MACC Statement of Work
SECTION 1- SUMMARY OF WORK
1.1 DESCRIPTION OF WORK
The Contractor shall provide all management, labor, material, equipment, transportation, supervision, and Architectural Engineering services (as required) to accomplish simultaneous maintenance, sustainment, repair, and minor construction projects located on the following Air Force installations: Hanscom Air Force Base (HAFB) – Bedford, MA; HAFB FAMPCAMP, Bedford, MA; Patriot Golf Course, Bedford, MA; Sagamore Hill Solar Observatory – Hamilton, MA; Fourth Cliff Recreation Annex – Humarock, MA; Cape Cod Air Force Station
– Sagamore, MA; and New Boston Air Force Station – New Boston, NH.
This Contract will be Task Order (TO) based. Each TO will include complete design documents (i.e. plans and specifications) or will consist of a Design-Build (DB) Request for Proposal (RFP).
The Contracting Officer (CO) will issue the RFP to all awardees of the Multiple Award Construction Contract (MACC) describing basic requirements for each individual TO on an as needed basis. Each TO will be awarded in accordance with RFP criteria. The Government will require prompt response and execution of TOs.
Work performed under this contract will be complex in nature, require multiple trades, and may require detailed engineering design required to be performed by registered / licensed Engineers and Architects.
1.2 WORK BY THE GOVERNMENT
The Government will not be obligated to issue any particular type of work under this contract and will reserve the right to accomplish work using Government workforces or by other contracts, as the Government deems necessary or desirable, and to do so will not breach or otherwise violate this contract.
1.3 COMMENCEMENT OF WORK
The Contractor shall be prepared to receive RFP’s at the time of contract award.
In most cases the Contractor shall be given thirty (30) calendar days to prepare a cost proposal and submit it to the Government. Under certain circumstances the Government may require a proposal in as little as fourteen
(14) calendar days. Failure to submit a proposal by the RFP due date and time will eliminate the Contractor from consideration for that TO. For more complex projects, the CO may grant additional time.
Upon award of individual TO’s, the Contractor shall submit pre-construction submittals as required by the Division 1 Specifications (Appendix 1). Notice to Proceed will not be issued until all required pre-construction submittals have been approved.
1.4 CONTRACTOR PERSONNEL
The Contractor shall employ a sufficient number of qualified personnel to adequately oversee all work under this contract. When work is being performed, the assigned superintendent or an appointed alternate shall be available at any work site within sixty (60) minutes of notification. All key management staff shall be fluent in English.
The Contractor shall submit a list of qualified personnel for Government approval at contract award. In the event of a personnel change, the Contractor shall submit a revised listing of qualified personnel for Government approval.
1.4.1 Contractor’s Contract Manager (CM): The Contract Manager shall be responsible for the overall performance of all TO’s issued to the Contractor. The contract manager shall have a minimum of fifteen
(15) years of documented applicable construction experience with a minimum of at least ten (10) years being in a relevant construction project management position. The name of this person and at least one alternate who shall act on behalf of the CM when absent, shall be designated in writing and submitted to the CO for approval. The CM will receive each RFP from the CO.
1.4.2 Contractor’s Project Manager (PM): The Contractor shall provide a Project Manager for each TO issued under this contract. The PM shall have decision-making, obligation, negotiation, and signature authority pursuant to this contract. The PM shall notify the Contracting Officer (CO) of any projected absence over two (2) days and designate a qualified replacement. The Contractor shall increase the number of PMs as necessary to ensure adequate management for all active projects. See SECTION 01 30 00 ADMINISTRATIVE REQUIREMENTS for Project Manager Qualifications.
1.4.3 Contractor’s Project Superintendent (PS): The Project Superintendent shall provide on-site supervision. The PS shall visit each active project site daily, submit detailed Construction Progress Reports for each TO, schedule and coordinate subcontractors and material suppliers and attend all status meetings, site visits and pre-final/final inspections. If for any reason the site becomes inactive, the PS shall visit the site at regular intervals to ensure site security and safety of the general public. Subcontractors shall not perform duties of the PS. The Contractor shall increase the number of PSs as necessary to ensure adequate daily supervision for all active projects. See SECTION 01 30 00 ADMINISTRATIVE REQUIREMENTS for qualifications of the Project Superintendent.
1.4.4 Contractor’s Quality Control Manager (QCM): The Quality Control Manager shall provide quality control management for all active TOs and execute the QC Plan. The QCM shall visit active project sites and verify that the materials and workmanship are in accordance with approved construction drawings, material submittals and technical specifications. The QCM shall prepare and coordinate material submittal sheets and shop drawing submittals, prepare QC reports, schedule and coordinate testing procedures and attend all status meetings, site visits and pre-final/final inspections. The QCM shall have complete authority to take any action necessary to ensure compliance with the contract requirements. The QCM shall be someone other than the Contract Manager or Project Superintendent. The QCM shall have a minimum of five (5) years of relevant construction quality control experience and shall have completed a course in Construction Quality Management for Contractors. The name of the QCM and alternate(s), who shall act on behalf of the QCM when absent, shall be designated in writing and submitted to the CO for approval at contract award. See SECTION 01 45 00.00 10 QUALITY CONTROL for qualifications of the Construction Quality Control Manager.
1.4.5 Contractor’s Safety Manager (SM): The Safety Manager shall ensure full compliance with all safety requirements on all active projects. The SM cannot be the Project Superintendent. The SM shall meet the requirements of Engineer Manual (EM) 385-1-1 section 1. The training, experience and qualifications of the SM shall be required as per EM 385-1-1. See Specification SECTION 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS for qualifications of the Safety Manager.
1.5 CONTRACTOR EMPLOYEE REQUIREMENTS
The Contractor shall ensure that the employees and subcontractor employees have current, valid licenses and certifications necessary to perform their functions. Any cost or time associated with obtaining licenses or certifications shall be at the Contractor’s expense.
1.6 CONFLICT OF INTEREST
The Contractor shall not employ any person who is nor was an employee of the United States Government, if the CO determines that the employment of that person would create a conflict of interest.
1.7 SUBCONTRACTORS
All subcontractor firms shall be licensed in the State of the proposed project in their specialty where required.
The Prime Contractor shall ensure each subcontractor has a minimum of two (2) years’ experience in related projects of similar size, scope and complexity. Documentation of subcontractors experience shall be provided upon request of the Contracting Officer.
1.8 AVAILABILITY
Throughout the life of this contract, whenever there are active TOs, the CM shall be available to meet with the CO promptly after notification by telephone during normal business hours. The CM shall be available to meet with the CO within twenty-four (24) hours when there are no active TOs. The CO must be able to contact the CM by phone at all times. The CM shall carry a cellular phone for immediate response to contract requirements.
The CM shall provide overall contract management, including full authority to develop TO proposals, negotiate and sign TOs, provide subcontract purchasing and administration, and shall attend all monthly status meetings.
The Contractor shall notify the CO and the Government Project Manager (GPM) when the CM plans to be absent from the site for more than two (2) consecutive work days. Prior to returning to the project, the CM shall notify the CO and the GPM.
1.9 RESPONSE TIMES
The Contractor shall resolve punch-list items on individual task orders within ten (10) calendar days of notification by the Government unless more timely completion is noted elsewhere in the contract requirements.

SECTION 2 – GENERAL REQUIREMENTS
2.1 CODES
All construction accomplished pursuant to this contract shall comply with the most recent edition of applicable federal, state, and local laws, codes, and regulations including but not limited to the following (any exception must be approved in writing by the CO):
2.1.1 Unified Facilities Criteria (UFCs);
2.1.2 Executive Orders (EOs);
2.1.3 Air Force Engineering Technical Letters (AFETLs);
2.1.4 Air Force/DOD instructions, manuals, handbooks, regulations;
2.1.5 Instructions, manuals, handbooks, regulations, guidance, policy letters, and rules (including all changes and amendments);
2.1.6 American Society of Mechanical Engineers (ASME);
2.1.7 American National Standards Institute (ANSI);
2.1.8 National Association of Corrosion Engineers (NACE);
2.1.9 National Plumbing Code (NPC);
2.1.10 National Fire Protection Association (NFPA);
2.1.11 National Electrical Code (NEC);
2.1.12 International Building Code (IBC);
2.1.13 Commonwealth of Massachusetts General Law;
2.1.14 Massachusetts Department of Transportation (MassDOT) Standard Specification for Highways and Bridges (unless the CO directs the Contractor otherwise);
2.1.15 Life Safety Code;
2.1.16 Environmental Protection Agency (EPA) regulations;
2.1.17 National Environmental Policy Act (NEPA);

2.2 ORDER OF PRECEDENCE
Order of precedence is as follows:
1. Statement of Work (SOW)
2. Contract Drawings and/or sketches
3. Contract Specifications, drawings
4. Any other information provided.
For conflicts between requirements included in the SOW, the most stringent requirements shall apply, as determined by the Government. Likewise, for conflicts between requirements outside the SOW, the most stringent requirements shall apply, unless specifically requested in writing by the Government.
2.3 GENERAL REQUIREMENTS
The Basic MACC IDIQ Contract general requirements are detailed in the Division 1 Specifications included as Appendix 1. The attached Division 1 Specifications are applicable to all TO’s issued under this contract. As such, Division 1 Specifications will not be provided with individual RFP’s, only additional or revised specification sections that have been tailored for the RFP will be provided.
Division 1 Specifications may be updated over the life of the Contract. The Contractor shall replace the updated specification sections and the updated sections shall be applicable to all future TO’s.
SECTION 3 – TASK ORDER PROPOSALS
3.1 PROVISIONS ON CONTRACTING OFFICER’S AUTHORITY
Only the CO is authorized to make changes to the contract or any TO issued thereunder. No other Government or non-Government official may alter this contract or any TO issued in accordance with (IAW) the Basic MACC IDIQ contract terms and conditions. The Contractor shall report any attempts to alter this contract or any TO to the CO. In the event the Contractor effects any such changes at the direction of any person other than the CO, the change shall be considered to have been made without authority and no adjustment shall be made in the contract price to cover any increase in costs incurred as a result thereof.
3.2 ORDERING PROCEDURES
As the need arises for performance under the terms of this contract, the CO or their designated representative will provide the CM an RFP that will include a written TO SOW that includes Plans and Specifications or a Design Build RFP. Contractor shall be required to submit proposals on all Task Order Request For Proposal's issued under the MACC IDIQ. The site visit will be scheduled at the earliest possible time, but in most cases not more than ten (10) business days from the date of notification. The CM shall ensure any required company or subcontractor personnel attend a site visit with representatives from Base Civil Engineering and Operational Contracting to review the RFP, clarify the scope of the requirement, verify existing conditions, and obtain whatever measurements and information are necessary to develop a complete and accurate TO proposal. The typical site visit will include but not limited to the following:
3.2.1 Access to the work area;
3.2.2 Review of the SOW, plans and specifications or DB RFP;
3.2.3 Scope clarification questions;
3.2.4 Requirements for Contractor proposal (in addition to those enumerated in this SOW);
3.2.5 Special time requirements for completion, phasing requirements, and liquidated damages.
All scope clarification questions shall be submitted to the Government in writing to the CO. Questions will be accepted from the date of the RFP release until five (5) business days after the Site Visit. Responses to all questions will be shared with all potential Offerors.
3.3 CONTRACTOR PROPOSALS
An acceptable TO proposal shall consist of the following:
3.3.1 TO Cost Proposal: one (1) electronic copy of the Contractor’s completed bid schedule;
3.3.2 Period of Performance: Each TO proposal shall include a brief critical path schedule, taking into account the major work elements, mobilization, material delivery times, anticipated weather delays, and final inspection. The proposed timeline should be of sufficient detail to demonstrate that the Offeror can meet the Governments proposed Period of Performance (POP).
If the Government has a maximum POP it will be stated in the TO SOW. If not the Contractor can propose a POP using the brief critical path schedule. The Offerors proposal cover sheet (See Paragraph 3.3.3) shall clearly state that the requested POP. The POP shall start on the TO award date and not the NTP. The calculated POP is made up of the following:
3.3.2.1 Pre-Construction Period: Not more than 30 calendar days. Time allotted to the Contractor to submit insurance and bonding information, submission of preconstruction submittals required by specifications, and onsite mobilization.
3.3.2.2 Physical Construction: Varies by TO. Time allotted to the Contractor to complete all construction activities required by the TO.
3.4.2.3 Project Closeout: Not more than thirty (30) calendar days. Time allotted to the Contractor to prepare all project close out submittals and submit application for final payment.
3.3.3 Proposal Cover Sheet: Each TO proposal cover sheet shall include contract number, project number, project title, contact information for the CM, performance period, assumptions, exceptions, and the date to which the proposal will be valid. At a minimum each proposal shall be valid for one hundred and twenty
(120) calendar days unless a longer period is requested in the RFP.
3.3.4 Projects in Advance of Funding: During the course of the MACC contract, the Contractor shall, if required, be able to prepare and negotiate TO proposals in advance of funding. These TO projects may not have available funding and there is no guarantee that funds will become available for the award of the project. No separate compensation for any pre-order costs including proposal preparation and attendance during negotiations or site visits will be due to the Contractor for projects that are negotiated and funding is not provided.
3.4 Task ORDER PROPOSAL EVALUATION
The Government will evaluate Offeror proposals based on criteria stated n the Task Order RFP.
3.5 COMMENCEMENT OF WORK
TOs will be issued by the CO using the Department of Defense (DD) Form 1155, Order for Supplies and Services. Each TO will include the following information:
3.5.1 Date of Task Order;
3.5.2 Contract Number and Task Order Number;
3.5.3 Item Number, description, material submittal requirements, quantity and unit prices for items and total;
3.5.4 Task order price and delivery or performance date;
3.5.5 Accounting and appropriation data;
3.5.6 Liquidated damage, if any; and;
3.5.7 Any statement of work, drawings or other pertinent data.
The CO will issue Notice to Proceed NTP after receipt and approval of all required pre-construction submittals.
In rare circumstances, on projects deemed emergencies, the CO may issue verbal direction prior to the issuance of the written TO. In those circumstances, the NTP shall be the date the Contractor received the verbal NTP from the CO with written notification to follow with seventy-two (72) hours.
3.6 PAYMENT OF WORK
All requests for payment under this contract shall be made in accordance with SECTION 01 20 00.00 20 PRICE AND PAYMENT PROCEDURES. The Defense Finance and Accounting Services (DFAS) will reject any applications for payment that are made after the Contracts POP has expired.
SECTION 4 – DESIGN REQUIREMENTS
4.1 DESIGN REQUIREMENTS
TO’s issued under this MACC IDIQ contract may require the preparation of drawings, specifications, or engineering analysis by Registered Professional Engineers and / or Licensed Architects. All design work completed under this contract must be completed in accordance with the following Standards:
