About this file

This is Amendment No. 4 to Contract No. GC904 between the Florida Department of Environmental Protection (FDEP) and Geosyntec Consultants, Inc., a consulting firm located in Tallahassee, Florida. The original contract became effective March 1, 2017, and covers environmental forensics site investigation, technical support services, verification assessment, baseline data collection, special case studies, statistics and data evaluation, tank abandonment, and tank removal services. The amendment was executed on September 5, 2025, pursuant to DEP Solicitation No. RFP 2017008C and authorization under PUR 1000, provision 4(e).

Amendment No. 4 implements an equitable price adjustment to the contract rate schedule, effective only for new task assignments executed on or after the amendment execution date. The revised rates are detailed in Attachment B-1 (Revised Rate Schedule), which supersedes the prior Attachment B for all future work, while previously executed task assignments continue under the original rate schedule. The amendment also replaces Exhibit C (Special Terms and Conditions) with Exhibit C-1 (Revised Special Terms and Conditions), which maintains insurance requirements including $1,000,000 commercial general liability and workers' compensation coverage, permits subcontracting with prior written approval, allows personnel changes at no additional cost, and imposes liquidated damages of 5% per week for late deliverables up to the total compensation amount. The revised rate schedule covers multiple service categories including office activities, field activities, mobilization, drilling and boring, well installation and abandonment, sample collection and field testing, laboratory analysis, soil source removal, petroleum storage tank services, debris and waste removal, resurfacing, reports, and personnel services, with rates escalating annually over the contract term.

STATE OF FLORIDA

DEPARTMENT OF ENVIRONMENTAL PROTECTION

Revised Special Terms and Conditions

EXHIBIT C-1

These Special Terms and Conditions shall be read together with general terms outlined in the Standard Terms and Conditions, Attachment 1. Where in conflict, these more specific terms shall apply.

1. Insurance.

Required Coverage. At all times during the Contract the Contractor, at its sole expense, shall maintain insurance coverage of such types and with such terms and limits described below. The limits of coverage under each policy maintained by the Contractor shall not be interpreted as limiting the Contractor’s liability and obligations under the Contract. All insurance policies shall be through insurers licensed and authorized to issue policies in Florida.

Additional insurance requirements for this Contract may be required elsewhere in this Contract, however the minimum insurance requirements applicable to this Contract are:

a. Commercial General Liability Insurance.

The Contractor shall provide adequate commercial general liability insurance coverage and hold such liability insurance at all times during the Contract. The Department, its employees, and officers shall be named as an additional insured on any general liability policies. The minimum limits shall be $1,000,000 for each occurrence and $1,000,000 policy aggregate.

b. Commercial Automobile Insurance.

If the Contractor’s duties include the use of a commercial vehicle, the Contractor shall maintain automobile liability, bodily injury, and property damage coverage. Insuring clauses for both bodily injury and property damage shall provide coverage on an occurrence basis. The Department, its employees, and officers shall be named as an additional insured on any automobile insurance policy. The minimum limits shall be as follows:

$1,000,000/300,000 Automobile Liability for Company-Owned Vehicles, if applicable $1,000,000/300,000 Hired and Non-owned Automobile Liability Coverage

c. Workers’ Compensation and Employer’s Liability Coverage.

The Contractor shall provide workers’ compensation, in accordance with Chapter 440, F.S., and employer’s liability insurance with minimum limits of $100,000 per accident, $100,000 per person, and $500,000 policy aggregate. Such policies shall cover all employees engaged in any work under the Contract.

d. Other Insurance.

None.

2. Payment and Performance Bonds.

There are no bonds required under this Contract.

3. Liquidated Damages.

In addition to other remedies elsewhere in this Contract, and as provided by law, unless otherwise stipulated in the Scope of Work, the Contractor hereby covenants and agrees to pay liquidated damages to the Department as follows:

a. The Contractor acknowledges that time is of the essence for all services provided under this Contract, and the actual damages to be suffered by late performance and the damages suffered by failing to meet the standards as outlined in the Scope of Work are incapable of accurate calculation. Therefore, the parties agree that it is in the parties’ best interests to agree upon a reasonable amount of liquidated damages, which are not intended to be a penalty and are solely intended to compensate for unknown and unascertainable damages.

b. In addition to any other provisions of this Contract, in the event that the deliverable identified in the Scope, is not completed and submitted by the close of business on the date the deliverable is due, the compensation…
