive, (605) 385-2674 and the Contracting Officer shall be notified immediately.

B.

HISTORIC BUILDING PRESERVATION: If construction activities include excavation or construction which affect any identified historic building or structure, the contractor shall consult with the Base Historic Preservation Officer. A list of identified historic buildings is maintained and available through the 28 CES/CEA office at 2125 Scott Drive, (605) 385-2674.

1.11

NATURAL RESOURCE PRESERVATION AND PROTECTION

A.

WETLANDS: If construction activities include excavation or construction in jurisdictionally delineated wetlands, the contractor shall consult with the base Natural Resource Manager in the 28 CES/CEA office at 2125 Scott Drive, (605) 385-2674. A map of delineated wetlands is maintained and available through the 28 CES/CEA office at 2125 Scott Drive, (605) 385-2674.

B.

WILDLIFE HABITAT: Construction activities including excavation or construction which has real or potential impacts to animal burrows, nests, feeding sites or other potential wildlife habitat shall be reported to the base Natural Resource Manager.

C.

LAND MANAGEMENT: Construction activities shall consider nonpoint source pollution control measures, provide for erosion control, water management, runoff disposal, landscaping and special soil problems.

ENVIRONMENTAL AWARENESS AND RESPONSIBILITY CHECKLIST

A.

If any of the environmental hazards listed on the form are encountered, the contractor shall call the telephone number shown on the form and then immediately notify the contracting officer of the situation.

B.

The Environmental Awareness and Responsibility checklist is located at the end of this specification section.

1.13

EXCAVATION ENVIRONMENTAL RESPONSE PROCEDURES

A. Purpose – Beginning when EAFB was activated in 1942, burial or dumping was an industry accepted practice often used to dispose of materials no longer needed or wanted. Accidental spills also occurred periodically. Since the mid 1980’s, EAFB environmental programs have been identifying, investigating, and remediating as necessary, waste disposal and spill sites. Unless specifically noted otherwise in the contract documents, there are no known waste disposal or spill sites that affect the specified work. However, during any grading or excavation there is the potential to uncover previously unknown waste or spilled material.

B. Unusual Material - Unusual material as used in this section shall mean any materials other than soils, rock or bedrock encountered during excavation that is not specifically identified as part of the work in the contract document. This includes but is not limited to: stained soils; free product fuels, oils, etc; suspicious odors; bottles, cans, drums, or other containers; wooden, metal, or cardboard boxes; rags, gloves, or personal protective equipment; trash or common landfill debris; concrete, concrete block, wood, metal, or other building materials and construction debris; or any other unidentified materials.

C. Response - If the contractor encounters any unusual materials during any excavation or grading, the contractors shall:

1.

Immediately stop the excavation or grading operation.

2.

Shut down the equipment and leave it in its present location.

3.

Do not attempt to determine the contents of any bottles, containers, boxes, etc.

4.

Withdraw personnel from the equipment and the excavation a distance of at least 50 feet upwind or cross wind or as directed.

5.

Contact the escort, inspector, contracting officer or the contracting officer’s designated representative immediately, or call 911.

6.

Remain in the area until released by the CO or designated representative.

D.

Every contractor and subcontractor employee shall be briefed on the response procedures in this section prior to beginning work on EAFB. Training shall be documented by the employee signing and dating a training log sheet. Log sheet shall be maintained on the immediate jobsite in the contractors project office and shall be available for inspection by the contracting officer or designated representative. Response procedures review shall be included in the contractor’s periodic safety meetings.

1.14 AFFIRMATIVE PROCUREMENT

A. Contractor shall comply with Ellsworth’s affirmative procurement program.

1. Contractor is required to purchase Environmentally Preferable Products manufactured from recycled and reclaimed goods. Environmentally preferable products are listed on the EPA’s Comprehensive Procurement Guidelines – Products (http://www.epa.gov/cpg/products.htm)

2. Exemptions to purchasing the listed products within the Comprehensive Procurements Guidelines – Products are as follows;

a. Item/Material not available within a reasonable period of time.

b. Item/Material fails to meet performance standards set forth in applicable specifications.

c. Item/Material is not available from a sufficient number of sources to maintain a satisfactory level of competition (item available from only one source)

d. Item/Material is only available at an unreasonable cost (the price of the recycled content product exceeds the cost of a comparable no-recycled product).

3. For each item considered on the Comprehensive Procurement Guidelines – Products list, contractor shall submit a materials Determination/Exemption form (provided at the end of this section) for approval.

B. Contractor shall submit a monthly diversion rate report. This report shall contain the total weight of material recovered for recycling or reuse. The report shall include the total weight of unrecoverable refuse transferred off base. All weight tickets for debris going to the landfill shall be included in the report. Report shall be submitted to the Government no later than the 7th day of the following month (i.e. report for June is due by 7 July) PART 2 - PRODUCTS (Not Applicable)

PART 3 - EXECUTION

Contractor shall comply with all provisions of Section 01800 as well as all applicable federal, state, and local laws. Contractor shall comply with all applicable Air Force regulations. Federal, state and local laws, and Air Force regulations pertaining to each environmental program are outlined in Section 8 (EAFB Environmental Engineering Guidelines) of the EAFB Environmental Specification Handbook.

ENVIRONMENTAL HAZARDS INT.

ASBESTOS: When encountering asbestos containing materials (ACM) contact the 28th CES / CEV 5-2680 for inspection and handling. Do not disturb these materials unless you have a current worker/supervisor asbestos certification. The following are a few of the common types of ACM: 9 in. floor tile and mastics, hard pipe insulation, window putty, acoustic ceilings, some caulking mastics. transite siding or piping, and felt paper.

BIRDS, PLANTS, & ANIMALS: Report animal dens with opening larger than 4 inches, large bird nests constructed with twigs larger than 1/2 inches, prairie dog towns or vegetation associated with ponds.

BONES OR ARTIFACTS: When encountering unknown bones and artifacts during digging operations cease digging and contact the environmental flight for further guidance. (28th CES / CEV call 5-2680)

CONTAMINATED SOIL OR GROUND WATER: If your project is located within one of the operable units indicated on the enclosed map consult with the environmental flight. Report any stained, sheens and smelly soils or ground water to (28th CES / CEV 5-2680) All digging requires a permit.

FLUORESCENT LIGHT BULBS: Must be handled as Hazardous Waste. Contact CEV at 5-2680 for current policy letter.

FREON: A certified refrigerant technician must perform all work on systems containing CFC refrigerants. For technical support contact (28th CES / CEO at 5-2580)

GROUND WATER: Ground water cannot be discharged to the storm water system without a permit. (28th CES / CEV at 5-2680)

LEAD: For inspection of painted surfaces, please contact (28th CES / CEV at 5-2680)

PCB: When replacing or removing florescent light fixtures read the label on the ballast, if it says that this product does not contain PCB then it can be thrown into a dumpster. If the ballast label does not say anything about PCB then it may contain PCB and should be tested or treated as a PCB. Contact the Environmental Flight for further guidance. For questions contact (28th CES / CEV at 5-2680).

SANDING/DUST: Before sanding metals and painted surfaces or working in dusty areas contact Bioenvironmental Engineering. Painted surfaces may contain lead and other heavy metals which may create a significant health hazard. Excessive concentrations of nuisance dust may cause injury to mucous membranes. Bioenvironmental Engineering can determine what personnel equipment is required to prevent a health hazard. (Call 28th MG at 5-1790)

TRASH OR WASTE: The following materials CAN NOT be deposited in a refuse dumpster: Tires, liquid paint, dry or wet cell batteries, scrap metal, any liquid waste, industrial chemicals, yard wastes, oil, hydraulic fluid, wood. For questions call 28th CES / CEV at 5-2680.
