E.1 AMS CLAUSE 3.1-1 CLAUSES INCORPORATED BY REFERENCE (JULY 2011)

This screening information request (SIR) or contract, as applicable, incorporates by reference the provisions or clauses listed below with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make the full text available, or offerors and contractors may obtain the full text via Internet at: http://conwrite.faa.gov/.

FEDERAL AVIATION ADMINISTRATION CLAUSES INCORPORATED BY REFERENCE

REFERENCE TITLE

3.10.4-2 Inspection of Supplies – Fixed-Price (Nov 1997)

3.10.4-4 Inspection of Supplies – Both Fixed-Price & Cost

Reimbursement (Apr 1996)

3.10.4-16 Responsibility for Supplies (Apr 1996)

E.2 POINTS OF INSPECTION AND ACCEPTANCE

E.2.1 Supplies and/or services must be inspected and accepted at the specified location.

Acceptance will be made by the CO, COTR, or designated FAA representative. The system has been accepted when the Contractor demonstrates to the FAA that the system meets all requirements described in Section C. The FAA will be contacted with 60 days notification when inspections are needed.

E.2.2 The FAA will provide a written notification of acceptance or rejection within 30 calendar days of receipt of the final product. Specific justification or substantiation of the reason(s) for rejection will also accompany the notice. If the FAA determines that there are omissions, errors, or deficiencies, in the contractor’s equipment, the Contractor must make the necessary correction that will allow the Government to accept the final product. The Contractor must correct the report or deliverable within 7 working days unless otherwise specified.

E.3 QUALITY ASSURANCE PROGRAM

Quality Assurance is applicable to all phases of the ATIS Requirement. The Contractor must establish and maintain a Quality Assurance program in accordance with American National Standards Institute (ANSI)/American Society for Quality (ASQ) International Organization for Standardization (ISO) 9001- 2008, or equivalent.

The inspection requirements specifically set forth in this SOW and Section E must become a part of the Contractor's overall Quality Assurance program. The absence of Government inspection does not relieve the Contractor of the responsibility of ensuring that all services, products or supplies submitted to the Government for acceptance comply with all requirements of the contract. The Contractor must establish and maintain a Quality Assurance program and provide the procedures and controls to ensure that all requirements of the contract are met.
