About this file
This is a Construction Waste Management Plan document issued by the City of Palm Desert Building and Safety Division that applies to the California Villas Pool Improvement Project being undertaken by the Palm Desert Housing Authority. The document outlines mandatory waste diversion requirements under California Green Building Code (CALGreen) standards and Palm Desert Ordinance No. 1388, which mandate that construction and demolition projects achieve a minimum 65% diversion rate of non-hazardous debris through recycling, salvage, or reuse, with 100% diversion required for land-clearing debris such as dirt, rock, and landscape materials. The pool improvement project scope includes removal of existing pool and spa plaster, surface preparation and new plaster installation, waterline tile cleaning and restoration, installation of LED pool and spa lights, application of brick clay coping sealer, and repair and repaint of pool and spa deck surfaces. The CWMP must be completed and submitted with the building permit application to the City's Development Services Center, and monthly recycling progress reports must be provided to the District Environmental Coordinator during project execution.
All construction and demolition waste hauling must be conducted exclusively through either direct contractor self-hauling with a Self-Hauling Permit or through Burrtec Waste & Recycling Services, the City's franchised waste hauler. A final diversion report approved by Burrtec must be uploaded to the City's e-TRAKiT portal and submitted to the Building and Safety Division prior to issuance of Certificate of Occupancy, Temporary Certificate of Occupancy, or Final Inspection. The applicant acknowledges understanding that failure to comply with Ordinance No. 1388 constitutes a misdemeanor punishable by up to six months imprisonment or a fine up to $1,000, or both, and may result in job stop orders or delays in final project approval. Free technical assistance and guidance for regulatory compliance is available through the City's District Environmental Coordinator at (760) 674-1026, with additional information available through the City's permit center at (760) 776-6435 or permitcenter@palmdesert.gov.

*PLEASE CONTACT BURRTEC AS OUTLINED BELOW
Construction and Demolition (C&D) waste accounts for 29% of materials going into landfills. The City of Palm Desert is mandated by State law to help reduce the amount of material hauled to landfills through the California Green Building Code (CALGreen). The City has created a process to make compliance easy through the C&D Diversion Program, and it all starts with a Construction Waste Management Plan.
A Construction Waste Management Plan (CWMP) is necessary to demonstrate compliance with State regulations for your C&D project. A CWMP ensures that C&D projects salvage, reuse, or recycle all inert solids (i.e. concrete, drywall, brick, asphalt, glass, plaster, clay, etc.) and divert at least 65% of all other debris generated by your project. This 65% diversion requirement, including 100% diversion of land clearing debris (i.e., dirt, rock, landscape material, etc.), is a mandatory requirement of the CALGreen requirements (See Palm Desert Environmental Programs!!)
The following projects are required to submit a Construction Waste Management Plan and comply with CALGreen:
Residential
1. Newly constructed low- and high-rise residential buildings such as:
• Hotels, motels, and lodging houses.
• Apartments and condominiums.
• One and two-family dwellings and townhouses.
• Dormitories, shelters for homeless people, congregate residences, and employee housing.
• Other types of dwellings containing sleeping accommodations with or without common toilets or cooking facilities.
• Factory-built housing.
• Accessory Dwelling Units (ADU) built in accordance with the California
Building Standards Code.
• Live/Work Units.
• Accessory structures serving residential buildings.
2. Additions or alterations of existing residential buildings where the addition or alteration increases the building’s conditioned area, volume, or size. The CALGreen requirements are only applicable within the specific area of addition or alteration.
Commercial or Non-residential:
1. Newly constructed buildings.
2. Building additions of 1,000 square feet or greater.
3. Building alterations with a permit valuation of $200,000 or above (for occupancies with the California Building Code. Code requirements for additions and alterations shall only apply to the portions of the building being added or altered within the scope of the permitted work.
Note: Minor electrical, plumbing, and mechanical permits are exempt.
