| NO. | REFERENCE | PG. NO. | PARA. NO | ISSUE / COMMENT | QUESTION | GOVERNMENT RESPONSE |
| 1 | Attachment 2H | 1 | II. (a) Table | Reference states: Aircraft public & passenger4. We do not understand why the Government included this FAR clause in Section H. The FAR clause, at best, is ambiguous and does not provide sufficient definition of "public" & "passenger" to make a determination that this clause is applicable in the case of the Government requirement. It is our understanding that all aircraft, aircraft facilities, flight line equipment, etc. will be provided by the Government and as such, the Contractor will be operating Government Aircraft and Government Aircraft systems in performance of PWS requirements. Our understanding of this clause is that it applies to Contractors when the contractor is the provider and operator of aircraft used in performance of task requirements. | Request the Government provide clarification of the FAR clause as used in this case. Rationale: The Government lifted the exact words from the FAR and inserted it into Section H. There were no metrics associated with each type MDS to assist bidders with determining the extent of insurance requirements. |
Request Govt confirm it will indemnify Contractors performing on military aircraft or create a cost reimbursable CLIN for desired level of insurance.
| FAR Clause 52.228-5, Insurance --Work on a Government Installation, is required for FFP contract that exceeds the simplified acquisition threshold. FAR 28.306(b)(1) states coverage specified in FAR 28.307 is the minimum insurance required and shall be included in the contract Schedule or elsewhere in the contract. As such, Attachment 2H Section II, paragraph (a) is included in the RFP to provide a information on the extent of insurance requirement for this RFP. | |||||
| 2 | Attachment 2H | 1 | II. (a) Table | Refer to row which addresses Aircraft public & passenger insurance. The words on this row are lifted straight from FAR 28.307-2(d) with no additional clarification. Does the Government require contractors to obtain liability/bodily injury insurance for all occupants of military aircraft when contract instructors are performing on the aircraft? Does the Government require contractors to obtain bodily injury insurance for the maximum number of occupants on each type MDS? To obtain insurance quotes in time for pricing, we may require substantially more information that what is provide in Section H and the Solicitation documentation. Insurers may require lists of aircraft to be used, maintenance and flight records, and specific schedules where Contractors will be operating and or flying on aircraft. | Request the Government clarify the use of this FAR clause and provide additional explanation of the requirement. The FAR, as written, is ambiguous and in our opinion, not all aspects of the FAR clause applies when operating Military-owned and maintained aircraft and aircraft systems. |
Request Govt confirm it will indemnify Contractors performing on military aircraft or create a cost reimbursable CLIN for desired level of insurance.
| Please refer to FAR 28.307-2(d). Aircraft will be used in performing this contract, therefore, contractor must maintain the minimum insurance requirement specified in the section or as specified in Attachment 2H, Section II, paragraph (a). | ||||||
| 3 | Attachment 2H | 1 | II. (a) Table | Refer to row which addresses Aircraft public & passenger insurance. Recommend the insurance expense be made a Cost Reimbursable expense on the contract. Since this is a Low Price competition, we do not recommend that the cost of Aircraft Public & Passenger Insurance be turned into a competitive low-price factor. | Recommend the Government clarify the insurance requirement. If liability and bodily harm insurance remains a Contractor requirement to maintain, recommend making it a Cost Reimbursable expense against the contract. | Contractor is required to maintian minimum liability coverage per FAR 28.307-2, Liability. This will not be a cost reimbursable expense. |
| 4 | Attachment 2H | 1 | II. (a) Table | Reference states: Vessel5 When contract performance involves use of vessels, the contracting officer shall require, as determined by the agency, vessel collision liability and protection and indemnity liability insurance. The Government has inserted the FAR clause without explanation. The legal definition of “vessel” includes aircraft. Does the contract require use of a "Vessel"? If so, what is the definition of Vessel as used in this context. | Request the Government clarify the use of this FAR clause. As written it is ambiguous and does not provide sufficient information to determine cost factors. |
Request Govt confirm it will indemnify Contractors performing on military aircraft or create a cost reimbursable CLIN for desired level of insurance.
| Vessels insurance coverage requirement is not applicable to this requirement. | ||||||
| 5 | Attachment 2H | 1 | II. (a) Table | Reference states: Vessel5 When contract performance involves use of vessels, the contracting officer shall require, as determined by the agency, vessel collision liability and protection and indemnity liability insurance. This requirement is ambiguous and does not provide sufficient information to determine whether to apply cost factors during pricing of the effort. | Request the Government clarify the use of this FAR Clause and whether costs associated with "Vessel" insurance will be treated as a Cost Reimbursable expense. | Vessels insurance coverage requirement is not applicable to this requirement. |
| 6 | RFP | Table L0003-1 | The government response to question #68 posted last night indicates that signed JV documentation is to be placed in Volume III, Technical in addition to Volume I. However, Table L0003-1 – Proposal Organization does not have a placeholder for Teaming Arrangements or JV Documentation in the Volume III outline. | Where would the government like this information to be placed in Volume III? | JV and teaming arrangements does not need to be in Volume III. See revised RFP. |
