Bid Bond Form for West Virginia Transitional Living Facility HVAC Replacement

This is a Bid Bond Form required by the State of West Virginia, Department of Administration, Purchasing Section for the Transitional Living Facility HVAC Replacement project. The bond serves as a guarantee that a bidder will enter into a contract if their bid is accepted and will furnish any required bonds and insurance as specified in the bid documents. The form establishes a penal sum (bond amount) that represents the maximum liability of the surety in the event of non-performance or bid rejection. The bond conditions provide that the obligation becomes null and void if the bid is rejected or if the bidder accepts the contract and performs all required obligations; otherwise, the bond remains in full force and effect.

The surety executing the bond must be licensed in West Virginia to transact surety insurance and must affix its seal along with an attached power of attorney. The form requires signatures from authorized representatives of both the principal (bidder) and the surety, with the principal signature requiring authorization at the level of President, Vice President, or Duly Authorized Agent. The surety's liability is expressly limited to the stated penal amount, and the surety waives notice of any extensions granted by the obligee for bid acceptance. This bond protects the State of West Virginia by ensuring bidder compliance and contract performance.
