About this file

This is a Bid Guarantee (Bid Bond) form for the City of Palm Desert related to the California Villas Pool Improvement Project (Project No. CHA00016) managed by the Palm Desert Housing Authority. The bid bond serves as bidder security and is required unless alternative forms of security such as cash, certified check, or cashier's check accompany the bid submission. The bond obligates the principal contractor and surety jointly and severally to the City of Palm Desert in a penal sum equal to ten percent (10%) of the total bid price. The bond condition stipulates that if the principal does not withdraw its bid within the specified timeframe, is awarded the contract, and provides all required documents to the City as outlined in the contract documents, the obligation becomes null and void. Otherwise, the bond remains in full force and effect.

The surety waives notice of any changes, extensions of time, alterations, or additions to the contract terms and agrees that such modifications do not affect its obligation under the bond. In the event the City pursues legal action against the bond, the surety is responsible for paying all litigation expenses incurred by the City, including reasonable attorneys' fees, court costs, and expert witness fees. The bond requires execution by both the contractor/principal and the surety (with an Attorney-in-Fact Certificate attached), along with notarization by a California notary public. Separate notary acknowledgments are required for both the contractor/principal and the surety's attorney-in-fact, with the latter requiring an attached power-of-attorney to the bonding company's local representative.
